of them may own in sections one and two north, in town number two, of range number twelve east, and to make use of the water in said stream for propelling any kind of machinery they may see fit to erect, and they may sell or lease the right to use said water, to any person whatsoever: Provided, however, said dam shall be so constructed as not to flow any lands or water privileges not belonging to said Smith and Miltimore.

Sec. 2. As soon as Rock river shall be improved and rendered navigable to said dam, the owners of said dam shall construct a convenient lock, rot less than one hundred feet long, between the gates, and not less then twenty-four feet wide in the clear of the chamber, for the passage of boats, barges, and other water craft. Said lock to be in readiness for the passage of boats, bar ges, and other water craft when said river shall be improved; and the proprietors of said dam shall maintain said lock, and shall attend the passage of all boats, barges, and water craft through said lock, free of all charge to the owners thereof.

Sec. 3. The said Smith and Miltimore, their successors, associates, and assigns, shall, whenever they construct said dam, construct also a slide, or chute, in such manner as to allow the passage of rafts over said dam, as well as to permit the ascent and descent of fish in said stream.

SEC. 4. The legislature of the territory, or state of Wiscon sin, may at any time alter or amend this act.

AN ACT

To make the official certificate of any register or receiver of any land office of the United States, in this territory, evidence in certain cases.

Be it enacted by the Council and Horse of Representatives of the Territory of Wisconsin:

SECTION 1. That the official certificate of any register or re- Certificate ceiver, of any land office of the United States, in this territory, how regardof the entry or purchase of any tract of land, or of the location of any tract or tracts of land, by a military land warrant, within his district, shall be deemed and taken to be prima facie evidence of title in the party who made such entry or purchase, or his heirs or assigns, and shall enable such party, his heirs or assigns, to recover the possession of the land described in such certificate in any action of ejectment, or forcible entry and detainer, unless a better legal title be exhibited for the same: Provided always, that no such certificate shall be taken as evidence, nor entitle the holder or holders thereof, his, her, or their heirs, or assigns, to have or maintain any action in law or equity, for any lands held, owned, or occupied by any person or persons, as mineral ground, at the time of the entry of said tract or tracts of land, on which discoveries of lead or copper ore had been made, at or previous to the time of entry of said land.

Tax may be collected.

AN ACT

To authorize school district number six in the town of Summit to levy a tax to pay the expenses of building a school house.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the trustees of school district number six in the town of Summit, in Waukesha county, be, and hereby are authorized to levy and collect a tax of a sum not exceeding two hundred and twenty-five dollars on the taxable property in said district, for the purpose of paying the expenses of building a school house in said district: Provided, that a majority of the legal voters in said school district, present at a school meeting called in said district by the trustees thereof for that purpose, ten days previous notice being given, shall vote in favor of levying the tax authorized by this act.

SEC. 2. The said tax to be collected as other school taxes are now by law collected.

AN ACT

To dissolve the marriage contract between Orman Crandall and Angeline Crandall.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

Section 1. That the marriage contract heretofore existing between Orman Crandall and Angeline Crandall be, and the same is hereby dissolved, and the parties to the said contract are by virtue of this act restored to all the rights and privileges of unmarried persons.

PREAMBLE AND RESOLUTIONS

Relative to the death of Silas Wright.

Whereas the dignity and power of a state, no less than the prosperity and happiness of its people, depend in an eminent degree upon the wisdom, integrity and patriotism of its citiAnd whereas, the legislative assembly of Wisconsin

zens:

recognizes in the life of the late Silas Wright, of New York, all that could adorn and dignify the character of the citizen the statesman, and the patriot. Therefore

Be it resolved by the Council and House of Representatives of the Territory of Wisconsin:

That in his death the nation has lost one of its brightest ornaments; the commerce of the west one of its ablest advocates; Wisconsin one of its warmest friends and supporters, and the cause of universal freedom one of the boldest and most incorruptible of its champions.

Resolved, That while we thus express the universal sentiment of the people of Wisconsin, we desire also respectfully to mingle our sympathies with those of the bereaved widow and family of the deceased.

Resolved, That his excellency the governor be requested to transmit a copy of the foregoing preamble and resolutions, together with a copy of his late annual message to the widew of the deceased.
