CHAPTER 119.

An Act to enable the Trustees of Whycocomagh School
Section, Number 58, in the Northern District of

Be it enacted by the Governor, Council, and Assembly, as follows::

1. The trustees of School Section, Number 58, Whycocomagh, in the northern district of the county of Inverness, may borrow on the credit of such school section, its property, and the security of this Act, a sum not exceeding one thousand dollars, for the erection of a new school house and the purchase of enough land adjoining the present school

grounds to make a suitable lot to build on in said section, and shall repay the same in ten annual equal instalments of one hundred dollars each, with interest, at a rate not exceeding seven per centum per annum, such interest to be paid yearly.

5. The trustees for the time being of said school section How assessed. shall, and they are hereby authorized so to do, assess upon said section, in addition to the amount assessed upon said school section for school purposes each year, a sum sufficient to pay the interest on the principal, or such part thereof as may from year to year be still due and payable, and one of such debeutures annually, and such money shall be annually applied by said trustees for the payment of such debentures and interest, and for no other purpose.

CHAPTER 120.

An Act to amend Chapter 137, Acts of 1903, entitled, “An
Act relating to Sewerage in the Town of Kentville."

Section 33 amended.

Assessment, how made.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 33 of chapter 137, of the Acts of 1903, is hereby amended by adding thereto the following: "Provided that the Town Council may, at any time, assess upon the real and personal property, within any section of any sewerage district in which a system of sewerage has been constructed, in whole, or in part, and upon the income of persons resident within such section, any sum which the Town Council shall find necessary to pay any interest upon moneys borrowed by the Council under the said Act.

2. Such sssessment shall be made upon the property in such sewerage section specified in section 34 of the said Act, and upon the income of persons resident within such sewerage section, in manner as other town assessments are made, and all rates made by such assessment and rating, shall, when so assessed and rated, be and become immediately payable, and may be levied or collected, by warrant or otherwise, in like manner as other town rates may be collected.

CHAPTER 121.

An Act to enable the Town of Kentville to acquire, install and operate an Electric Light and Power System.

Whereas, the Town Council of the town of Kentville has Preamble. passed a resolution, asking that legislation be procured to enable the town of Kentville to acquire, install and operate an electric light and power system in the town;

Be it therefore enacted by the Governor, Council, and Assembly, as follows:

1. This Act may be cited as The Kentville Electric short title. Light and Power Act, 1907."

2. In this Act, unless the context otherwise requires :

(b) "Company," means "The Kentville Electric Light
and Power Company, Limited,"

'Council," means the Town Council of the town
of Kentville.

This Act shall not go into operation or effect until when Act shall authority to borrow the amount specified in the twelfth go into effect. section of this Act, is given by vote of the ratepayers of the town, called and held under the one hundred and fortythird and one hundred and forty-fourth sections of "The Towns' Incorporation Act," which vote shall be taken within six months after the passing of this Act.

4. Subject to the provisions of this Act, the Council is hereby authorized and empowered to acquire and provide for the town a suitable and sufficient electric light and power plant and system, and to operate the same for the purposes of lighting the streets, thoroughfares, and public buildings and places of the town, and of supplying and furnishing electric light and power to the inhabitants of the town, and outside the limits of the town, to the Government of the Dominion of Canada, or to the Government of the Province of Nova Scotia, or to persons within a radius of five miles of the said town, and for such purpose to generate or purchase electricity, and supply electric light and power, and sell the same, as may be required, as deemed by the Council expedient, and to keep, sell and supply, to any person, firm or corporation, obtaining electric light or power from the town, all suitable or requisite electric fittings or supplies for the installing or use of electric light or power, in houses, buildings or premises.

5. It shall be lawful for the Council for the purposes aforesaid, and for the purpose of purchasing, equipping and installing such plant and system in the town, and of operating the same, and for the purchase of electric or other power therefor, to enter into any contract that may, by the Council, be deemed expedient or necessary, and to erect or purchase buildings, construct works, acquire lands, and do all other things necessary or expedient in the premises, and for that purpose to do or provide, or cause to be done or provided, any and all works and materials deemed necessary or expedient for the proper carrying out of the purposes of this Act, either by tender or contract, or by days work, or otherwise.

6. (1) The Council shall have power to sell and supply electricity, or electric light, or electric power or energy, for any purpose, to any person, firm, company or corporation within the town and outside the limits of the town, to the Government of the Dominion of Canada, or to the Government of the Province of Nova Scotia, or to persons within a radius of five miles of the said town, and to determine the amount supplied by meter, if deemed expedient, and to collect all moneys due on accout of any such electricity, electric light or electric power or energy so sold or supplied, in the same manner, and by the same process, as taxes due the town for water supplied by the town by its water system are collected.
