Resolved, that the Senate now meet the House of Representatives in Convention, for the purpose of proceeding in the elec tions.

IN CONVENTION.

The Senate and House of Representatives being assembled in Convention in the Representatives' Hall, for the purpose of proceeding in the elections agreeably to the laws of the State,

On motion of Mr. Quincy of Rumney of the House, who had voted with the majority on that question,

Resolved, that the vote of the Convention accepting the report of the, select committee appointed to receive the returns of votes for Electors of President and Vice President of the United States, compare and cast their numbers, be reconsidered.

On motion of Mr. Ela of Meredith of the House-
Ordered, that said report lie upon the table.

On motion of Mr. Baker of Hillsborough of the House— The Convention resumed the consideration of the resolutions offered yesterday by Mr. Sawyer of Nashua of the House, providing for the summoning of certain delinquent town clerks before the Convention for the purpose of amending their respective returns, and the appointment of a select committee to examine said town clerks upon oath and report facts to the Convention.

Mr. Baker proposed to amend the resolutions by striking out all after the word "Resolved," and inserting the following words: "That the report of the select committee appointed to examine and count the returns of votes for Electors of President and Vice President and to report thereon, be recommitted, that process be issued requiring the town clerks of the towns of Salem, Windham, Centre Harbor, Effingham, Milford, Temple, Sullivan, Croydon, Lempster, Alexandria, Bethlehem, Bristol, and Northumberland, to appear before said committee on Friday the twenty-seventh day of November, A. D. 1840, at eight o'clock in the forenoon, to amend their respective certificates or returns according to law and the town records of such votes; and that said committee report thereon to the Convention."

Mr. Spalding of Nashua of the House, moved to amend the proposed amendment by inserting after the word, "Northumber land" in the tenth line thereof the words "Society Land and Dalton."

On the question, shall this amendment to the proposed amendment be adopted?

It was decided in the negative.

Mr. Quincy of Rumney of the House, proposed a further amendment to the proposed amendment, striking out therefrom the words, "That the report of the select committee appointed to examine and count the returns of votes for Electors of President and Vice President of the United States, be recommitted,"

Which amendment to the proposed amendment was accepted by the mover.

On motion of Mr. Baker of Hillsborough, of the HouseOrdered, that the proposed amendment lie upon the table. Mr. Sawyer of Nashua of the House rose to a question of order, which was, whether, the Convention having laid upon the table the amendment proposed by Mr. Baker of Hillsborough, the resolutions to which the amendment was proposed did not follow it.

And the Chair deciding that they did not,

Ordered, that said resolutions lie upon the table.

On motion of Mr. Quincy of Rumney of the House

The Convention resumed the consideration of the report of the select committee appointed to receive the returns of votes for Electors of President and Vice President of the United States, compare and cast their numbers.

On motion of Mr. Quincy of Rumney of the House—

Ordered, that said report be recommitted to said committee.
On motion of Mr. Baker of Hillsborough of the House-

The Convention resumed the consideration of the resolutions offered yesterday by Mr. Sawyer of Nashua of the House, providing for the summoning of certain delinquent town clerks before the Convention for the purpose of amending their respective returns, and the appointment of a select committee to examine said town clerks upon oath and report facts to the Convention, together with the amendment to said resolutions proposed by Mr. Baker of Hillsborough of the House.

Mr. Baker withdrew his proposed amendment and offered the following as a substitute therefor:

Strike out all after the word "Resolved," and insert the following, viz: "That process be issued requiring the town clerks of the towns of Salem, Windham, Centre Harbor, Effingham, Mil ford, Temple, Sullivan, Croydon, Lempster, Alexandria, Beth lehem, Bristol and Northumberland, to appear before the Senate

and House of Representatives in Convention assembled, on Friday the twenty-seventh day of November, A. D. 1840, to amend their respective certificates or returns according to law and the town records of such votes."

On the question, shall this amendment be adopted?

It was decided in the affirmative.

On the question, shall the resolutions as amended pass?
It was decided in the affirmative.

The Convention rose and the Senate returned to their Chamber.

Resolved, that when the Senate adjourn this forenoon, it be to meet again on Monday next at three o'clock in the afternoon. On motion of Mr. Goodhue

A message from the House of Representatives by their Clerk:

"Mr. President-The House of Representatives have passed a bill entitled "An act to render Railroad Corporations liable for damages by fire or steam;" in which they ask the concurrence of the Honorable Senate."

The foregoing bill, sent up from the House of Representatives for concurrence, was read a first and second time.

Ordered, that it be referrred to the committee on the Judicia

Mr. Renton, from the committee on Incorporations, to whom was referred the bill entitled "An act to disannex the farm owned in common by Ezra Eastman and Samuel Osgood from Gilmanton in the county of Strafford, and annex the same to Gilford in said county," made a report,

Whereupon

Resolved, that the further consideration of said bill be indefinitely postponed.

Mr. Gregg, from the committee on the Judiciary, to whom was referred so much of the message of His Excellency the Governor at the last June session as relates to a Geological Survey of the State, made a report, .

Whereupon

Resolved, that the further consideration of the same be postponed to the next session of the Legislature.

Mr. Pickering, from the select committee to whom was referred the message of His Excellency the Governor, with instructions to report what disposition be made of the several subjects. embraced therein, made a report,

Whereupon

Resolved, that so much of said message as relates to banks and banking, be referred to the committee on Banks.

That so much as relates to a new apportionment of public taxes, be referred to the select committee having that portion of the Governor's message at the last June session relating to that subject under consideration

That so much as relates to the State Prison, be referred to the select committee having under consideration so much of the Governor's message at the last June session as relates to that subjectThat so much as relates to a Geological Survey, be referred to the select committee on that subject

That so much as relates to the judicial system, be referred to the committee on the Judiciary

That so much as relates to the suffering insane, be referred to the committee on the Judiciary.

Mr. Nutter, from the committee on Unfinished Business, made a report,

Whereupon

Resolved, that so much of the message of His Excellency the Governor at the last June session as relates to an Insane Hospital and the location thereof, be referred to the committee on the Judiciary.

The Senate adjourned.

WEDNESDAY, NOV. 25, 1840.

Mr. Gregg, from the select committee on the subject of a Geological survey, to whom was referred so much of the message of His Excellency the Governor as relates to that subject, made a report,

Whereupon

Resolved, that the further consideration of the same be postponed to the next session of the Legislature.

A message from the House of Representatives by their Clerk:

"Mr. President-The House of Representatives have appointed Messrs. Quincy of Rumney, and Sawyer of Nashua, with such as the Senate may join, a committee to propound such questions as may be deemed proper, to the delinquent town clerks who have been summoned to appear before the Senate and House of Representatives in Convention assembled on Friday next; in which they ask the concurrence of the Honorable Senate."

Resolved, that the Senate concur with the House of Representatives in the appointment of a joint select committee to examine the delinquent town clerks who have been summoned to appear on Friday next, before the Convention of both Houses.
