laying out a new street commencing at the north east corner of block forty-six, and running to a point two rods west of the south east corner of a white house on block thirty-eight, thence in the same direction to River alley; said line to be the west side of said new street, which street is to be four rods wide, shall be valid and of full force, the same as if the vote of the trustees in said act had been recorded in due form of law.

AN ACT

To authorize school district No. 1, in the town of Summit, to levy a tax for the purpose of paying the expenses of building a school house.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin :

SECTION 1. That the trustees of school district number one, in the town of Summit, in Waukesha county, be and are hereby authorized to levy and collect a tax of a sum not exceeding two hundred and twenty-five dollars on the taxable property in said district, for the purpose of paying the expenses of building a school house in said district: Provided,

that a majority of the legal voters in said district, present at a school meeting called in said district by the trustees thereof for that purpose, ten days previous notice being given, shall vote for levying the tax authorized by this act.

SEC. 2. The said tax to be collected as other school taxes are now by law collected.

AN ACT

To provide for the payment of the heirs of the late Thomas P. Burnett, deceased, for reporting the decisions of the supreme court of the territory of Wisconsin.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. The sum of seven hundred and fifty dollars is hereby appropriated for the heirs of the late Thomas P. Burnett, deceased, by [to] be drawn by their guardian or guar dians as a compensation for his services as reporter of the supreme court of said territory for the years 1844, 1845 and 1846: Provided, That the auditor of said territory shall not issue warrants for any part of this appropriation until there shall be filed in his office the certificate of the superintendent of territorial property showing that the manuscript of each of said years has been prepared for publication, and has been

deposited in the territorial library; and for each year so certified, amounting to two hundred and fifty dollars a year, warrants may be issued.

AN ACT

To divorce Mary Smith from her husband John Smith, and to change her name.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the marriage contract heretofore existing between Mary Smith and her husband John Smith, be, and the same is hereby dissolved, and the parties are hereby restored to all the rights and privileges of unmarried per

sons.

SEC. 2. That the lawful name of Mary Smith shall hereafter be Mary Moore, by which name she shall be called and known to all legal intents and purposes.

AN ACT

To authorize the levy of a special tax in the fifth ward of the city of Milwaukee.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the aldermen of the fifth ward of the city of Milwaukee be, and they are hereby authorized to levy and collect a special tax on the city lots lying in said ward; said tax to be applied towards the grading, filling, or construction of the streets in said ward: Provided, That in laying said tax for the grading, filling or constructing of any particular street, not more than three-fourths of the cost of so grading, filling, or constructing such street shall be levied upon the lots fronting on such street; and which shall be distributed upon such lots according to their fronts throughout the whole extent of such street.

AN ACT

To authorize the adjutant general to draw on the treasurer for money to meet certain ex

penses.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the treasurer of the territory is hereby authorized to pay on the draft of the adjutant general such sum or sums of money as may be necessary to meet the expenditures of that office authorized by law, as also the expenses of the several commanders of regimental and battalion commands in promulgating general orders from the commander-in-chief; the said sum or sums of money not to ex ceed one hundred and sixty dollars; for the faithful expenditure of which the adjutant general shall account with the auditor of the territory, and make report to the next legisla

ture.
