Mr. Robinson presented the petition of a majority of the legal voters of the town of Poplin, praying to be exempted from the operation of the first section of an act providing for the division of towns into school districts, and for the alteration of the limits of school districts in certain cases, passed July 6, 1839.

Mr. Sanborn of East Kingston presented the petition of Ruth Webster praying for the passage of a law, which will prevent further use of her land by the Boston and Maine Railroad Corporation until she is remunerated therefor.

Mr. Chamberlain presented the petition of Calvin Learned and others praying for the passage of a law authorizing school districts to hold more land, than they are now by law entitled to.

Ordered, that said petitions be referred to the committee on the Judiciary.

Mr. Perrin presented the petition of Nathan Kingman and others praying for an additional officer in the company of Riflemen in the 13th Regiment of N. II. Militia.

Mr. Towle of Freedom presented the petition of Joseph Smith and others praying for an act incorporating the 2d company of Light Infantry in the 27th regiment N. H. Militia.

Mr. Crawford presented the petition of the officers of the 12th company of Riflemen in the 18th regiment of N. H. Militia praying for an act of incorporation.

Ordered, that said petitions be referred to the committee on Military Affairs.

Mr. Swasey presented the account of A. B. Currier.

Ordered, that it be referred to the committee on Claims. Mr. Dame, from the committee on Unfinished Business, n ade a report,

Whereupon

Resolved, that the petition of the selectmen of Lee praying that said town be disannexed from Strafford and annexed to Rockingham county; the petition of Elhanan Winchester and others praying that lot No. 150 in the town of Stark be dişannexed from said town of Stark and annexed to the town of Lancaster; the petition of Alanson Noble and others praying that the easterly half of lots No. 3 and 4 in the 11th range of lots in Dalton, be disannexed from said town of Dalton and annexed to the town of Whitefield; the petition of Nathaniel and Franklin Davis to be severed from the town of Gilford and annexed to the town of Meredith, be referred to the committee on Towns and Parishes.

Mr. Shannon, from the select committee consisting of the del egation from the county of Strafford, to nominate eight persons as members of the select committee to establish a new apportionment of the public taxes, reported the following resolution.

Resolved, that Messrs. Ela of Meredith, Hall, Copp, Dame Sawyer of Dover, McDaniel, Hill of Alton, and Durgin, be of said committee on the part of the county of Strafford.

On motion of Mr. Morrill of Somersworth

Ordered, that said report be recommitted to the select committee consisting of the delegation from the county of Strafford.

A message in writing from His Excellency the Governor was received by the Secretary of State, which was read and is as follows:

Ordered, that the message of his excellency the Governor with the accompanying documents, be referred to the committee on Public Lands.

Mr. Parker of Lisbon from the select committee to take into consideration the message of his excellency the Governor and report the disposition to be made of the several subjects embraced therein, made a report,

Whereupon

Resolved, that so much of his excellency's message as relates to the Independent Treasury be referred to the standing committee on Finance.

That so much thereof as relates to the new apportionment of the public taxes be referred to the select committee on that subject.

That so much thereof as relates to Banks and Bank Commissioners be referred to the committee on Banks.

That so much thereof as relates to the State Prison be referred to the committee on the State Prison.

That so much thereof as relates to the judicial system be refer red to the several county delegations.

That so much thereof as relates to the Insane Hospital be refer red to the select committee upon that subject.

That so much thereof as relates to a Geological Survey of the State be referred to the select committee upon that subject. On motion of Mr. Tudor

Resolved, that the committee on Military Affairs be instructed to inquire into the expediency of making an appropriation for repairs of the gun house belonging to the artillery company of the 20th regiment.

On motion of Mr. Burleigh of Brookfield

Resolved, that the committee on Military Affairs be instructed to inquire into the expediency of so amending the act of July 7, 1837, that the soldiers shall be paid out of the State Treasury instead of the treasuries of the several towns.

The Speaker announced the appointment of Mr. Patten as a member of the committee on Banks, in place of Mr. Whittemore of Antrim, resigned.

Also the appointment of Mr. Burnham as a member of the com mittee of the State Prison, instead of Mr. Webster, resigned. On motion of Mr. Warner

The House reconsidered the vote appointing Messrs. Warner, Chamberlain, and Leavitt of Gilmanton, a committee on the part of the House, to give information to his excellency the Governor, that John W. Weeks, Stephen P'erley, Samuel Hatch, Andrew Peirce, Jr., John Scott, Francis Holbrook, and Samuel Burns are duly chosen by the people of this state, Electors of President and Vice President of the United States.

On motion of Mr. Swasey

Resolved, that the House are now ready to meet the Senate in Convention, for the purpose of proceeding in the elections agreeably to the laws of this State.

The Senate and House of Representatives being met in Convention in the Representatives' Hall

On motion of Mr. Quincy of the House

The Convention reconsidered the vote accepting the report of the joint select committee to examine, and count the votes for Electors of President and Vice President of the United States, and report thereon.

On motion of Mr. Ela of Meredith of the House

Ordered that the report lie on the table.

On motion of Mr. Baker of Hillsborough of the House

The Convention resumed the consideration of the resolutions introduced by Mr. Sawyer of Nashua providing for the amending of the returns of the votes for Electors of President and Vice President of the United States.

Mr. Baker of Hillsborough moved that the resolution be amended by striking out all after the word "Resolved," and inserting instead thereof the following

"That the report of the select committee appointed to examine and count the votes for Electors of President and Vice President and to report thereon be recommitted, that process be issued requiring the town clerks of the towns of Salem, Windham, Centre Harbour, Effingham, Milford, Temple, Sullivan, Croydon, Lempster, Alexandria, Bethlehem, Bristol and Northumberland to appear before said committee on Friday the 27th day of November, A. D. 1840, at eight o'clock in the forenoon, to amend their respective certificates or returns according to law, and the town record of such votes, and that said committee report thereon to the Convention."

Mr. Spaulding of Nashua of the House moved that the amendment be amended by inserting after the word "Northumberland, the words Society Land and Dalton."

On the question,

Shall the amendment to the amendment be adopted?

It was decided in the negative.

Mr. Quincy moved that the amendment be amended by striking out all that part thereof, relating to the recommitment of the report to the committee.

Which was accepted by the mover.

On motion of Mr. Baker of Hillsborough

Ordered, that the amendment to the resolution lie on the table. Mr. Sawyer of Nashua raised a question of order, which was, whether, when the Convention had laid upon the table the amendment to the resolution, the resolution did not follow it?

The report of the committee to examine and count the votes for Electors of President and Vice President of the United States, was taken up and recommitted to said committee.

On motion of Mr. Baker of Hillsborough

The Convention resumed the consideration of the resolutions introduced by Mr. Sawyer of Nashua.

Mr. Baker withdrew his amendment to said resolutions, and moved instead thereof that the resolutions be amended by striking out all after the word "Resolved," and insert the following:

"That process be issued requiring the town clerks of the towns of Salem, Windham, Centre Harbor, Effingham, Milford, Temple, Sullivan, Croydon, Lempster, Alexandria, Bethlehem, Bristol and Northumberland, to appear before the Senate and House of Representatives in Convention assembled, on Friday the twenty-seventh day of November, A. D. 1840, to amend their respective certificates or returns according to law and the town record of said votes.

On the question,

Shall the amendment be adopted?

It was decided in the affirmative.

And on the question,

Shall the resolution pass?

It was decided in the affirmative.

The Convention rose and the Senate withdrew.
