An Act to amend the "Cattle Ranges Act," and the c. A., 1888, c. 15. "Cattle Ranges Amendment Act, 1890."

ER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as

follows:

1. Sections 2, 3, 4, 5 and 6 of the "Cattle Ranges Act" are hereby c. A., 1888, c. 15, repealed, and the following substituted therefor:ss. repealed. "2. In the construction of this Act the word 'cattle' shall include Interpretation. horses, mares, geldings, colts, bulls, bullocks, cows, heifers, steers, calves and mules; sheep' shall include rams, ewes, wethers and lambs."

"3. owner of any cattle, sheep or swine shall depasture or keep the same on such common or commons, except as aforesaid, or shall in passing over such common or commons, permit the same to remain thereon for a longer period than twenty-four hours, he shall be liable to a penalty of not more than one hundred dollars, to be recovered in a summary way before any Justice of the Peace, and in default of payment shall be imprisoned for any period not exceeding one month. "5. In and for the year 1892, and in and for each of the following tured on commons. years, there shall be levied and paid upon and in respect of the cattle or sheep of every person depasturing or keeping the same upon such common or commons, such sums as the Lieutenant-Governor in Council may from time to time fix, which sums respectively shall be paid by the person assessed before the fifteenth day of November in each and every year, to such officer as the Lieutenant-Governor in Council shall appoint. Such sums shall not be less than ten cents or greater than twenty-five cents for each head of cattle so depastured or kept upon such common, nor less than two cents nor greater than five cents for each head of sheep so depastured or kept upon such common.

"6. In event of all the residents or land-owners who depasture their cattle or sheep upon such common or commons being willing to fence such common or commons at their own expense, it shall be lawful for them to do so; provided always, that it shall be lawful for any person, entitled so to do by the 'Land Act,' to pre-empt land within such Land fenced may be fence, on condition that he agrees to abide by the laws or by-laws pre-empted. for the regulation of the common which may be enacted from time to time by the Board of Overseers (if any) appointed for such district or polling division under the Cattle Ranges Act,' and amendments thereto."

Short title.

2. Section 7 of the "Cattle Ranges Act" is hereby amended by adding after the word "cattle," wherever same therein appears, the words "or sheep."

3. Section 17 of the "Cattle Ranges Act" is hereby amended by striking out the words after " swine," in the third line, down to and inclusive of the word fence," in the fourth line, and substituting therefor the words " on common lands.”

4. Section 10 of the "Cattle Ranges Amendment Act, 1890," is hereby amended by striking out the words after "Province," in the fourth line, down to and inclusive of the word "mountains."

5. This Act may be cited as the "Cattle Ranges Amendment Act, 1892."

An Act respecting the "Companies Act, 1890."

ER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1890, Chap. 6.

1. Section 11 of the "Companies' Act, 1890," is hereby amended Amends s. 11. by striking out the words "and residents of the Province," in the third line, and by inserting after the word "but," on the sixth line, the words "a majority of the said trustees shall be residents of this Province and."

2. And whereas there is a clerical error in section 49 of the said Rectifies error in s. Act which it is expedient to correct: therefore be it enacted as follows:The word "convertible" is hereby substituted for the word "controvertible," which occurs in the second line of section 49 of the "Companies Act, 1890," and in reading and construing the said section, both as to past and future cases, the expression "controvertible" shall be deemed to and shall mean "convertible."

CHAPTER 7.

An Act to Amend the "Companies' Act, 1890."

[23rd April, 1892.]

ER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1. The "Companies Act, 1890," is hereby amended by inserting the

following sub-section between sections 5 and 6 of the said Act:

1890, Chap. 6.

"5A. The Trustees of the Company may also be termed 'Directors,' Trustees and Direcand whether under the designation of Trustees or Directors shall have tors. all the powers and authorities conferred upon Trustees by this Act. It shall be lawful for the shareholders of the Company, upon a vacancy happening in the trusteeship by the resignation or death of any of the Trustees named in the memorandum of association as the persons who are to manage the concerns of the Company for the first three months or otherwise, at any time within such three months, at any meeting of the Company called for the purpose of electing Trustees, to elect any other stockholder or stockholders to fill such vacancy or vacancies, and the Trustees for the first three months, or those persons elected to fill vacancies caused by the death or resignation of such Trustees, or otherwise, shall be the Directors of the Company, and shall hold office until others are elected in their places."

2. Section 8 of the said Act is hereby amended in manner follow- Amends s. 8. ing, that is to say:

(1.) By striking out all the words in sub-section (a) from the word

"incorporations," in line three to the end of the sub-section:

(2.) By striking out the words "actually paid in," in the last line

of the said section.
