CHAPTER 83. An Act to enable the City of Sydney to borrow money for Be it enacted by the Governor, Council, and Assembly, as follows: borrow. 1. The city of Sydney is hereby authorized and em- Power to powered to borrow, on the credit of the said city of Sydney, and of the assessable property therein, a sum of money not exceeding five thousand dollars, for the purpose of extending the water system of the said city of Sydney. 2. Such sums shall be borrowed on debentures to be Debentures. issued in sums of one hundred dollars, or twenty pounds sterling money, each, or any multiple thereof, at one time, or from time to time, as determined by the resolution of the City Council, bearing interest at such rate, not exceeding five per centum per annum, and repayable at such time, not exceeding thirty years, as the said Council shall determine; which debentures shall be issued by the Mayor, under the seal of the said city, and signed by the Mayor and City Clerk of the said city, and to each of such debentures shall be attached coupons for the payment of interest aforesaid, which shall be signed by the Mayor and City Clerk of the said city, or their names may be impressed on the said coupons by machinery provided for that purpose, and with the authority and approval of the said City Council. 3. The said debentures shall be made payable either in How payable. Canadian currency or in sterling money of Great Britain, and the same shall be made payable, and the interest coupons thereon shall be made payable, either in the Dominion of Canada or in the United Kingdom of Great Britain and Ireland, as the said City Council shall deem meet or most expedient. 4. In order to provide a sinking fund for the payment Sinking fund. of the debentures authorized to be issued under this Act, the City Council shall annually include in the estimates of the sums required for the purposes of the said city, such How provided. Debentur es' sum as may by resolution be determined by the City Council, not, however, in any case, to be less than one per cent. of the amount to be borrowed under the provisions of this Act, and such sum shall be rated and collected in the same manner and with the same remedies as other rates and taxes in said city are collected. 5. Such sums, when collected, shall be deposited in some chartered bank in the Province of Nova Scotia, to the credit of an account to be called "Sydney Water Loan Sinking Fund, 1907," bearing interest, and the city of Sydney shall be bound to make good and provide in each year, out of the general revenue of the said city of Sydney for such year, the difference, if any, that will arise in such year between the interest that shall accrue on the invested sinking fund, and the interest which shall accrue on such fund calculated at the rate of four per cent. per annum, and place the same to the credit of the said sinking fund account. Such sum shall be used for payment of debentures issued under the provisions of this Act, and for no other purpose. 6. The provisions of "The Municipal Debentures Act" shall apply to the loan authorized by this Act in so far as the same are not inconsistent here with. ᏟᎻᎪᏢᎢᎬᎡ ᏋᏎ, An Act to enable the City of Sydney to make a Grant in aid of Educational Work in the City of Sydney. Whereas, the Council of the city of Sydney, on the 4th day of October, 1906, adopted the following report of a special committee appointed to consider an application of King's and Dalhousie Colleges :— "Your committee appointed to consider the application of the Colleges of King's and Dalhousie for financial assistance, and to aid them in carrying on the educational work already begun in Sydney, after having an interview with the committee representing the colleges, and obtaining full information respecting the work proposed to be done, beg to recommend that the Council make a grant of $400.00 in aid of said work, for the college term of 1906-7, after Legislative authority in that behalf has been secured, and, further, that legislation be obtained at the next sittings of the Assembly, authorizing the city of Sydney to make an annual grant of $400.00 to aid the combined colleges of King's and Dalhousie in carrying on the edcational work at Sydney." Be it enacted by the Governor, Council, and Assembly, as follows: 1. The city of Sydney is hereby empowered to make a Power to make grant of and pay the committee representing King's and rant. Dalhousie Colleges, in the educational work being carried on in the said city of Sydney, the sum of four hundred dollars ($400.00) for the term of 1906-7, and to make a grant of a sum not exceeding four hundred dollars ($400.00), and to pay such sum to the said committee annually thereafter. 2. The City Council of said city of Sydney shall annually How levied. add to the amount to be rated and levied upon the assessable property of the said city, the sum so granted, and such sum shall be rated annually upon the property of the ratepayers of the said city, liable to assessment, and shall be levied and collected in the same manner, and with the same remedies, as ordinary rates and taxes are rated and collected. 3. The committee referred to in section one shall consist Committee. of the Mayor of the city of Sydney, C. S. Cameron, Reverend C. D. Schofield, G. A. R. Rowlings, J. E. A. McLeod, W. F. Jennison, H. P. Duchemin, F. A. Bowman, R. Gillis, W.G. Yorston and C. D. Livingstone, and their successors duly appointed. 4. Such grant shall not be included in the estimates of the city of Sydney, for any year, unless the same has been previously approved of by the Board of School Commissioners for the said city of Sydney. Power to exempt from taxation CHAPTER 85. An Act to enable the City of Sydney to Exempt from (Passed the 25th Day of April, A. D., 1907.) Be it enacted by the Governor, Council, and Assembly, as follows: 1. The city of Sydney is hereby authorized and empowered, by resolution of the City Council, to exempt from taxation, for a period not exceeding fifteen years, the plant, buildings and stock-in-trade of the Saunderson Manufacturing Company, Limited. Such exemption shall not extend to the lands of the company, nor to property not actually in use, for the purposes of the business of the company, and shall only continue while the Company is in active operation in the city of Sydney, but shall not extend to rates for the support of schools, water or sewer rates, or special charges under any local improvement by-law. 1 CHAPTER 86. An Act to enable the City of Sydney to Remove Temporary District of said City. (Passed the 25th day of April, A. D., 1907.) Preamble. SECTION. Preamble. SECTION. 1. Power to remove. Whereas, certain temporary one-story wooden buildings were erected, under permission given by an ordinance passed by the Town Council of the said town of Sydney, on October 22nd 1901, within the fire limits of the town of Sydney, after the fire, which occurred in the said town of Sydney on the 19th day of October, 1901; And whereas, certain of said buildings have not been removed, and doubt has arisen as to the power of the City Council of the city of Sydney to order the removal of said f buildings, and to remove said buildings, in the event of the owners thereof refusing to remove them. Now, therefore, be it enacted by the Governor, Council, and Assembly, as follows: remove. 1. The City Council of the City of Sydney is hereby Power to authorized and empowered to order, by resolution of the Council, the removal of any such buildings. 2. If the owner of any such building does not, within ninety days after the service upon him of notice of such resolution, by leaving such notice with him personally, or mailing it to his last known place of address, remove such building owned by him, the City Council may authorize any official or officials to pull down or remove such buildings, and may charge the expenses incurred therein to the owner, which expenses may be recovered in the name of the city, as in an action for debt. 3. This Act shall not come into operation until the first day of July, A. D. 1908. CHAPTER 87. An Act to enable the City of Sydney to grant a bonus and exemption from taxation to the National Whereas, the City Council of the city of Sydney, on Preamble. November 5th, 1906, decided to grant a bonus, and exemption from taxation to, and make an agreement respecting water with, a company represented by Messrs. Crowell, Derrick and Wetmore, upon conditions hereinafter set forth, and arranged that a vote of the electors of the city of Sydney should be taken thereon; And whereas, on the 20th of November, 1906, by a majority of 909 votes over 81 votes, the electors of the city of |
