Resolved, that a select committee be appointed on the part of the House with such as the Senate may join, for the purpose of fixing on a day on which the business of the present session may be brought to a close.

Ordered, that Messrs. Perkins of Allenstown, Lathrop and Stevens of Lyman be the committee.

Mr. Knapp submitted the following resolution:

"Resolved by the Senate and House of Representatives in General Court convened, that the towns of Woodstock and Lincoln in the county of Grafton be classed for the purpose of electing a representative to the General Court; and also that the towns of Ellsworth and Waterville in said county of Grafton, be classed for the purpose of electing a representative to the General Court, until the Legislature shall otherwise order, any law or usage to the contrary notwithstanding.

Which was read a first and second time.

On motion of Mr. Knapp

Ordered, that it be referred to the committee on Elections. Mr. Betton summitted the following resolution:

Resolved, that the committee on Elections be instructed to inquire into the expediency of farther providing by law for the correct returns of votes of town clerks to the office of the Secretary of State, and to report by bill or otherwise.

Resolved, that the committee on the Judiciary be instructed to inquire into the expediency of repealing an act entitled "An act providing for the division of towns into school districts, and for

the alteration of the limits of school districts in certain cases," passed July 6, 1839.

The House proceeded to the order of the day upon the bill entitled "An act to sever a lot of land, number one hundred and fifty, owned and occupied by Elhanan Winchester, from the town of Stark in the county of Coos, and annex the same to the town of Lancaster.

Resolved, that it pass and that its title be as aforesaid.

Ordered, that the Clerk request the concurrence of the Senate therein.

The House proceeded to the order of the day upon the bill entitled "An act to change the name of the town of Coventry to Benton."

Resolved, that the committee on Towns and Parishes be instructed to inquire into the expediency of passing a law requiring towns to erect stone monuments at every angle of their respective towns, and report by bill or otherwise.

Mr. St. Clair, from the committee on Elections, to whom was referred a resolution instructing said committee to report a bill in amendment of an act entitled an act relating to the election of Governor, Counsellors, Senators and Representatives, passed July 3d, 1839, so as to exclude from the rateable polls forming the basis of representation, all paupers absolutely and also all aliens, who have not resided in such town or place the period required by law to entitle citizens to vote in such town or place, by leave reported a bill entitled "An act in amendment of an act entitled an act relating to the election of Governor, Counsellors, Senators and Representatives, passed July 3d, 1839."

Which was read a first time.

The House reconsidered the vote accepting the report of the committee on the Judiciary upon the resolution instructing them to inquire into the expediency of passing a law to regulate the sale of ship timber.

Resolved, that the House are now ready to meet the Senate in

Convention, for the purpose of proceeding in the elections agreeably to the laws of this State.

IN CONVENTION.

The Senate and House of Representatives being met in Convention in the Representatives' Hall—

On motion of Mr. Quincy of the House

The chairman of the select committee to compare and cast the numbers of the returns of votes for Electors of President and Vice President of the United States and report thereon, laid before the Convention the returns of said votes from the town clerks of the towns of Windham, Salem, Sullivan, Milford, Effingham, Temple, Lempster, Centre Harbour, Alexandria, Croydon, Bethlehem, Bristol and Northumberland, who have been summoned to appear before the Convention this day.

The chairman informed the Convention that the precepts commanding the appearance of said town clerks before the Convention this day, had all been duly served and returned.

The chairman also informed the Convention that the Secretary of State had laid before the Convention the returns of votes which had been received from the towns of Dalton and Society Land. On motion of Mr. Goodhue of the Senate

Resolved, that the Convention proceed to propound such interrogatories to the delinquent town clerks, as may be deemed proper, and that said clerks may answer upon oath to interrogatories that may be put to them by the Convention or by their order.

The Convention accordingly proceeded to the examination of said clerks.

Isaac McGaw, town clerk of the town of Windham having been duly sworn, in reply to the question, whether he had made any mistake in making up the records of the votes cast in said town of Windham for Electors of President and Vice President of the United States on the first Monday of November instant, or whether he had made any mistake in his return of said votes, and if so what that inistake was

Answered, that he had made a mistake both in his said record and return by omitting to enter therein sixty-two votes which were cast for Andrew Pierce, Jr.

On motion of Mr. Gregg of the Senate

Resolved, that said town clerk be permitted to amend said record and return according to the facts.

Said town clerk then amended his record and return according ly, by entering therein sixty-two votes as cast for Andrew Pierce, Jr.

Frederick W. Bailey, town clerk of the town of Salem having been duly sworn, in reply to the question, whether he had made any mistake in making up the record of the votes cast in said town of Salem for Electors of President and Vice President of the United States, on the first Monday of November instant, or whether he had made any mistake in his return of said votes and if so, what that mistake was

Answered, that he had made no mistake in his said record, but that he had made a mistake in his return, by omitting the word "Jr." after the words "Andrew Pierce."

On motion of Mr. Sawyer of Nashua of the House

Resolved, that he be permitted to amend his said return according to the record.

Said town clerk then amended his return accordingly by inserting the word "Jr." after the words "Andrew Pierce."

Selem Frost, town clerk of the town of Sullivan having been duly sworn, in reply to the question, whether he had made any mistake in making up the record of the votes cast in said town of Sullivan for Electors of President and Vice President of the United States on the first Monday of November instant, or whether he had made any mistake in his return of said. votes, and if so what that mistake was
