Sec. 56. When any treasurer shall have levied on personal sale of property for the non-payment of any tax or assessment in this taxes. act provided, he shall proceed to advertise and sell the same in the same manner and upon like notice, and make return of all money received therefrom, as is or may be required by the general laws of this State in the levy and sale of personal property for the non-payment of taxes by township treasurers. They shall have power to define what are such lateral pipes, and shall cause the same to be laid and provide for the payment thereof in the same manner as is provided in said act for making and paying for street improvements, not requiring the taking of lands or private property by said city.

Sec. 6. AN ACT to amend section forty of an act entitled "An act to incorporate the village of Ovid," approved March twentyfourth, eighteen hundred and sixty-nine, and to add a new section thereto, to stand as section two.

SECTION 1. The People of the State of Michigan enact, That section forty of an act entitled "An act to incorporate the village of Ovid," approved March twenty-fourth, eighteen hundred and sixty-nine, be and the same is hereby amended so as to read as follows:

Sec. 40. If, at any annual or special township meeting of the electors of the township of Ovid, there shall be voted any sum of money as an appropriation for highways and bridges, the real and personal property within the corporate limits of the village of Ovid shall be exempted from taxation for such appropriation, and any sum of money so voted, or any part thereof, shall not be laid out or expended within the said village limits. The common council of said village shall have exclusive power and authority to raise annually, by a general tax upon the real and personal property in said village liable to taxation, such sums of money as they may deem necessary, to be expended on the streets, highways and bridges within said village, and to defray the expenses and liabilities incurred by said village, and to carry into effect the powers hereby conferred on them; and they shall, on or before the first day of June in each year, determine by resolution the amount of taxes necessary to be levied for said purposes during the year: Provided, That the taxes so determined to be levied shall not exceed, in any one year, one per cent upon the assessed valuation of taxable property in said village, exclusive of and in addition to any taxes which may be levied by virtue of any provisions of this act as a special assessment for public or local improvements; and every tax lawfully imposed by the common council upon any lands, tenements, and hereditaments in said village shall be and remain a lien upon such

SECTION 1. Sec. 41. The recorder, after such statement and tax-roll shall have been delivered to him under the direction of the common council, and in pursuance of any ordinance or resolution of the common council, shall proceed to sell at public auction. at some public place in said village, said lands, or a sufficient amount thereof to pay said return taxes; and in case a less amount than the whole tract returned is sold for the payment of such taxes, the same shall be taken, as provided by the general laws governing tax sales, from the northern portion. thereof returned in said statement on account of the non-payment of taxes thereon, first giving at least thirty days' notice of the time and place of such sale by publishing the same at least four weeks, once in each week, previous to said sale, in some paper published in Bay county, which notice or advertisement shall contain a description of the lands and the names of the owners, if known, and the amount for which the same is to be sold. On the day mentioned for such sale. said recorder shall commence the sale of said lands, and continue the same until all the said lands shall be sold, and said Certificate to recorder shall give to the purchaser of any such lands so sold. a certificate in writing, describing the lands purchased and the sum paid therefor, and the time when such purchaser will be entitled to a deed of the same: Provided, That in case any failure to sell such parcel of land cannot be sold for the amount of such taxes and expenses, the recorder shall bid off the same for the use and benefit of the said village of Wenona, and shall make out a like certificate of sale with like effect in all respects as certificates given other purchasers; and on completion of sales ment to made by virtue of the provisions of this section, the recorder lands sold. shall make and deliver to the treasurer of said village a state

Sec. 57. Sec. 62. All apportionments for the purpose of such assessments to be upon the basis of the value of each tract or parcel of land within such taxing district: Provided, That that portion of the street, Proviso. lane, or alley to be so planked or widened shall be situate wholly within such taxing district, and that the expense thereof shall not exceed four per centum of the aggregate valuation of the tracts and parcels of land so assessed situate within such taxing district, as appears from the assessment thereof as shown by the then last general assessment roll of said village.
