Clerks of Windham, Salem, Sullivan, Milford, Effingham, Temple, Lempster, Centre Harbour, Alexandria, Croydon, Bethlehem, Bristol and Northumberland, who had been summoned to appear before the Convention this day.

The chairman informed the Convention that the precepts com manding the appearance of said Town Clerks before the Convention this day, had all been duly served and returned.

The chairman also informed the Convention that the Secretary of State had laid before the Convention the returns of votes which had been received from the towns of Dalton and Society Land.

On motion of Mr. Goodhue of the Senate

Resolved, that the Convention proceed to propound such interrogatories to the delinquent Town Clerks as may be deemed proper, and that said Clerks may answer upon oath to interrogatories that may be put to them by the Convention or by their or der.

Isaac M'Gaw, Town Clerk of the town of Windham, having been first duly sworn, testified, in reply to an interrogatory of the select committee for that purpose, propounded by the chairman of the Convention, as to whether he had made any mistake in making the records of the votes cast in the town of Windham for Electors of President and Vice President of the United States on the first Monday of November current, or in his return of the same -that he had made a mistake both in the records and in the return-that it did not appear from the records or return that any votes were cast in said town of Windham on said first Monday of November current for Andrew Pierce, Jr. as an Elector of President and Vice President of the United States, whereas sixty-two

votes were so cast.

Resolved, that the Town Clerk of Windham be permitted to amend both his records and return agreeably to the facts.

The Town Clerk of Windham amended his records and return accordingly.

Frederick W. Bailey, Town Clerk of the town of Salem, having been first duly sworn, testified, in reply to the like interogatory of the select committee, propounded by the chairman of the Convention, as to any mistake made by him in the record or return of votes cast in the town of Salem, that he had made a mistake in the return of votes cast in said town, that one hundred and

fifty-eight votes, returned as having been cast for Andrew Pierce as an Elector of President and Vice President of the United States in said town of Salem on the first Monday of November current, were in fact cast, and recorded as having been cast, and should have been returned for Andrew Pierce, Jr. for that office. Resolved, That the Town Clerk of Salem be permitted to amend his return agreeably to the facts and the Town Records. The Town Clerk of Salem amended his return accordingly. Selim Frost, Town Clerk of the town of Sullivan, having been first duly sworn, testified, in reply to the like interogatory of the select committee, propounded by the chairman of the Convention, as to any mistake made by him in the record or return of votes cast in the town of Sullivan, that he had made a mistake in his return, inasmuch as he had returned thirty votes as given for Andrew Pierce, which were cast, and recorded as cast, for Andrew Pierce, Jr. as an Elector of President and Vice President of the United States.

Resolved, that the Town Clerk of Sullivan be permitted to amend his return agreeably to the facts and the Town Records. The Town Clerk of Sullivan amended his return accordingly. Daniel Russell, Town Clerk of the town of Milford, having been first duly sworn, testified, in reply to the like interrogatory of the select committee in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Milford, that he had made a mistake in his return, having returned two hundred and twenty-five votes as given for George B. Nesmith for an Elector of President and Vice President of the United States, which were given and recorded as having been given for George W. Nesmith for that office.

Resolved, that the Town Clerk of Milford be permitted to amend his return agreeably to the facts and the Town Records. The Town Clerk of Milford amended his return accordingly. George W. Drake, Town Clerk of the town of Effingham, having been first duly sworn, testified, in reply to the like interrogatory of the select committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Effingham, that he had made a mistake in returning fifty-two votes as having been cast for Thomas Edwards, which were cast and recorded as having been cast for Thomas M. Edwards.

Nathan Colburn, Jr. Town Clerk of the town of Temple, hav ing been first duly sworn, testified, in reply to the like interrogatory of the select committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Temple, that he had made a mistake in both the record and return, having recorded and returned ninety votes as cast for George Nesmith, which were cast and should have been recorded and returned as cast for George W. Nesmith, and fifty-one votes as cast for Samuel Patch, which were cast and should have been recorded and returned as cast for Samuel Hatch.

David Thornton, Town Clerk of the town of Lempster, having been first duly sworn, testified in reply to the like interrogatory of the select committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Lempster, that he had made a mistake in his return, having returned ninety-six votes as cast for Amos Brewster, which were cast and recorded as cast for Amos A. Brewster.

Paine, Town Clerk of the town of Centre Harbour, having been first duly sworn, testified, in reply to the like interrogatory of the select committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Centre Harbour, that he made a mistake in not returning any votes as cast for Thomas M. Edwards, when twenty-five votes were cast and recorded as cast for said Edwards.

Resolved, that the Town Clerk of Centre Harbour be permitted to amend his return agreeably to the facts and the Town Records. The Town Clerk of Centre Harbour amended his return accordingly.

James Crawford, Town Clerk of the town of Alexandria, having been first duly sworn, testified, in reply to the like interrogatory of the select committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Alexandria, that he had made a mistake both in the record and return, one hundred and fifty-nine votes having been recorded and returned as cast for John Weeks, which were cast and should have been recorded and returned as cast for John W. Weeks.

Resolved, that the Town Clerk of Alexandria be permitted to amend both his records and return agreeably to the facts.

The Town Clerk of Alexandria amended his records and return accordingly.

Benjamin Skinner, Town Clerk of Croydon, having been first duly sworn, testified, in reply to the like interrogatory of the select committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Croydon, that he had made a mistake in the return, having returned ninety-six votes for Thomas Edwards, which were cast and recorded as cast for Thomas M. Edwards.

Resolved, That the Town Clerk of Croydon be pormitted to amend his return agreeably to the facts and the Town Records. The Town Clerk of Croydon amended his return accordingly.

Timothy P. Turner, Town Clerk of Bethlehem, having been first duly sworn, testified, in reply to the like interrogatory of the select committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Bethlehem, that forty-four votes were recorded and returned as having been cast for Amos Brewster, which he supposed should have been recorded and returned as cast for Amos A. Brewster ; and in reply to a further interrogatory of the select committee as to whether he had any doubt that the forty-four votes recorded and returned as cast for Amos Brewster were cast for Amos A. Brewster, he testified that he had not, upon the whole.

Mr. Sawyer of Nashua of the House moved that the Town Clerk of Bethlehem be permitted to amend his return of votes cast if he choose to do so.

Mr. Ela of Meredith of the House proposed to amend the motion so as to permit the Town Clerk of Bethlehem to amend his return according to the facts within his knowledge.

Mr. Blaisdell of Hanover of the House suggested an amendment to the amendment proposed by the gentleman from Meredith, Mr. Ela, which was accepted by Mr. Ela.

The amendment as modified read

"Resolved, that the Town Clerk of Bethlehem be permitted to amend or correct his return according to facts within his knowledge and also the Records of said town."

On the qustion, shall the amendment be adopted?

The Town Clerk of Bethlehem amended his return and Records accordingly.

William L. Chase, Town Clerk of Bristol, having been first duly sworn, testified, in reply to the like interogatory of the se lect committee, in like manner propounded, as to any mistake made by him in the record or return of votes cast in the town of Bristol, that he had made a mistake both in the record and return, having recorded and returned one hundred and four votes as cast for John P. Weeks, which were cast for John W. Weeks.

On motion of Mr. Gregg of the Senate

Resolved, that the Town Clerk of Bristol be permitted to amend his records and return agreeably to the facts.

The Town Clerk of Bristol amended his records and return accordingly.

The Town Clerk of the town of Northumberland, was called but did not appear.

Mr. Treadwell of Portsmouth of the House moved to instruct the select committee to inquire of the Town Clerk of Temple whether any votes were cast or declared in that town for Samuel Patch as an Elector of President and Vice President of the United States; and if not, to request him to explain how the name of said Patch came to be entered on the records of said town. Which was decided in the affirmative.

The interrogatory having been propounded accordingly, the Town Clerk of Temple testified that no votes were cast or declared for Samuel Patch as aforesaid, and he was wholly unable ́to explain how the name of said Patch came to be entered on the records, except through haste and by mistake.

The Convention proceeded to read and record the amended returns of votes for Electors of President and Vice President from the towns of Windham, Salem, Sullivan, Milford, Effingham,
