On motion of Mr. Parker of Fitzwilliam

Ordered, that it lie on the table.

Mr. Parker of Fitzwilliam, from the committee on Education, who were instructed to inquire into the expediency of repealing an act entitled "An act providing for the division of towns into school districts, and for the alteration of the limits of school districts in certain cases," passed July 6, 1839, made a report, Whereupon

Resolved, that it is inexpedient to repeal said act.

Mr. Hoit of Bridgewater, from the committee on Towns and Parishes, to whom was referred the petition of William Pierce, praying that his farm be severed from the town of Campton and annexed to the town of Plymouth, made a report,

Whereupon

Resolved, that the petitioner have leave to withdraw his petition.

Mr. Cate, from the committee on Military Affairs, to whom was referred the petition of Loring Stoddard and others, praying for the removal of Jonathan W. Sanborn, captain of the fifth company of Infantry in the thirty-third regiment of N. H. militia, made a report,

Resolved, that the petitioners have leave to withdraw their pe

tition.

Mr. Cate, from the committee on Military Affairs, to whom was referred the petition of the officers and soldiers of the 32d regiment, praying for the alteration of the law in relation to the powers and duties of surgeons, reported a bill entitled "An act in addition to former acts relating to the powers and duties of sur. geons."

Which was read a first time.

Ordered, that it be read a second time to-morrow forenoon at eleven o'clock.

Mr. Howard, from the committee on Incorporations, to whom was referred the petition of Joseph M. Harper and others, praying for an act incorporating the Freewill Baptist printing establishment and Book Concern in Dover, reported a bill entitled "An act to incorporate the trustees of the Freewill Baptist printing establishment and Book Concern at Dover.

Which was read a first and second time.

Mr. Treadwell, from the committee on Roads, Bridges and Canals, to whom was referred the petition of T. G. Messer and others, praying for a toll bridge across Connecticut River, repor ted a bill entitled "An act to incorporate the proprietors of Cole- . brook Bridge."

Which was read a first time.

Ordered, that it be read a second time to-morrow forenoon at eleven o'clock.

Mr. Baker of Hillsborough, from the committee on the Judiciary, to whom was referred the petition of William Farrar and others, praying for a law authorizing the appointment of a reporter, reported the following resolution:

Resolved, that the petitioners have leave to withdraw their peti

tion.

Ordered, that the report lie on the table.

Mr. Baker of Hillsborough, from the same committee to whom was referred the bill entitled "An act providing for the appointment of a reporter of the decisions of the Superior Court of Judicature, reported the following resolution.

Resolved, that said bill be indefinitely postponed.

On motion of Mr. Wells

Ordered, that the report lie on the table.

Mr. Perkins of Allenstown, from the joint select committee to fix on a time when the business of the present session may be brought to a close, reported the following resolution.

Resolved by the Senate and House of Representatives in General Court convened, that the business of the present session of the Legislature may be brought to a close on Thursday the seventeenth day of December instant.

On motion of Mr. Wentworth

Ordered, that the resolution lie on the table.

The House proceeded to the order of the day upon the following resolution:

Resolved by the Senate and House of Representatives in General Court convened, that the sum of seven thousand dollars be, and the same hereby is appropriated for the use of the State Prison for the purpose of paying the amount due from the Prison to the late Warden, and of enabling the present warden to carry on the business connected with said institution, and that His Excellency the Governor be, and he hereby is authorized to draw the above sum from the Treasury by his warrants from time to time as he may think necessary.

Which was read a second time.

Ordered, that it be read a third time to-morrow afternoon at three o'clock.

The House proceeded to the order of the day upon the following resolution:

Resolved by the Senate and House of Representatives in General Court convened, that the sum of five hundred dollars be and the same is hereby appropriated for the contingent expenses of this State, and that His Excellency the Governor be and hereby is authorized to draw from time to time from the Treasury, for such expenses, such sums as to him may appear necessary, not exceeding in the whole the above sun.

Which was read a second time.

On motion of Mr. Ayer

Resolved, that the rules of the House be so far suspended as that the resolution be read a third time at the present time.

The resolution was then read a third time.

Resolved, that it pass.

Ordered, that the Clerk request the concurrence of the Senate therein.

A message from the Senate by their Clerk:

"Mr. Speaker The Senate concur with the House of Representatives in the appointment of a joint select committee to inform the Hon. Levi Woodbury of his election to the office of Senator, and have on their part joined Mr. Pickering."

Mr. Ela, from the committee on Engrossed Bills, reported that they had carefully examined and found correctly engrossed bills of the following titles and the following resolutions, to wit:

"An act to sever a lot of land numbered one hundred and fifty, owned and occupied by Elhanan Winchester, from the town of Stark, in the county of Coos, and annex the same to the town of Lancaster."

"An act in favour of the Artillery company in the thirty-second Regiment, New Hampshire Militia."

"An act to change the name of the town of Coventry to Benton."

"An act to regulate the sale of hoops and staves."

"An act to incorporate the third company of Light Infantry in the twenty-seventh Regiment."

"An act in addition to an act entitled an act empowering school districts to build and repair school houses, passed July 6, 1827," "An act in amendment of an act entitled an act to prevent fraud in cord wood exposed to sale, passed June 15, 1791,"

"An act providing compensation for the Electoral Board." "A resolution disannexing the place called Pinkham's Grant from the district of Jefferson, &c.

"A resolution disannexing the town of Carroll from the town of Dalton, &c.

Said bills and resolutions were then severally signed by the Speaker.

Ordered, that the Clerk inform the Senate thereof.

Mr. Wilson of Keene by leave presented "a statement of facts by Robert Wallace one of the selectmen of the town of Henniker, in relation to the return of rateable polls in said town upon which return was predicated the number of Representatives to which said town is entitled in the House of Representatives."

Mr. Wilson of Keene submitted the following resolution: Resolved, that said statement be referred to the committee on Elections, and that said committee have power to send for per sons and papers and report the facts to the House.

Mr. Baker of Hillsborough moved that the resolution be amended by striking out all that part thereof after the word "Elec
