made to said bill by the Hon. Senate, which was by inserting after the word "passed" in the eleventh line of the first section, the words following, to wit: "unless for good cause shown it shall be thought proper by the court to commit the same to the Road Commissioners.

Mr. Stickney moved to amend the amendment by adding thereto the words following, to wit-"And provided that in all cases where any petition to the court for the discontinuance of any highway which has not been made and which was laid out prior to the time when the act to which this in addition shall take effect, the same proceedings shall be had thereon as if the act to which this is in addition had not been passed, anything in said act to the contrary notwithstanding.

Mr. Barnard moved that the bill lie on the table.

Mr. Treadwell moved that the House concur with the Hon. Senate in the adoption of said amendment.

Mr. Smith of Lempster, from the committee on Engrossed Bills, reported that they had carefully examined and found correctly engrossed bills of the following titles and the following resolutions, to wit:

"An act altering the places and establishing the times and places for holding Courts of Probate in the county of Grafton." "An act to amend the laws relating to the transfer of personal property by mortgage.'

"An act in addition to the several acts relating to the assessment and collection of taxes."

"An act authorizing aliens to hold real estate."

"An act authorizing an increase of members to Engine companies No. 2 and 4 in Concord."

"An act in addition to and amendment of an act regulating marriages, and for the registering of marriages, births and burials, approved Dec. 12, 1832."

"An act to locate and authorize the erection of the New Hampshire Asylum for the Insane."

"An act in amendment of the laws now in force relative to the fees of trustees of debtors in actions before Justices of the Peace, and for other purposes."

"A resolution in favor of Joseph Cofran."

"A resolution ordering the standard weights received from the Secretary of State of the United States to be deposited in the office of the Treasurer of this State."

"A resolution authorizing the Secretary of State to purchase and deliver to the selectmen of Pinkham's Grant one copy of the revised statutes and pamphlet laws."

Which were severally signed by the Speaker.

Mr. Hill of Northwood introduced a bill entitled "An act in addition to an act regulating pedlars, hawkers and showmen.” Which was read a first and second time.

Mr. Stark presented the petition of Foster Towns and others, praying for an act of incorporation for an Insurance Company at Manchester.

Mr. Jenness of Deerfield, from the committee on Agriculture and Manufactures, to whom was referred the bill entitled "An act for the encouragement of Agriculture," reported the same without amendment.

On motion of Mr. Wilson of Keene

Ordered, that the bill be put upon its second reading for the purpose of amendment.

Mr. Wilson of Keene offered an amendment to said bill.
And the question being put,

It was decided in the affirmative.

Mr. McDaniel, from the committee on Incorporations, to whom was referred the petition of Abraham Plumer and others, praying for an act to incorporate the Farmers' Mutual Fire Insurance Company at Epping, made a report,

Mr. McDaniel, from the same committee, to whom was referred the bill entitled "An act to alter the name of the First Baptist Society in Portsmouth," reported the same without amend

Mr. Hill of Northwood, from the committee on Military Affairs, to whom was refered the petition of Samuel J. Marckres

and others,, praying for a grant of State arms to the eighth company of Light Infantry in the fifth regiment, made a report,

Mr. Learned, from the same committee, who were instructed to inquire into the expediency of repealing so much of the law passed July 6, 1833, as relates to the collection of fines for miliiary duty, and of revising the provisions of the act for the collection of military fines which were repealed by said law of July 6, made a farther report,

Resolved, that it is inexpedient to legislate upon the subject.

Mr. Cate, from the same committee, to whom was referred the bill entitled "An act allowing to the sixth company of infantry in the thirteenth regiment of the militia of this State an additional number of arms," reported the same without amendment,

Mr. Lane, from the committee on Claims, to whom was referred the account of Asa Fowler and others, reported the following resolution:

Resolved by the Senate and House of Representatives in General Court convened, that Asa Fowler be allowed the sum of ninety dollars and fifty cents; Harry Hibbard two hundred twentyeight dollars and sixty-seven cents; and Moses F. Morrison fourteen dollars in full for their several accounts, the same to be paid out of any money in the treasury not otherwise appropriated. Which was read a first time.

Ordered, that it be read a second time this forenoon at eleven o'clock.

Mr. Copeland, from the committee on Banks, to whom was referred the petition of the Directors of the Concord Bank, made a report,

Whereupon

Resolved, that the further consideration thereof be postponed to the next session of the Legislature.

Mr. Parker of Fitzwilliam, from the committee on Education, to whom was referred the bill entitled "An act in addition to and in amendment of an act for the support and regulation of primary schools, passed January 4, 1833," reported the same without amendment.

Mr. Treadwell, from the committee on Roads, Bridges and Canals, to whom was referred the petition of Hobart Clark and others, Directors of the Boston and Maine Railroad asking leave to make a statement in addition to their annual report for the year 1840, with a request that the same be placed upon file with the original report of the Directors to which it refers, made a report, Whereupon

Resolved, that the statement of the Directors of the Boston and Maine Railroad, in addition to their annual report for the year 1840, together with this report, be entered upon the Journals of the House

To the Honorable the Senate and House of Representatives of the State of New Hampshire.

The undersigned respectfully represent that on the 18th of June last they received an attested copy of a report made on the preceding day in the House of Representatives by the committee on Roads, Bridges and Canals, in relation to the annual report of the Directors of the Boston and Maine Railroad. That the annexed statement in addition to that report of the Directors was immediately drawn up and sent to Concord for the purpose of being presented to the House, but that, to their great regret, the Legislature adjourned on the following day, before an opportunity had been found of so doing. The undersigned now desire respectfully to lay it before the House, with the request that it may be placed on file with the original report of the Directors to which it refers.

The undersigned, a majority of the Directors of the Boston and Maine Railroad, respectfully ask leave to make the following statement in addition to their annual report for the year 1840.

In the report above referred to, it was stated that "the owners of land over which the road has been constructed, are in general friendly to the undertaking. Their damages have been settled, with a few exceptions, on reasonable terms."
