Authority of members.

Trustees, how elected.

6. The said United Baptist Church may, at any annual meeting, or at any regular meeting called for the purpose, make by-laws for the management of the secular and religious affairs of the said United Baptist Church, not inconsistent with the laws of the province.

7. No real or personal estate shall be either bought, leased, sold, conveyed, mortgaged or otherwise disposed of, nor shall any action or suit be brought by the said trustees until authorized so to do by the members of the said United Baptist Church entitled to vote on such matters, at a regular or special meeting of the said United Baptist Church, called for the purpose of giving such authority, of which meeting due notice shall be given as provided by said by-laws.

8. At each annual meeting of the said United Baptist Church two trustees shall retire from office, and sucessors shall be elected to those retiring from among the members of the said United Baptist Church. The retiring trustees shall be eligible for re-election. The number of trustees shall not be less than six, a majority of whom shall form a quorum at any meeting held for the transaction of business in relation to the said United Baptist Church.

An Act to Amend Chapter 108, Acts of 1894, entitled "An
Act incorporate the Trustees of Bay View Baptist
Church of Port Maitland and Beaver River."

(Passed the 28th day of March, A. D., 1907.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Chapter 108 of the Acts of 1894, entitled: "An Act to incorporate the Trustees of Bay View Baptist Church of Port Maitland and Beaver River," is hereby amended as follows: Insert after the words "The Bay View,' in the fourth line of Section 1 of said Act, the word "United."

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Philip Cohen, Hyman Davidson, Max Bonavitsky, Incorporation. Hyman Brody, William Bonavitsky, Harry Green, Max Nathanson, Israel Nathanson, B. Wolfe, and such other persons as are or shall become members of the Association hereby incorporated, are hereby constituted a body corporate, under the name of "The Hebrew Congregation of Sydney, Nova Scotia."

2. The objects of the society shall be :

(a) To promote the moral and spiritual welfare of its
members;

b) To provide, by entrance fees, contributions, dona-.
tions, fines, levies, rent and interest on capital, a
place of worship and accommodation therein for
its members and their families.

3. The constitution and by-laws of the said Association, Constitution. by this Act incorporated, shall, when approved by the Governor-in-Council, be the constitution and by-laws of the said corporation, and the said corporation may from time to time make, alter and repeal said by-laws to carry into effect the objects of the said corporation. But such constitution and by-laws, and every alteration and amendment thereof, shall be subject to the approval of the Governorin-Council.

4. The corporation may collect all moneys due them, or Powers. to become due them, under the coustitution and by-laws of said society, and shall have power to sue and be sued in the corporate name for all claims and demands due to or owing by said corporation.

5. The real and personal property of the society, and all debts due them, are vested in the corporation hereby created, who may purchase, take, hold and enjoy real estate by ownership, lease or otherwise, to the value of ten thousand dollars, and may sell, mortgage, lease, convey or otherwise dispose of the same for the benefit of said society, and may invest its funds in any way it may think fit, including investments by mortgage of real or personal estate, or both.

An Act relating to the old burying ground in connection with Carman Methodist Church, Sydney Mines.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Trustees of Carman Methodist Church, Sydney Mines, may, at the request of the relatives or friends of persons buried in the burying ground, adjoining the old Methodist Church, at Sydney Mines, remove the bodies of such persons to, and bury the same in the Public Burying Ground at Sydney Mines.

2. The removal and burial of the bodies of such persons shall be under the direction of the Health Officer of the town of Sydney Mines, and shall be at the expense of the trustees, who may recover the amount of such expenses from the persons at whose request such removal and burial is undertaken.

CHAPTER 178.

An Act to incorporate the Trustees of St. Andrew's Presbyterian Church, Lunenburg, Nova Scotia.

Be it enacted by the Governor, Council, and Assembly,

as follows:

1. All persons now belonging to the congregation of St. Congregation. Andrew's Presbyterian Church, Lunenburg, and all persons who may hereafter join themselves to or become members or adherents of the congregation hereinafter named, are declared to be a Presbyterian congregation in connection with the Presbyterian Church in Canada, and the said congregation shall hereafter be known and called St. Andrew's Presbyterian Church, Lunenburg.

2. Charles S. Morash, Benjamin Knock and Burgess Incorporation: McKittrick, all of Lunenburg, in the County of Lunenburg, trustees of St. Andrew's Church, Lunenburg, Nova Scotia,

and their successors in office, are hereby constituted a body corporate under the name of the Trustees of St. Andrew's Presbyterian Church, Lunenburg, and they shall have a perpetual succession and a common seal.

3. Such trustees and their successors in office shall have Powers. power to purchase, take, hold and enjoy real and personal estate, and may sell, convey, mortgage, lease or otherwise dispose of the same, and may invest any money that may come into their hands for the use and benefit of the said congregation, subject to the provisions of this Act.

4. All the real and personal property now or at the date Property vested of the passing of this Act, belonging to the Presbyterian congregation at Lunenburg, or now, or at the passing of this Act vested in any person or persons for the use and

benefit of the said Presbyterian congregation at Luuenburg, and all property, real and personal, which may hereafter be required by the said trustees of St. Andrew's Presbyterian church, Lunenburg, shall be, and the same is hereby vested, in the said trustees and their successors in office for the use and benefit of the said congregation.

5. Such trustees are hereby empowered to hold property, real, personal and mixed, for the use and benefit of said congregation to the value of one hundred thousand dollars ($100,000.00).

6. The said trustees in their corporate capacity may sue, and be sued, in all matters touching the property of the congregation, and in all and every matter in which the said congregation may or shall be directly or indirectly interested, subject to the provisions hereinafter contained.

7. A misnomer of said trustees in their corporate capacity shall not defeat or annul any grant, gift, conveyance, assurance, devise or bequest to said corporation or congregation whereby any estate or interest was intended to pass to said corporation or to said congregation for the benefit of any institution under the control of said congregation, provided the intent of the parties shall sufficiently appear upon the face thereof.

8. The trustees herein incorporated, and their successors in office, are hereby incorporated for the purpose only of holding the property of the congregation in trust for the said congregation, and shall be deemed only to hold the property of the congregation in trust for the benefit of the congregation, and shall not be deemed to have any power or authority to do or perform anything with regard to the proper and efficient or any management of the secular or internal affairs of the congregation, but the same shall be under the management of a committee to be called the managing committee, and who may, in the name of the said trustees, demand, sue for, recover and receive all moneys or money due to the congregation in any way whatsoever, subject to the provisions of this Act.

9. No real or personal property shall be either bought, leased, sold, conveyed, mortgaged or otherwise disposed of, nor shall any action or suit be brought by the said trustees until authorized so to do by a majority of the members of the said congregation entitled to vote in such matters at & regular meeting of the said congregation, called for the pur
