Agreements. (By Memorandum.) ALL AGREEMENTS under hand and seal must be en

grossed on an half crown stamp; and in memorandums of agreement on unstamped paper, care must be taken not to create a covenant, or the attorney will be liable to a penalty of sol. to be sued for by the Commissioners of the stamp duties.

Every agreement which requires a specific performance, ought

to be certain, and fair in all its parts, and for an adequate

appraisement. MEMORANDUM made this day of May, 1973, between

C. D. of, öc. and J. L. of, &c. as follows, viz. T

HAT for and in confideration of pounds, to be paid after

the appraisement hereafter mentioned is made, C. D. mall let unto 7. L, the Red Lyon alehouse, with the sheds, shops, or rooms, and other appurtenances thereunto belonging, fituate in in the county of for the remainder of the several terms therein now to come and unexpired by the several leases thereof, and by a legal assignment, as soon as the said appraisement is made, will align over the several leases thereof unto the said . L. TO HOLD from Midsummer-day next, for the remainder of the several terms therein now to come and unexpired; AT and under the yearly rent of pounds, payable quarterly. The said C. D. to pay all taxes whatsoever up to Midsummer-day next; and it is agreed between the said parties that y. L. fhall take all the goods, beer, wine, and {pirituous liquors in the said house and cellars, at an appraisement to be made thereof by two indifferent persons, one to be named and chosen by each of the said parties, which are to be paid for as soon as such appraisement is ended; and if either of the said parties Mall ni
