An Act to Amend and Consolidate the Law with respect to Affidavits and Declarations.

[23rd April, 1892.]

ER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1. This Act may be cited as the "Oaths Act, 1892."

2. Any Judge of the Supreme Court of this Province may, by one or Appointment of more commission or commissions under the seal of such Court, from Commissioners to time to time empower so many persons in the Province as he may think fit and necessary, to take and receive all and every such affidavit and affirmation (in cases where by law an affirmation is allowed) as any person or persons may desire to make in or concerning any cause, matter, or thing, depending or in anywise concerning any of the proceedings in the Courts of the Province.

3. Every such affidavit and affirmation may be read and made use Affidavits, how used. of in such Courts and shall be of the same force as if taken in open Court.

4. Any such Judge as aforesaid may, from time to time, in manner Appointment of aforesaid, appoint the same or other persons to be Commissioners in Commissioners to take recognizances of the Province, to take and receive all and every such recognizances of bail. bail as any person or persons may at any time desire to acknowledge or make in any action or suit depending in the said Courts, in such manner and form and by such recognizances of bail as the Judges of the said Court may take.

5. The recognizance of bail or bail piece, so taken as aforesaid, shall be filed in the office of the Registrar or District Registrar of such Supreme Court, as the case may require, together with an affidavit of the due taking of the recognizance by some credible person present at the taking thereof.

6. The recognizance so taken and filed shall be of the like effect, and subject to exception as to the bail in like manner, and within the same. time, as if taken in open Court.

7. Any Judge of the Supreme Court may take recognizances of bail in any action, which recognizances shall be filed as aforesaid without an affidavit, and shall be of the like effect as if taken in open Court.

Revocation of com- 9. The Supreme Court may revoke the commission of any such Commissioner, whether the commission was issued under any previous Statute in that behalf or shall be issued under this Act, and such revocation shall operate as a revocation for all purposes.

10. The Lieutenant-Governor in Council may, by one or more commissioners for taking mission or commissions under his hand and seal, from time to time, affidavits without the Province. empower such and as many persons as he may think fit and necessary to administer oaths, and take and receive affidavits, declarations and affirmations without the Province of British Columbia, in or concerning any cause, matter, or thing depending, or in anywise concerning any of the proceedings to be had in the Supreme Court or any other Court in the Province, and every oath, affidavit, declaration, or affirmation taken or made as aforesaid, shall be as valid and effectual, and shall be Effect of affidavits of the like force and effect to all intents and purposes as if such oath,

11. The Commissioners so appointed shall be styled "Commissioners for taking affidavits in and for the Courts of British Columbia;" and for every such commission the sum of ten dollars shall be charged.

12. Oaths, affidavits, declarations or affirmations administered, sworn, may be made before made or affirmed, out of the Province of British Columbia before some certain functionaries one of the following persons:

in the United King

dom or foreign parts.

A Commissioner authorized to administer oaths in the Supreme Court of Judicature in England;

A Judge of any of the Superior Courts in England, Ireland or Scotland;
