Ordered, that it be referred to the committee on Incorporations.

The House proceeded to the order of the day upon bills of the following titles, and the following resolutions, to wit:

"An act relating to primary schools."

"An act in addition to and amendment of an act entitled an act relating to Banks and Banking and to establish Bank Commissioners for the State of New Hampshire, approved July 5, 1837."

"An act in amendment of an act entitled an act to incorporate the proprietors of the Pinkham Turnpike Road, approved July 4,

1834."

"An act in addition to and amendment of an act regulating marriages, and for the registering of marriages, births and burials, approved Dec. 12, 1832."

"An act authorizing an increase of members to Engine companies No. 2 and 4 in Concord."

"An act relating to the return of votes, and making further provision for certifying the same."

"An act providing for the admeasurement of round Ship tim

ber."

"A resolution in favor of the proprietors of Pinkham's Grant." "A resolution respecting a set of standard weights transmitted to this State from the office of the Secretary of State at Washington."

Which were severally read a third time.

Resolved, that they pass and that the titles of the bills be as aforesaid.

Ordered, that the Clerk request the concurrence of the Senate therein.

The House resumed the consideration of the unfinished business of Saturday, upon the motion of Mr. Baker of Hillsborough, that the resolution relating to the subject of the memorial of Robert Wallace, be taken up and disposed of.

And the question being put,

It was decided in the affirmative.

The question being upon the passage of said resolution.
The resolution was withdrawn by the mover.

On motion of Mr. Wells

Resolved, that the Secretary of State be requested to lay before the House the quarterly returns of the Concord Bank for September and December, 1840.

Mr. Smith of Lempster submitted the following preamble and

resolutions:

Whereas by a report of a committee of the Legislature of this State,accepted June 25, 1818, His Excellency William Plumer, then Governor of this State, was permitted to transmit certain books and papers from the Secretary's office to the Secretary of War for the purpose of establishing the claims of officers and soldiers who served in the war of the revolution, for pensions under the law of Congress passed 1818.

And whereas the interest of the people of this State requires that those books and papers should be returned to the office of the Secretary of this State Therefore be it

Resolved by the Senate and House of Representatives in General Court convened, that the Secretary of this State is hereby authorized and directed to demand and receive from the Secretary of War the books, records and papers now in the War office or in the Pension office, which belong to this State, and deposite the same in the office of the Secretary of this State.

And be it further resolved, That the Governor of this State cause said papers or such portions thereof, to be arranged and bound for preservation, as in his judgment the interest of the people of this State may require.

Said preamble and resolutions were read a first time.

Ordered, that they be read a second time to-morrow forenoon at eleven o'clock.

A message from the Senate by their Clerk:

"Mr. Speaker-The Senate concur with the House of Representatives in the passage of bills of the following titles to wit:

"An act authorizing aliens to hold real estate.'

"An act in addition to and in amendment of an, act entitled an act to provide for the choice of Road Commissioners," with amendments in which they ask the concurrence of the House."

The House proceeded to the consideration of the foregoing bill, with the amendments which came down from the Honorable Senate.

Ordered, that it lie lie on the table.

The Speaker laid before the House a statement of the affairs of the Concord Bank as, it existed on the first Monday of September 1840; also a statement of the affairs of the Concord Bank, as it existed on the first Monday of December, 1840, made in conformity to an act relating to Banks and Banking and to estab

lish Bank Commissioners for the State of New Hampshire passed July 5, 1837, and an act in addition thereto, approved July 4, 1838, which had been transmitted to the House by the Secretary of State, agreeably to a resolution of the House.

On motion of Mr. Wells

Ordered, that they be referred to the committee on Banks. Pursuant to previous notice and by leave,

Mr. Jenness of Portsmouth introduced a bill entitled “An act to alter the name of the first Baptist Society in Portsmouth." Which was read a first and second time.

On motion of Mr. Jenness of Portsmouth—

Ordered, that it be referred to the committee on Incorporations.

Pursuant to previous notice and by leave,

Mr. Warner introduced a bill entitled "An act in amendment of an act entitled an act establishing the times and places of holding Courts of Probate in the county of Coos, approved June 19,

1840.

Which was read a first time.

Ordered, that it be read a second time to-morrow forenoon at eleven o'clock.

Mr. Sanborn of East Kingston gave notice that he will tomorrow ask leave to introduce a bill relating to the taxing of railroad corporations.

On motion of Mr. Wells

The House resumed the consideration of the resolution in favor of George P. Meserve and cthers.

On motion of Mr. Wells—

Resolved, that the House non-concur in the amendment to said resolution made by the Hon. Senate.

Ordered, that the Clerk inform the Senate thereof.

Pursuant to previous notice and by leave,

Mr. Cox introduced a bill entitled "An act in addition to and amendment of an act entitled an act for the support and regulation of primary schools, passed Jannary 4th, 1833,"

Which was read a first and second time.

On motion of Mr. Cox

Ordered, that it be referred to the committee on Education. On motion of Mr. Warner

Resolved, that when the House adjourn this afternoon, it adjourn to meet again at nine o'clock in the forenoon, and when it adjourn in the forenoon, it adjourn to meet again at two o'clock in the afternoon, until otherwise ordered.

On motion of Mr. SwaseyResolved, that the committee on Elections be, and they hereby are authorized to send for persons and papers, if such shall be found necessary to a full and fair investigation of all the facts or intimation of facts set forth in the memorial, or statement of facts relative to the election in the town of Henniker, which has been to said committee referred, and that said committee be instructed so to do, if an immediate, complete and satisfactory investigation of said matter cannot otherwise be had.

On motion of Mr. Weeks of Canaan

The House resumed the consideration of the report of the committee on the Judiciary to whom was referred the bill entitled "An act to incorporate the Female Charitable Society in Con

cord."

The question being on the passage of the following resolution:
Resolved, that the same be indefinitely postponed.

It was decided in the negative.

On motion of Mr. St. Clair

Ordered, that said bill be recommitted to the committee on the Judiciary.

On motion of Mr. Ayer

The House adjourned.

TUESDAY, DEC. 15, 1840.

Mr. Ames presented the petition of Silas Sawyer and others praying to be disannexed from the town of Sharon and annexed to the town of Peterborough.

Also the petition of Moses Sawyer and others praying to be disannexed from the town of Sharon and annexed to the town of Jaffrey.

Mr. McDaniel presented the petition of Samuel E. Buzzel and others, citizens of the town of Lee, praying that a portion of said town of Lee and Durham be severed from said towns and annexed to the town of Madbury.

Ordered, that said petitions be referred to the committee on

Towns and Parishes.

Mr. Baker of Hillsborough presented the memorial of Joel Parker and others, recommending two terms of the Superior

Court to be held at Concord annually instead of the terms in the several counties.

Mr. Baker of Hillsborough called for the reading of said memorial.

Which was read.

Ordered, that it be referred to the committee on the Judiciary. Mr. Cate, from the committee on Military Affairs, to whom was referred the petition of Joshua Chatman and others, praying for an act of incorporation for the first company of Light Infantry in the fourteenth regiment, made a report,

Resolved, that the petitioners have leave to withdraw their pe

tition.

Mr. Bryant, from the committee on Incorporations, to whom was referred the petition of Lyman Hayes and others, praying for an act of incorporation of the proprietors of the Universalist Meeting House in Orford, made a report,

Mr. Baker of Hillsborough, from the committee on the Judiary, to whom was referred the bill entitled "An act to amend the law relating to the transfer of real estate by mortgage," made a report,

Mr. Hatch of Exeter, by leave, presented the petition of Nathaniel Batchelder and others, praying for an act of incorporation by the name of the President,. Directors and Company of the Swanscot Bank.
