To the Honorable the House of Representatives of the State of New Hampshire: The undersigned, one of the Selectmen of the town of Henni ker, begs leave to submit the following statement of facts for the consideration of your honorable body. That a majority of the Selectmen of the town of Henniker, in making up the list of rateable polis in said town at the time of the last annual meeting, from which is determined the number of Representatives to which said town is entitled, inserted upon said list the names of several individuals, who were not at that time residents in said town of Henniker. That said list contains the names of four hundred and forty-two individuals, that of these, as the undersigned verily be lieves, at least twenty were not, at the time of the last annual meeting, residents in said town of Henniker. That upon said list are the names of the following individuals: Daniel B. Alley-who has resided in Lynn, Ms., more than one year last past. Alexander W. Connor-who had not resided in Henniker for several months previous to the annual meeting, and had no intention to return to Henniker to reside. Silas Dutton-who resided and voted in Nashua, as was well known to the Selectmen. H. Day Emerson-resided and voted in Bradford, N. H. Edward M. Eastman-resided and voted in New Ipswich, N. Mark Gove-resided in Newport, N. H. Joshua D. Hemphill-had not resided in this State for severa years. Benjamin Hoyt-has not resided in this State for several years. Levi Hathorn-bas resided in Hillsborough several years has past. Robert Kimball-has resided in Boston several years. Thomas Whitman-was a minor on the day of the annual meeting. Thomas J. Whitcomb-has resided in Boston several years last past. Horatio Connor, Harrison Connor-have resided in Lowell, Ms. several years. Oliver Pillsbury, Jr.-has resided in New Jersey nearly two years. The undersigned represents that the foregoing names with several others, which he believes should not be put upon said list were inserted thereon, without his consent, and contrary to his wishes and advice, by a majority of the Selectmen of said town of Henniker. That said town of Henniker now have two Representatives upon your floor, although he believes they are entitled to but one. The undersigned having remonstrated against this course of procedure, without effect, has deemed it his duty to communicate the foregoing facts. All which is respectfully submitted. On motion of Mr. Bennett ROBERT WALLACE. Resolved, that the parties to be heard in the memorial of Robert Wallace, and of the Selectmen of Henniker, be required to take their evidence with notice to the counsel of the parties, and that they be ready for a hearing before the committee on Elections, on Monday next at 6 o'clock, P. M. and that all evidence used upon such hearing shall be taken with notice, or shall be given orally before the committee. Adjourned. MONDAY, DEC. 14, 1840. PRESENT: All the members of the committee. The chairman laid before the committee the following resolution of the House of Representatives of December 14, 1840. Resolved, that the committee on Elections be and are hereby authorized to send for persons and papers, if such shall be found necessary to a full and fair investigation of all the facts or intima tions of facts set forth in the memorial or statements of facts relative to the election in the town of Henniker, which has been to said committee referred, and that said committee be instructed to do so, if an immediate, complete and satisfactory investigation of said matter cannot otherwise be had. The remonstrant, Robert Wallace, appeared before the committee and submitted in evidence a copy of the list of rateable polls in the town of Henniker, A. D. 1840, admitted by the parties to contain 448-which is as follows: "A list of the rateable polls in the town of Henniker, at the time of the annual election, A. D. 1840. Said list contains every male inhabitant of the age of twenty-one years and upwards to the best of our knowledge.
