the part of the faid B. S. and in full performance thereof, and for and in confideration of the fum of pounds in hand paid, by the faid E. G. to the faid B. S. before the fealing and delivery thereof, and of the rent and covenants herein contained on the part and behalf of the faid E. G. his executors, administrators, and affigns, to be paid, kept, done, and performed; he the faid B. S. did demife, lease, set, and to farm let unto the faid E. G. his executors, adminiftrators, and affigns, all that piece or parcel of ground fituate, lying, and being in or near- -, in the parish of - in the faid county of

containing by eftimation the feveral and respective quantities or numbers of feet, and abutted and bounded in fuch fort, manner, and form, as in the plan annexed to the faid in part recited indenture of leafe is particularly mentioned and defcribed. And also all those five several new brick meffuages, or tenements with the appurtenances, erected and built by the said E. G. in and upon the faid piece or parcel of ground, or fome part thereof, together with all and fingular the cellars, follars, lights, rooms,chambers, ways, eafements, waters, water-courfes, profits, commodities, and appurtenances whatsoever, to the faid piece or parcel of ground, meffuages or tenements, or any of them belonging, or in any wife appertaining, TO HOLD the faid premifes unto the faid E. G. his executors, adminiftrators, and affigns, from the feast day of — -, then laft paft, for and during the years, from thence next enfuing, and fully to be compleat and ended, at and under the rent of one pepper corn for the firft year of the faid term of years, being lawfully demanded; and for and during the remainder of the faid term of years, the yearly rent of pounds, of lawful money of Great Britain, payable quarterly, free from all public, parliamentary, or other taxes, as therein is mentioned, as by the faid indenture of leafe relation being thereunto had, will more fully appear. NOW THIS INDENTURE WITNESSETH, that for and in confideration of the fum of pounds, of lawful money of Great Britain, to the faid E. G. in hand paid, by the faid C. S. at or before the fealing and delivery of thefe prefents, the receipt whereof he the faid E. G. doth hereby acknowledge, and thereof, and of every part thereof, doth acquit, releafe, and difcharge the faid C. S. his executors, adminiftrators, and affigns, for ever, and by thefe prefents: he the faid E. G. HATH granted, bargained, fold, affigned, transferred, and fet over, and by these presents DOTH grant, bargain, fell, affign, transfer, and fet over, unto the faid C. S. his executors, adminiftrators, and affigns, all that the faid piece or parcel of ground, with the faid five feveral new brick meffuages or tenements, with all and fingular other the premifes above mentioned to have been demifed by the faid recited indenture of leafe, with their and every of their appurtenances, together with the faid recited indenture of leafe: And alfo all the eftate, right, title, intereft, time, and term of years now to come and unexpired, ufe, truft, profit, property, claim, and demand whatsoever of him the faid E. G. of, in, and to the fame, and every part and parcel thereof, by force, virtue, or means of the faid recited indenture

S. his executors, adminiftrators, and affigns, all thofe five feveral policies of infurance refpectively numbered as follows; namely, fixty four thou fand two hundred and thirty, fixty-four thousand two hundred and thirty-one, fixty-four thousand two hundred and thirty-two, fixtyfour thousand two hundred and thirty-three, fixty-four thoufand two hundred and thirty-four; whereby the before mentioned to be granted and affigned premifes are infured from fire, in and by the AMICABLE CONTRIBUTIONSHIP, or fociety commonly called the HAND IN HAND Office, for the fum of pounds, (to wit) the fum of pounds on cach of the faid feveral policies, together with all intereft, profit, and advantage that may arife or accrue, from or by the fame, or any of them, TO HAVE AND TO HOLD the faid piece or parcel of ground, with the mefluages or tenements erected and built thereon, and all and fingular other the premifes herein before mentioned or intended to be hereby affigned, with their and every of their appurtenances, together with the faid recited indenture of leafe, inftruments or policies of infurance, and all interest and profit thereof, unto the faid C. S. his executors, adminiftrators, and affigns, from henceforth, for and during all the reft, refidue, and remainder of the faid term of years, in and by the faid recited indenture of leafe granted, now to come and unexpired; PROVIDED always, and thefe prefents are upon this condition nevertheless, that if the faid E. G. his executors, adminiftraters, or afligns, or any of them, do and fhall, well and truly pay, or caufe to be paid unto the faid C. S. his executors, adminiftrators, and affigns, in the faid county of, the full fum pounds, of lawful money of Great Britain, in manner following, that is to fay, the fum of pounds, on the next enfuing the day of the date of thefe prefents, and the pounds, refidue thereof in on or upon the

fum of day of -- then next following, and which will be in the year of our Lord -, without making any default, deduction, or abatement, for or in refpect of any taxes, charges or impofitions what foever, fet or impofed, or that fhall or may hereafter be fet, or impofed upon the faid premifes, or the monies hereby fecured or any part thereof, by authority of parliament, or otherwife howfoever, that then thefe prefents and every thing herein contained fhail ceafe, and be void, any thing herein contained to the contrary thereof notwithstanding. AND the faid E. G. for himself, his heirs, executors, and adminiftrators, DOTH covenant, promife, and agree, to and with the faid C. S. his executors, adminiftrators, and affigns, in manner following, that is to fay, that he the faid E. G. his executors, adminiftraftors, or affigns, fhall and will, well and truly pay, or caufe to be paid, unto the faid C. G. for himself, his heirs, executors and administrators, DOTH covenant, promife and grant, to and with the faid C. S. his executors, adminiftrators or affigns, by thefe prefents in manner and form following, that is to fay, that the faid recited indenture of leafe and policy of infurance, hereby affigned at the time of the fealing and delivery of these prefents, are, and each of them is good and fufficient in the law, and no ways forfeited, furrendered, mortgaged, or otherwife incumbered; and that he the faid E. G. hath row in himself full power, good right, true title, and lawful and abfolute authority to grant, bargain, fell, affign, transfer and fet over, the faid recited indenture of leafe and policies of infurance, and the faid piece or parcel of ground, mefluages or tenements, and premifes, with the appurtenances, unto the faid C. S. his executors, adminiftrators, and affigns, in manner and form aforefaid. AND FURTHER that from and after default fhall be made, in payment of the faid fum of pounds, or any part thereof according to the provifoe or condition before mentioned, it fhall and may be lawful to and for the faid C. S. his executors, adminiftrators or aligns, to enter into and upon the faid piece or parcel of ground, meffuages or tenements, and premises hereby granted, bargained, fold, affigned, transferred, and fet over, or mentioned or intended fo to be, and every part and parcel thereof with the appurtenances, and the fame from thenceforth to have, hold and enjoy, and the rents, iffues and profits thereof, and of every part and parcel thereof, to his and their own proper ufe and behoof, to have, receive, and take, for and during all the reft, refidue and remainder then to come and unexpired, of the faid term of years, hereby affigned, without any let, fuit, trouble, moleftation, interruption, or difturbance of or by the faid E. G. his executors, adminiftrators, or affigns, or any of them, or any other perfon or perfons whomsoever, fubject nevertheless to the rent and covenants, in the faid recited indenture of leafe, referved and contained, on the tenant or leffee's part to be from thenceforth paid and performed; AND FURTHER ALSO, that the faid recited indenture of leafe, piece or parcel of ground, meffuages or tenements, and all and fingular other the premifes with the appurtenances hereby affigned, now are, and be, and fo from henceforth and at all times hereafter, for and during the remainder of the faid term of years, hereby granted and affigned, fhall remain, continue and be unto, and to the ufe of the faid C. S. his executors, administrators and affigns, free and clear, and freely and clearly acquitted, exonerated, and discharged, or otherwife by the faid E. G. his executors and administrators, faved, kept harmless and indemnified, of, from, and againft all former and other gifts, grants, bargains, fales, leafes, affignments, mortgages, furrenders, forfeitures, re-entries, caufe, and caufes of forfeitures, and re-entry, arrearages of rents, judgments, executions, extents, and of and from all other eftates, titles, troubles, and incumbrances whatsoever; the rent and covenants in the faid recited indenture of leafe, contained on the tenant or leffees

leffee's part and behalf to be paid, done and performed; (only excepted) AND ALSO that he the faid E. G. his executors, and adminiftrators, and all and every other perfon or perfons, having, claiming, of deriving, or which fhall or may have, claim, or derive any manner of eftate, right, title, or intereft, in or to the faid recited indenture of teafe, piece, or parcel of ground, mefluages, and premifes hereby granted and affigned, or intended fo to be, or any part thereof, fhall and will at any time or times, after default, fhall be made of or in payment of the said fum of pounds contrary to the provifoe or condition before mentioned, upon the reasonable request, cofts, and charges in the law, of the faid C. S. his executors, adminiftrators, or affigns, nake, do acknowledge, levy, and execute, or caufe or procure to be made, done, acknowledged, levied, and executed, all and every fuch further, and other lawful and reasonable act and acts, thing and things, deeds, conveyances, and affurances in the law whatfoever, for the further, better, more perfect, and abfolute affigning, afsuring, corroborating, or confirming the faid recited indenture of leafe, and piece, or parcel of ground, meffuages, or tenements and premifes hereby alligned, or mentioned, or intended fo to be, unto the faid C. S. his executors, administrators, and affigns, for and during the remainder of the faid term of years, hereby affigned, and subject to the rent and covenants aforefaid, as by the faid C. S. his executors, administrators, and affigns, or his or their council learned in the law, fhall be reasonably devifed, advised, or required. AND the faid E. G. for himself, his heirs, executors, and adminiftrators, doth further covenant, promife, and agree, to and with the faid C. S. his executors, adminiftrators, and affigns, by these presents, in manner following, (that is to fay), that fo long as all or any part of the faid principal fum of pounds, or the intereft to grow due for the fame, shall remain unpaid, he the faid E. G. his executors or adminiftrators, fhall and will, from time to time, and at all times hereafter, keep the faid premifes infured from fire, and fhal infure on the fame, the full fum of pounds, and immediately affign the faid policy or policies of infurance, and all benefit thereof, to the faid C. S. bis executors, adminiftrators, and affigns, and in cafe the faid E. G. his executors or adminiftrators,. fhall neglect to infure the fame premifes as aforefaid, it shall and may be lawful to and for the faid C. S. his executors, adminiftrators, and affigns, to make infurance in his own name, and the benefit of all fuch infurances already made, or hereafter to be made, on the faid hereby bargained, fold, and affigned premifes, or any part thereof, fhall be, and remain a fecurity, as well for the true payment of all fuch money as he the faid C. S. his executors, administrators, or affigns, fhall expend or lay out for the premium, depofit, and charges of any infurance or infurances to be made of the faid affigned premifes, or any part thereof, and the intereft of fuch insurance-money, after the rate of pounds in the hundred for a year, as of the faid principal fum of pounds, and the intereft from thenceforth to grow due for the fame. AND LASTLY, it is covenanted, concluded, and agreed upon, by and

S. his executors, administrators, or affigns, or any other perfon or perfons, claiming or to claim, by, from, or under him, them, or any of them, any thing herein contained, to the contrary thereof notwithstanding. Of a Debtor's Eftate, Goods, Monies, and Effects to Creditors.

W. of, &c. the principal creditors of the faid W. M. of the second part; and G. A. of, &c. (and others) the other creditors of the faid W. M of the third part. WHEREAS the faid W. M. now is, and doth stand justly indebted unto the feveral perfons above named his creditors, in the feveral fums of money particularly mentioned and expreffed in the schedule or inventory hereunder written, entituled, The firft Schedule, amounting in the whole to the fum of pounds, of lawful money of Great Britain; and the faid W. M. by reason of feveral great loffes and misfortunes, is rendered unable to pay and fatisfy his faid creditors, their said respective debts, but being willing and defirous to make them the best and utmott fatisfaction in his power, hath propofed to difcover, and abfo Jutely to convey, affign, and deliver up upon oath, unto the faid B. K. and B. W. all his eftate, monies, goods, debts of every kind, and all other his eftate and effects whatfoever, and wherefoever, of which the faid W. M. was any ways poffeffed, interested in, or entituled to on the laft, (his own and family's wearing apparel only excepted). IN TRUST for them, the faid B. K. and B. W. and the rest of the creditors of the faid W. M. rateably and in proportion to their respective debts. NOW THIS INDENTURE WITNESSETH, That in purfuance of the faid propofal, and for and in confideration of the fum of pounds of jawful money of Great Britain, to him the faid W. M. in hand paid, by the faid B. K. and B. W. at or before the fealing and delivery of thefe prefents, the receipt whereof is hereby acknowledged, he the faid W. M. (by and with the confent, and at the nomination of the reft of his creditors, teftified by their being parties to, and duly executing these prefents) HATH bargained, fold, affigned, transferred,
