Garrison Chapel, and the lot of land in which said church stands, should form part of said Trinity Parish, the Governor-in-Council shall issue a proclamation bringing the preceding sections of this Act into force. Until such proclamation has been issued the preceding sections of this Act shall be of no force or effect. Such special meeting of the members of the executive committee of said Diocesan Synod shall be called by the chairman of said committee, by notice to such of said members as are in Nova Scotia or Prince Edward Island, stating the purpose for which the meeting is called. The said resolution may be passed notwithstanding any vacancy that may exist in said committee.

CHAPTER 171.

An Act to vest the Title of certain Lands in the Parish of
St. James, in Kentville, in the Rector, Wardens
and Vestry of St. James' Parish, Kentville.

SECTION.

Preamble.

(Passed the 25th day of April, A. D., 1907.)

SECTION.

1. Title, how vested.

Whereas, by deed, dated September 1st, 1857, and re- Preamble. corded in Book 22, page 236, of the Registry of Deeds for Kings County, certain lands and premises situate at Kentville, in the County of Kings, were by James E. De Wolfe conveyed to Daniel Moore, Charles W. H. Harris and John Mitchell, in trust, for the purpose, among other things, of building thereon a parsonage as the residence of the clergyman of the Church of England resident at Kentville aforesaid, and in further trust to convey said property to such person or corporate body, as should be resolved and determined at a meeting of the parishioners of St. James' church;

And whereas, said trustees are now all dead and never conveyed said property as aforesaid or otherwise;

And whereas, doubts have arisen as to the title of said property and of the power of the rector, wardens and vestry of the parish of St. James' church, Kentville, to control the use and management of said property or to sell or convey the same free from said trust;

Title, how vested.

And whereas, at a vestry meeting of said parish it was resolved that legislation be obtained to vest said property in the rector, wardens and vestry of St. James' church, Kentville, in manner aforesaid ;

Be it therefore enacted by the Governor, Council, and Assembly, as follows:

:

1. That the title to said lands and premises, and the buildings thereon, shall hereby vest in and become the absolute property of the rector, wardens and vestry of the parish of St. James' church, Kentville, and free from all trusts, and with the approval of the Bishop to sell and convey said property and to apply the proceeds from such sale for the purposes of the said parish in such manner as the rector, wardens and vestry, with the consent of the Bishop, shall approve and direct, and as near as possible under the circumstances, to give effect to the intention of the said James E. DeWolfe, as expressed in or can be ascertained by the trust last mentioned and set out in the said deed from said James E. De Wolfe to said Daniel Moore, Charles W. H. Harris and John Mitchell.

CHAPTER 172.

An Act to incorporate the Trustees of the Wolfville.
Tabernacle Society.

Be it enacted by the Governor, Council, and Assembly, as follows:

Incorporation. 1. Joseph C. Bishop, Charles A. Patriquin and Everett Sawyer, appointed by the society known as the "Wolfville Tabernacle Society," and hereby declared to be duly appointed, and their successors in office to be hereafter appointed, are hereby created a body corporate, by the name of "The Trustees of the Wolfville Tabernacle Society."

Objects.

2. The objects of the society shall be :

(a) To promote the moral and spiritual welfare of its
members;

(b) To provide, by entrance fees, contributions, dona-
tions, rent, and interest on capital, a place of
worship and accommodation therein, for its mem-
bers and their families.

3. At the first business meeting of the society in each Trustees. year, or as soon after as convenient, successors to the above named persons shall be appointed, one in each year, to fill the places of those herein named, who shall retire each year in the order of their names until all retire, and thereafter the senior member of the corporation shall retire each year, and a successor shall be appointed in his place. The treasurer of the society for the time being shall be appointed a member of the corporation, if convenient, and any member may be re-appointed.

4. The trustees may acquire and hold real estate for the May hold benefit of said society, not to exceed in value ten thousand dollars, and may borrow money, and may also at any time sell, mortgage, transfer and convey any real or personal property in the name of the corporation,

5. The property on the north side of Main Street, in the Property town of Wolfville, in Kings County, at present held by Joseph C. Bishop, Charles A. Patriquin and Everett W. Sawyer, in trust for said society, is hereby vested in the trustees mentioned in the first section of this Act.

6. The trustees shall assume and have control of the Control of property of the society, both real and personal, but said property. trustees shall have no right to divert the property of said society from uses appointed by the society, or to incur debts beyond what is necessary for the proper care, repairs and preservation of the property of the said society, or to borrow money, or sell, mortgage, transfer or convey property as empowered by Section 3 of this Act, unless authority is especially given by the said society; and such authority for each and all of the purposes aforesaid, shall be valid only when approved by a majority present at a meeting called by a special notice given to the members of the society at least one week before such meeting is held, in which notice the object of the meeting shall be stated.

By-laws.

7. The society may at any regular meeting called for the purpose, make by-laws for the further management of the business affairs of the society, which by-laws shall have the force of law, providing they are not inconsistent with this Act and the laws of the province.

CHAPTER 173.

An Act to amend Chapter 82, Acts of 1871, entitled, "An
Act to incorporate the Trustees of Prince Street

SECTION.

Baptist Church, Truro.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section three of chapter eighty-two of the Acts of 1871, entitled, “An Act to incorporate the Trustees of the Prince Street Baptist Church, of Truro," is hereby amended by striking out the words "being pew holders" in the fifth and eighth lines thereof.

2. Section 5 of the said Act is hereby repealed.

3. Section 6 of the said Act is hereby amended by striking out the words "nor any such ornamenting, painting, insurance or repairs undertaken or affected under the last preceding section" in the third and the fourth lines thereof, and by striking out the words "and congregation being pew-holders in such edifice" in the fifth and sixth lines. thereof.

4. Section 7 of said chapter is hereby repealed.

CHAPTER 174.

An Act to incorporate the Trustees of the United Baptist
Church, of Canning.

Be it enacted by the Governer, Council, and Assembly, as follows:

1. John A. Newcomb, Ira L. Cox, Joseph B. Tooker, Incorporation. Eslie B. Cox, Edward M. Beckwith and William R. Potter, all of Canning, in the County of Kings, and their successors in office, are created a body corporate by the name of the "Trustees of the United Baptist Church of Canning."

2. Such trustees, and their successors in office, shall have Power. power to purchase, take, hold and enjoy real and personal estate, and may sell, convey, mortgage, lease or otherwise dispose of the same, and may invest any money that may come into their hands for the use and benefit of the said United Baptist Church, subject to the provisions of this Act.

3. All the real and personal property now or at the Property date of the passing of this Act, belonging to or being the property of, or used by, and in possession of, the congregation of the Baptist Church at Canning, and the congregation of the Free Baptist Church at Canning, in the County of Kings, shall be, and is hereby vested in the said trustees and their successors in office, for the use and benefit of the said United Baptist Church.

4. Such trustees are empowered to hold property, real May hold and personal, for the use and benefit of the said United property. Baptist Church, to the value of twenty thousand dollars.

5. The said trustees may sue and be sued in all matters May sue and be touching the property of the said United Baptist Church, sued, and in all and every matter in which the said United Baptist Church may or shall be directly or indirectly interested.
