Agreements. (By Memorandum.)

ALL AGREEMENTS under hand and feal must be engroffed on an half crown ftamp; and in memorandums of agreement on unftamped paper, care must be taken not to create a covenant, or the attorney will be liable to a penalty of sol. to be fued for by the Commiffioners of the stamp duties.

Every agreement which requires a fpecific performance, ought to be certain, and fair in all its parts, and for an adequate confideration. Vefey, vol. 1. cafe 143.

MEMORANDUM made this day of May, 1773, between G. D. of, &c. and J. L. of, &c. as follows, viz.

AHAT for and in confideration of pounds, to be paid after the appraisement hereafter mentioned is made, C. D. fhall let unto 7. L. the Red Lyon alehoufe, with the fheds, fhops, or rooms, and other appurtenances thereunto belonging, fituate in

in the county of for the remainder of the several terms therein now to come and unexpired by the feveral leafes thereof, and by a legal affignment, as foon as the faid appraisement is made, will affign over the feveral leases thereof unto the faid . L. TO HOLD from Midfummer-day next, for the remainder of the feveral terms therein now to come and unexpired; AT and under the yearly rent of pounds, payable quarterly. The faid C. D. to pay all taxes whatfoever up to Midfummer-day next; and it is agreed between the faid parties that J. L. fhall take all the goods, beer, wine, and fpirituous liquors in the faid houfe and cellars, at an appraisement to be made thereof by two indifferent perfons, one to be named and chofen by each of the faid parties, which are to be paid for as foon as such appraisement is ended; and if either of the faid parties fhall not
