Shall the fourth of said amendments be adopted? which was by striking out the fifth section of said bill and inserting as a substi tute the following to wit:

"SEC. 5. Be it further enacted, that if any person whose resi dence is in another State shall come into this State for a tempora ry purpose, or if any person shall go from one town or place in this State to any other town or place in this State for any temporary purpose with the intention of returning to his home, such

person shall not be considered a resident of any town or place in this State where he may have such temporary residence and shall not be entitled to vote therein."

Mr. Jenness of Portsmouth, from the select committee to whom were referred the petitions in relation to itinerant traders and pedlars, and the bill entitled "An act in addition to an act regulating pedlars, hawkers and showmen," reported said bill with two amendments.

Mr. Sanborn of East Kingston presented the petition of the selectmen of the town of East Kingston and thirty-seven others, legal voters of said town, praying for the passage of a law exempting said town from the operation of a law requiring towns to be districted into school districts.

Ordered, that it be referred to the committee on Education. Mr. Cate of Northfield, from the committee on Military Affairs, to whom was referred the resolution instructing them to enqaire into the expediency of so amending an act passed July 4, 1838, providing for exemption from military duty in certain cases as to require the receipt given in such cases to be filed with the captain or clerk of the company on or before the first day of April in each year, reported a bill entitled "An act providing for exemption in certain cases from military duty."
