The counsel for the remonstrant then laid before the committee the following depositions :

Deposition of Levi Harthorn.

I, Levi Harthorn depose and say, that I have been an inhabitant of Hillsborough more than three years last past. I came to reside in Hillsborough on the first Monday in April 1837, and have resided there ever since. I have voted in the town of Hillsborough in the years 1838, 1839 and 1840.

Day Emerson's deposition.

I, Day Emerson of Bradford, depose and say, that in March last at the time of the annual meeting I was an inhabitant of the

town of Bradford, N. space of six months.

Deposition of Abraham Gove.

I, Abraham Gove depose and say, that my son, Mark Gove, purchased a farm in Newport, N. H. in September, 1838. He removed from Henniker to Newport with his family, Nov. 8, 1839. And has resided in Newport ever since. His name was upon the check list in Henniker and voted in said town in 1839. ABRAHAM GOVE.

Deposition of Silas Dutton.

I, Silas Dutton, of lawful age, depose and say, that at the time of the annual meeting in March last I was an inhabitant of the town of Nashua, N. H. and exercised my right of suffrage there. I further say that on the day of the last annual meeting I communicated the foregoing facts to one of the Selectmen of Henniker. SILAS DUTTON.

December 14, 1840.

It is admitted that Mr. Dutton drives a stage, of which he is in part owner, from Nashua to Henniker-he stays in Nashua one night and in Henniker the next, and is unmarried.

Ezekiel Connor's deposition.

I, Ezekiel Connor of Henniker, N. H. depose and say, that my son Horatio Connor went to Lowell to reside in March, 1837, and has resided there ever since.

And my son Harrison Connor has resided in Wellfleet and Lowell, Mass. three years last November. They were not in Henni ker at or about the time of the annual meeting in March last. Question by Selectmen.

How often have your sons been at home since they left Henniker, and how long have they remained at home?

Answer. They have been at home twice, don't remember how long the first time; the last time about two weeks.

What is the employment of your sons ?

Answer. They are at work in the factories at Lowell.

The oldest son, Harrison, was engaged in teaching school at Wellfleet, Ms. the two first winters after leaving Henniker. After closing his school the first winter he returned to my house and

staid about a week-then went to Lowell, and continued there until he went to Wellfleet to commence his school the next winter; after closing his school he returned to Lowell where he continued until last September; when he made us a visit of about two weeks, and then returned to Lowell where he still continues to reside. He was twenty-one years of age before he left home to go to Lowell or Wellfleet the first time. Horatio has been at Lowell all the time since he first left, with the exception of making us two visits, the first time about one week, and the last time about two weeks. I don't know that they have any property in

town.

Do you know they have no property in Henniker.
Answer.-No, I don't know for a certainty.

I don't know of their being there all the time except from information derived from them.

EZEKIEL CONNOR.

It is admittted that they are unmarried men.

Deposition of James Hoyt.

I, James Hoyt of Henniker, depose and say, that my son, Benjamin Hoyt, was twenty-one years of age in February, 1834. He left my house the last of March or first of April following for Bangor, Me. and remained there until the last of August following. Then made my house his home until the first of April following-he then went to Dunbarton to work, continued there eight months, then was backwards and forwards to my house a month or two-after that went to Dunbarton and remained there the most part of two years, during which period he was often at my house to see the folks; made Dunbarton his home-after leaving Dunbarton he was at my house a week or a fortnight fixing to go off-then went to Taunton, Mass. and has resided there ever since with the exception of once-his hand being lame he came home to see us and staid not quite three weeks; this was in January, 1839. He is not married to my knowledge.

Does your son make your house his home when in Henniker?
Ans. Yes sir.

He is at Taunton in the employment of a Railroad company.
