10 ALL to whom thefe prefents fhall come, I R. C. of fend greeting: WHEREAS I am indebted unto J. F. of in the fum ofof lawful money of Great Britain, and the faid 7. F. and one F. 7. of ftand jointly and feverally engaged for me the faid R. C. in feveral bonds or obligations for feveral fums of money; NOW KNOW YE, That I the faid R. C. for and towards the payment and fatisfaction of the faid monies, and for divers other good caufes and confiderations me thereunto moving, HAVE granted, affigned, bargained, and fold, and by thefe prefents DO freely and abfolutely grant, affign, bargain, and fell, unto the faid J. F. and F. 7. all and all manner of, goods, chattels, debts, monies, and all other things, of me the faid R. NOW ALL MEN by thefe prefents, That IT. C. of merchant, for and in confideration of the fum of —, of good and lawful money of Great Britain, to me in hand by J. T. of grocer, and J. R. of ——— -, merchant, before the fealing and delivery hereof, well and truly paid, the receipt whereof I do hereby acknowledge, and myself to be therewith fully fatisfied, and thereof, and of every part and parcel thereof, do fully, clearly, and abfolutely acquit, release, and discharge the faid 7. T. and J. R. their heirs, executors, administrators, and affigns, and every of them for ever by these presents, HAVE granted, bargained, fold, affigned, and fet over, and by these presents do fully, clearly, and abfolutely grant, bargain, fell, affign, and fet over unto the faid J. T. and F. R. their executors, adminiftrators, and affigns, for ever, one full and equal eighth part of the good ship or veffel called the

Efq; for the fum of damages and cofts, in an action of trefpafs, affault, and imprisonment, as by the record thereof, now remaining in the faid court, may ap pear, on which faid judgment a writ of error was brought, return'able in the Exchequer chamber at Westminster, which is now depending and undetermined; AND WHEREAS the faid C. B. is indebted unto the faid D. J. in the fum of, for fo much money paid, laid out, or advanced by him the faid D. f. to and for the ufe and behoof of the faid C. B. paid, laid out, and advanced as aforefaid, by him the said D. 7. at or before the fealing and delivery hereof, the receipt and payment whereof be the faid C. B. doth hereby acknowledge, and of and from the fame, and every part and parcel thereof, doth hereby for ever acquit, release, and discharge the faid D. 7. his executors, adminiftrators, and affigns, HE the faid C. B. HATH bargained, fold, affigned, tranfferred, and fet over, and by thefe prefents DOTH bargain, fell, affign, transfer, and fet over unto the faid D. J. his executors, adminiftrators, and affigns, (to and for his and their own proper ufe and behoof for ever) the faid in part recited judgment, and the faid fum of thereby recovered, and all the benefit and advantage which can or may be had or obtained by reafon or means thereof, or of any action, execution, or extent thereupon, to be had, fued out, or taken, and all his the faid C. B.'s eftate, right, title, and intereft, claim, and demand whatsoever, of, in, and to the faid judgment, or any fum or fums of money, lands, tenements, or other things, which by virtue of any execution, procefs, or proceeding thereupon, to be made or fued out, fhall or may be had, gotten, obtained, or recovered; AND the faid C. B. for the confideration aforefaid, doth hereby make, ordain, authorize, conftitute, and appoint, him the faid D. J. his executors, adminiftrators, and affigns, his true and lawful attorney and attornies irrevocable for him the faid C. B. and in his name, place, and ftead, to fue and profecute any execution, action, or extent, upon the faid judgment, and to acknowledge, make, and give full fatisfaction, release, and discharge for the fame. And alfo to do and perform, all and every other lawful acts and things whatfoever, which fhall be neceffary to be done in and about the premifes, as fully and effectually as he the faid C. B. may, might, can, or could do, if perfonally prefent; AND doth hereby for himself, his executors, and adminiftrators, ratify, confirm and allow, all legal acts, matters, and things whatsoever, to be done and accomplished by the faid D. J. his executors, adminiftrators, and affigns, in and touching the premises, at his and their proper cofts and charges in the law: AND the faid C. B. for himself, his executors and administra tors, doth hereby covenant, promife, and agree, to and with the faid D. 7. bis executors, adminiftrators, and affigns, that he the faid G. B. hath not, at any time heretofore, any ways released, vacated, or discharged the faid judgment fo recovered as aforefaid, or any part thereof, and that neither he, nor his executors, or adminiftrators, fhall or will, at any time or times hereafter, unless at the request in writing, of the faid D. J. or in pursuance of fome rule or order of some court of law or equity, release, vacate, discharge, or enter fatisfaction on the record of the faid judgment, nor caufe, nor procure the fame to be released, vacated, or difcharged, or fatisfaction to be entered thereon, or revoke, annul, make void, or countermand, any power, authority, or claufe, herein before granted or contained; AND ALSO,

ALSO, that he the faid C. B. hath in himself good right, full power, and lawful and abfolute authority to bargain, fell, and affign, the faid judgment unto the faid D. J. in manner aforefaid; AND that the fame now is, and fo fhall remain, continue, and be free and clear, and freely and clearly acquitted, exonerated and difcharged, of, from, and against all and all manner of former and other bargains, fales, mortgages, and affignments thereof, and other incumbrances whatfoever, SAVE and EXCEPT one indenture of affignment or mortgage thereof, dated on or about the laft, made by him aforefaid, Gent. S. Bart. commiffary general of his faid Majefty's musters, and to his trufty and well beloved f. G. Efq; his deputy commiffary general, fignified to them by his faid Majefty's fecretary at war, G. T. Efq; that he was graciously pleafed to give leave to his trufty and well beloved the faid 7. H. Efq; to difpofe of his commiffion as guidon and major of his — troop of horse guards, commanded by his faid Majesty's right trufty and well beloved G. Lord F. towards enabling of him to purchase an higher poft in his faid Majefty's army, and reciting, that the faid 7. H. having humbly befought his faid Majefty, in regard to the dif pofing of his faid commiffion of guidon and major, which might meet with difficulties and delays, and could not be accomplished before his faid Majefty's departure for ——, that his said Majesty would be graciously pleased to grant his warrant for continuing him on the mufter rolls of his faid Majefty's troops, until he could meet with a perfon to purchase the said poft, who was fitly qualified to fucceed him therein; and in cafe that he should die before his faid commiffion could be difpofed of, that it might be then fold for the fole ufe and benefit of the faid A. B. (by the name of A. B. Gent.) and his executors, he the faid A. B. having advanced a confiderable fum of money towards the purchafe for the faid poft; which request his Majesty taking into his royal confideration, was graciously pleafed to grant, and by his faid warrant further graciously declared his will and pleasure to his faid commiffary general, and deputy of his faid mufters, fignified as aforefaid, that they fhould pass and allow the faid 7. H. Efq; on the muster rolls of his faid Majesty's troop of horse guards, as guidon and major, until he could find a perfon to purchase the fame, and that they thould mufter no other perfon whatfoever in the faid troop, in the room of the faid 7. H. Efq; in cafe of his death, without the confent of the said A. B. his faid Majefty, thereby further declaring, that it was his royal intention that the money arifing by fale of the faid commiffion fhould be fecured and paid to the faid A. B. or his executors, as in and by his faid Majefty's warrant, given at his court at St. James's, the day before the day of the date hereof, fubfcribed by his faid fecretary at war G. T. Efq; it does and may appear; NOW THIS INDENTURE WITNESSETH, and the faid 7. H. for himself, his heirs, executors, and adminiftrators, and for every of them, doth covenant, promife, and agree, to and with the faid A. B. and his executors and administrators, that he the faid 7. H. fhall not, nor will, at any time or times hereafter, fell or difpofe of his faid commiffion of guidon and major, without the privity of the faid A.
