L. his heirs and affigns, all timber and other trees of whatfoever nature or kind, now ftanding, growing or being, or which, during this demife and grant, fhall fland, grow, or be in or upon the lands and grounds hereby demifed, or in or upon any part or parcel thereof, with free liberty of ingrefs, egrefs and regress, for him the faid G. L. his heirs and affigns, and his and their fervants, labourers and workmen, with all carts, waggons, working-tools, utenfils and implements, to fell, cut down, hew, fquare, work out, cord, coal, faw, convert, load, have, take and carry away the faid timber-trees, and other trees, and all the timber, coal, wood and ftuff thereof coming, arifing or increafing; and to dig and make coal-pits, faw-pits, and places to work in, for the coaling, fawing and converting thereof, in and upon the lands and grounds hereby demifed; and for that purpose to have and take cover and quench of earth and fern in and upon the faid lands and grounds hereby demifed, at his and their free will and pleasure, for the better coaling and converting thereof, doing as little hurt or fpoil as may be, unto the corn, grain or grafs, of the faid M. T. growing on the demifed premifes from time to time, in converting the faid timber-trees and other trees; and alfo except and always referved out of this demife and grant unto the said G. L. his heirs and affigns, the royalties and games of hawking, hunting, fishing and fowling, in and upon the demifed premises, or in or upon any part or parcel thereof, with free liberty of ingrefs, egrefs and regrefs, for him the faid G. L. his heirs and affigns, and his and their fervants, to hawk, hunt, fish and fowl, there at his and their free wills and pleasures, doing no wilful hurt or spoil in the

corn or grain of the faid M. T. growing upon the demifed premises, and also, except and always referved out of this demife and grant unto the faid G. L. his heirs and affigns, all that the manor of S. with the rights, members and appurtenances thereof, and all court-leets and court-barons, and all the profits of the fame courts, and all quitrents, fines, heriots, fervices, reliefs, amerciaments, waifs, eftrays, goods and chattels of felons, wrecks of fea, deodands, and escheats whatsoever, to the faid manor belonging or appertaining, and free liberty of ingrefs, egrefs and regrefs, for him the faid G. L. his heirs and affigns, and his and their fteward, to keep court in the said capital mefluage or tenement before in these presents demifed, from time to time, during the term hereby granted, at his and their free wills and pleasures, for the faid manor of S. and free liberty of ingrefs, egrefs and regrefs, for all fervants, tenants and fuitors, at and to any courtleet or court-baron, to come, be and continue there during the continuance of fuch court-leet or court-baron, there to be held from time to time; and alfo, except and referved free liberty for him the faid G. L. his heirs and affigns, and his and their fervants and workmen, with carts and other neceffaries, to come upon the premises, to repair the fea-banks as often as need shall be, and to cut and take timber, woods and underwoods, on the premises for the doing thereof. To have and to hold all the faid manor, meffuages, lands, tenements, tithes and premifes, with the appurtenances, before in thefe prefents mentioned to be demifed, unto the said M. T. his executors, adminiftrators and affigns, from the feast of the annunciation of the blessed Mary, laft paft before the date hereof, for, during and until the full end and term of five years, from thenceforth next enfuing, fully to be compleat and ended; yielding and paying therefore yearly and every year during the term hereby granted, unto the faid G. L. his heirs and affigns, threefcore pounds of lawful money of Great Britain, at the feast of St. Michael the archangel, and the annunciation of the blessed Mary, by equal portions to be paid; provided always, that if it thall happen the faid yearly rent of threefcore pounds, or any part thereof, to be behind or unpaid in part or in all, by the space of 21 days after any feaft or day of payment on which the fame ought to be paid as aforefaid; that then, and at all times after, it shall and may be lawful to and for the faid G. L. his heirs and affigns, into all the faid demifed premifes, and every part thereof, wholly to re-enter and the fame to have again, repoffefs and enjoy as in their former eftate, any thing herein contained to the contrary notwithstanding; and the faid M. T. doth for himself, his executors, adminiftrators and affigns, covenant and grant to and with the said G. L. his heirs and affigns, by these presents, that he the faid M. T. his executors, adminiftrators and affigns, fhall and will yearly and every year during the term hereby granted, well and truly pay or caufe to be paid unto the said G. L. his heirs and affigns, the yearly rent of threefcore pounds, before in these presents referved to be paid, at the days and times before herein limited for payment thereof, without 40

fraud or delay; and alfo, that the faid M. T. his executors, adminiftrators and affigns, fhall and will from time to time during the term hereby granted, when and fo often as need fhall require, well and fufficiently repair, amend, maintain, sustain, fence, scour, cleanfe and keep all the houfes, barns, buildings, pofts, pales, rails, gates, ftiles, hedges, ditches, fences and inclosures which now are, or during this demife fhall be in or upon the faid demifed premifes; and the fame fo well and fufficiently repaired, amended, maintained, fuftained, fenced, fcoured, cleanfed, and kept, together with the poffeffion of all the faid demifed premifes, thall and will leave and yield up unto the faid G. L. his heirs and affigns, at the end of the faid term hereby granted; and alfo, that he the faid M. T. his executors, adminiftrators and affigns, fhall and will, at the end of the term hereby granted, leave twenty acres of the arable land hereby demised in a wheat-lane, fit to be fown with wheat in the next year after the end of the term hereby granted; and alfo, that if the faid M. T. his exccutors, adminiftrators or affigns, do or fhall, at any time during the term hereby granted, plough, break up, fow, or convert into tillage, the marsh, or the long meadow next the mill-pond, or the meadow through which the river runs, adjoining to the garden, parcel of the demifed premifes, or any part thereof, then the faid M. T. his executors, adminiftrators and affigns, fhall and will yearly and every year, during all the refidue of the term hereby granted as fhall be then to come and unexpired, yield and pay unto the faid G. L. his heirs and affigns, 50s. of lawful money of Great Britain, for every acre thereof, fo to be ploughed, broken up, fown or converted into tillage, for and in the name of an over-rent, or increase of rent, over and above the yearly rent before in these presents referved to be paid; and fo after that rate for any greater or lefs quantity thereof to be ploughed, broken up or converted into tillage as aforefaid; which faid over-rent or increase of rent, if any be, fhall be paid unto the faid G. L. his heirs and affigns, by equal portions, at the days limited for payment of the yearly rent first before in these prefents referved to be paid; the first payment thereof to begin and be made at fuch of the faid days as fhall next happen after fuch ploughing, breaking up, sowing or converting into tillage as a orefaid; and alfo, that the faid M. T. his executors, adminiftrators and affigns, fhall and will at their own cofts, bear, pay and difcharge all fuch duties, taxes, affefiments and payments, as fhall, during the term hereby granted, be iffuing, due or payable out of, or for the faid demifed premises, to the church, the parish, and the poor; and also, that he the faid M. T. his executors, adminiftrators and affigns, for and on behalf of the faid G. L. his heirs and affigns, fhall and will yearly during the term hereby granted, at the late dwelling-house of H. H. in aforefaid, well and truly pay or cause to be paid unto H. C. his heirs and affigns, at the feafts of the annunciation of the bleffed Mary, and St. Michael the archangel, by equal portions, 7 for the proportion of the faid G. rent of the tithes of aforefaid and alfo, that he the faid M. T. his executors, adminiftrators and affigns, fhall and will, from time to time, during the term hereby granted, imbarn and lay all the corn, grain, hay, grass, hame, fern and fodder, which during the faid term fhall arife, grow, renew or increase in or upon the demifed premifes, in the barns, and upon the lands and grounds hereby demifed, and not elsewhere, and fhall and will also expend and lay all the compoft, dung and foil thereof had, made, coming, growing, arifing, renewing or increasing, upon the lands and grounds hereby demifed, and not elsewhere nor otherwife; and fhall and will alfo, at the end of the term hereby granted, leave upon the demifed premifes, all the compoft, dung and foil there made in the last year of the faid term, to and for the use and benefit of the faid G. L. And the faid M.T. doth further for himself, his executors, adminiftrators and affign's, covenant and grant to and with the faid G. S. his heirs and affigns, by these prefents; that the faid M.T. his executors, adminiftrators or affigns, fhall not and will not at any time during the term hereby granted, lop, top or poll any trees growing on the demifed premifes, other than fuch as have been lopped, topped and polled; and that the faid M. T. his executors, adminiftrators and affigns, shall not, in any year of the term hereby granted, lop, top or poll more than the fourteenth part of the pollard trees upon the premises, nor fhall or will, in any year of the faid term, fell or cut more than the fourteenth part of the under-woods, hedges, bushes and hedge-rows there; and fhall not again lop, top, poll, fell or cut any trees, under-woods, hedges, bufhes or hedge-rows, which before during this demife shall have been lopped, topped, polled, felled or cut; and alfo, that the faid M. T. his executors, administrators and affigns, shall not at any time during the term hereby granted, lop, top, fell or poll any trees, or fell or cut down any of the coppice-woods, hedges or hedge-rows which now are, or during this demife shall be standing or growing upon the demifed premifes, at any unfeasonable times in the year, or in any unhusband-like manner; and alfo, that he the faid M. T. his executors, adminiftratos or affigns, fhall not at any time during the term hereby granted, in any wife fell or cut, upon the demifed premifes, any fellows likely to grow up to be timber-trees; and the faid G.L. doth for himself, his heirs and affigns, covenant and grant to and with the faid M. T. his executors, adminiftrators and affigns, by these prefents, that he the faid M. T. his heirs and affigns, fhall and will at their own coft, bear, pay and discharge or allow unto the faid M.T. his executors, administrators and affigns, all rents which are, or during this demife fhall be, iffuing or payable out of or for the demifed premifes, or any part thereof, to the lord or lords of the fee or fees thereof; and alfo all fuch duties, taxes, affeffments and payments, as fhall, during this demife, arife, become or grow due out of, for, or from the demifed premifes, or any part thereof, to the King's Majefty, or for the defence or publick ufe or occafion of this realm; 402
