AN ACT

Authorizing F. William Allerding, his associates or assigns, to build a dam across the Milwaukee river.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That F. William Allerding, and his associates Dam to be constructed. or assigns, be, and they are hereby authorized to build and construct and maintain and continue a dam suitable for milling purposes across the Milwaukee river, on any land owned by them on fractional lots numbers two and three of section number four, in township number seven, north of range number twenty-two east: Provided, that such dam shall be so constructed as to admit of the passage of rafts on said river without unreasonable inconvenience or delay.

SEC. 2. The said dam and the owners thereof shall be sub- Subject to ject to all the provisions of an act entitled "An act in relation certain proto mills and mill dams," approved January 13th, 1840.

AN ACT

To legalize a school tax in Phelps school district -number three in Germantown, Washington county, and authorize said district to levy an additional tax to build a school house.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That the tax of one hundred and ten dollars lev ied in Phelps school district number three in Germantown, Washington county, for building a school house, is hereby declared to be legal and valid, and that said tax be collected and accounted for in the same manner as other school district taxes: Provided, that the legal voters of said district at any meeting legally convened shall vote to confirm said assessment.

SEC. 2. The trustees of said Phelps school district number three are hereby authorized to levy an additional tax upon the taxable property in said district, not to exceed ninety dollars, to be applied to the building of a school house in said district.

SEC. 3. The said tax shall be levied and collected in the same manner as now provided by law for the collection of taxes: Provided, that the legal voters of said district vote to raise such sum in the manner now provided by law.

AN ACT

To authorize the county of Waukesha to procure certain records from the county of Milwaukee.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin :

SECTION 1. That the board of supervisors of the county Records to be procured. of Waukesha is hereby authorized and empowered to appoint some suitable person to procure from the records in the . office of the register of deeds of Milwaukee county, true and exact copies of the records of all deeds, mortgages, and other instruments recorded in said office, which relate to or affect lands or real estate situate within the limits of the said county of Waukesha, and record the same in a book or books to be provided for that purpose by said board, and to arrange and prepare an alphabetical index to the records so copied.

SEC. 2. The said board may appoint some other suitable Ib. person to procure from the records in the office of the district. surveyor in Milwankee county, true and exact copies of the surveys of villages, roads, and subdivisions of sections, situate. within the limits of the said county of Waukesha.

SEC. 3. Each of said persons so appointed shall affix to said Certificato to records by him so copied, a certificate under oath, that the same are true and correct copies of the original records, and were procured by him in pursuance of his appointment under the provisions of this act.

SEC. 4. The register of deeds and the district surveyor of Access to records given said county of Milwaukee shall each permit the person so appointed to have access to the records of his office for the purpose of procuring such copies: Provided, the same shall not interfere with the regular discharge of the duties of his office. SEC. 5. The copies of such records, made and certified as Copied reaords legal hereinbefore provided, shall have the same force and effect, and evidence.

be admitted in evidence in the same manner as the original records.

SEC. 6. Each of said persons so appointed shall be paid out of the treasury of the county of Waukesha for performing the duties of his appointment, such sum as shall have been agreed to be paid by said board, and by him to be received; but no extra compensation shall be allowed or agreed to be paid by said board.

SEC. 7. Said board may require either or both of said perbe required. sons respectively so appointed to enter into bonds to said county of Waukesha, with one or more sureties to be approved by said board, conditioned for the faithful performance of the duties of their respective appointments.

AN ACT

Granting to A. L. Gregoire and George W. Jones, the right to keep and maintain a ferry across the Mississippi river.

Be it enacted by the Council and House of Representatives of the Territory of Wisconsin:

SECTION 1. That A. L. Gregoire and George W. Jones, their heirs, executors, and administrators, or assigns, shall have the exclusive right and privilege, for the period of fifteen years,

of keeping and maintaining a ferry across the Mississippi river, from the east bank of said river to the west bank of the said Mississippi river, on section thirty-two, in township number one, north of range number two west, commonly known as Boat Yard Hollow.

SEC. 2. And the said ferry shall be subject to such regula- Subject to certain protions as other ferries are, or may by law be subject, fixing the rates of toll, and the manner in which licensed ferries shall be kept and attended to; and no ferry shall be licensed within two miles of the point where the ferry above provided for shall be established.

SEC. 3. This act may be amended or repealed by any future legislature of the territory, or future state of Wisconsin.
