qually interested in the passage of this act. It is of little conse quence whether the condition of the citizen be humble or exalted, when a question like this is at issue. If private property may be seized, private right invaded, the solemn guaranties of the constitution disregarded in one instance, they may be in another. The laws to which the citizen has looked for protection, which he has been accustomed to revere, will be regarded as a means of oppression and tyranny; and when once the respect due to the law has ceased, violence will ensue.

For the reasons here given the undersigned claim their constitutional right to enter this protest,upon the Journals of the House.

Mr. Green laid upon the Clerk's table the following resolution:

Resolved, that the thanks of this House be presented to the Hon. Moses Norris, Jr. for the able and highly acceptable manner in which he has discharged the duties of the Chair during the last and present sessions.

Which was read by the Clerk and unanimously adopted by the House.

To which the Speaker replied as follows:

"GENTLEMEN

Being about to take my final leave of you, not only as a member of this House, but as its presiding officer, I embrace this opportunity of saying that your partiality and confidence manifested in placing me in this Chair-the uniform and steady support which at all times you have rendered me in the discharge of its high and important duties, together with this expression of your approbation of the manner in which those duties have been performed, excite feelings of gratitude and regard which time cannot eradicate.

Permit me, gentlemen, on this occasion, to bear testimony to the promptitude, fidelity and industry with which the members of this House have discharged the duties pertaining to the high trust committed to them by their constituents. And though questions of an exciting character, and of deep interest to the public, have been moved and discussed, yet this diversity of opinion has been entertained and expressed in a manner becoming high minded and `honorable men, whose object is truth.

Gentlemen, it has been my constant and earnest desire to discharge the duties of the high trust which has been assigned me, faithfully, and in an acceptable manner. If I have succeeded, my fondest hopes are fully realized.

I can offer you nothing in return for the many manifestations of your kindness and regard towards me, except the humble tribute of my heartfelt thanks, and my ardent wishes for your future success and happiness.

Gentlemen, it is with the kindest feelings towards you, both individually and collectively, that I now bid you, Adieu."

THURSDAY, DEC. 24, 1840.

"A message from the Senate by their Clerk:

Mr. Speaker-The Senate concur with the House in the passage of the following resolutions, to wit:

"A resolution in favor of J. B. Wiggin; and

Sundry resolutions founded upon a preamble and resolutions transmitted to the Executive of this State by the Executive of the State of New Jersey.

The Senate have postponed to the next session of the Legisla ture, the resolutions relating to the controversy between the States of Maine and Georgia.

The Senate have postponed indefinitely the resolutions instructing our Senators and requesting our Representatives in Congress to use their efforts to cause provision to be made by law for the adjustment of the claims of our citizens for spoliations by France prior to the year 1800."

Mr. Ela of Meredith, from the committee on Engrossed Bills, reported that they have carefully examined and find correctly engrossed bills and resolutions of the following titles, to wit:

"An act to incorporate the Farmers' Mutual Fire Insurance Company."

"An act to incorporate the Durham Academy.'

"An act providing for exemption in certain cases from military duty.

"An act to incorporate the Amoskeag Fire Insurance Company."

"An act relating to the White River Falls Company and to establish the rates of toll of the same.

"An act in addition to an act entitled an act to prevent incestuous marriages and to regulate divorces, and for the relief of married women and widows."

"A resolution in favor of Aaron Carter and others."

"A resolution in favor of George Pendexter and others." "A resolution instructing Senators and requesting Representa tives in Congress to use their efforts to procure the passage of a law providing for the choice of Electors of President and Vice President of the United States on the same day in all the States." "A resolution in favor of J. B. Wiggin."

Sundry resolutions founded upon a preamble and resolution transmitted to the Executive of this State by the Executive of the State of New Jersey.

Mr. Treadwell moved that the resolutions relating to the con

troversy between the states of Maine and Georgia be signed by. the Speaker, and that he be required to transmit to the Executive of the several States, to be laid before their respective Legislatures, and to our Senators and Representatives in Congress, to be laid before that body, copies of said resolutions, and of the accompanying report.

And the question being put,

Mr. Hoskins called for the ayes and noes.
Mr. Treadwell moved a call of the House.
And a call of the House being ordered-

Mr. Treadwell moved that the Speaker be required to appoint a sergeant-at-arms to compel the attendance of the absent members.
