do, by and out of the rents and profits of the fame premises, pay or caufe to be paid unto the said E. G. and her affigns, for and during the term of her natural life, the like clear yearly rent or fum of pounds, at the faid four days of payment in the year, by even and equal portions; the first payment thereof to begin and to be made at fuch of the faid feafts as fhall next happen after the decease of the faid C. A. and subject to the yearly rents or fums of — pounds and pounds, and fhall and do in the next place, by and out of the rents and profits of the fame premifes, pay or caufe to be paid unto H. H. of, &c. Efq; and his affigns, for and during the term of his natural life, the clear yearly rent or fum of - pounds of like money, at the faid four days of payment in the year, by even and equal portions; the first payment thereof to begin and to be made at the feaft day of St. Michael next enfuing the date hereof, the fame being in lieu, difcharge and fatisfaction of the like rent of pounds, payable to the faid H. H. by and out of the fame premifes, by virtue of one indenture bearing date the in the year of our Lord 17-. All which faid yearly rents, during the continuance of them refpectively, are to be and fhall be paid, free from all taxes, charges and deductions what foever, parliamentary or otherwife. And upon this further truft, that the said laft mentioned truffees, their executors, adminiftrators and affigns, fhall and do permit and fuffer the faid Sir B. A. and fuch other perfon or perfons to whom the next and immediate reversion or remainder of the faid laft mentioned premifes, expectant upon the faid term of years, fhall for the time being belong, to receive and take the refidue and overplus of the rents and profits of the faid laft mentioned premifes, over and above what will be fufficient from time to time to pay the faid yearly rents of pounds and pounds; in which faid intended fettlement fhall be contained a provifo for ceaffing and making void the faid term of years, from and after the feveral deceases of the faid C. A. his intended wife, and H. H. and payment of all arrears which shall be then due of the faid yearly rents of -pounds and pounds, if any fuch fhall be. And as to, for and concerning the other term of years, of and in the premises intended to be fo limited, it is hereby declared and agreed, that the fame is to be and shall be upon the truits following; that is to fay, that the perfons to whom fuch term fhall be limited as aforefaid, their executors, adminiftrators or affigns, fhail and do, either in the life-time of the faid Sir B, A. and Ď. A. his wife, or of the furvivor of them, if they or the furvivor of them shall think fit, and fo fignify their minds by writing under their hands and feals, or under the hand and feal of the furvivor of them, or eife as foon as conveniently may be after the decease of the furvivor of them, by leafing, felling or mortgaging the premises, to be comprised in the fame term, or a competent part thereof, or by fuch ●ther ways and means, as to the fame trustees fhall feem meet, raise and

levy, or borrow and take up at intereft, the fum of pounds, for the portions of L. M. and O. A. daughters of the faid Sir B. A. or any of them, to be paid to them at fuch time or times, and in parts and proportions, manner and form, as they the faid Sir B. A. and D. A. his wife, or the furvivor, fhall by any writing or writings under their hands and feals, or under the hand and feal of The furvivor of them, direct or appoint; and in default of such di iction and appointment, then to the faid L. M. and O. A. the daunters, to be equally divided between them, fhare and fhare alike, at their respective ages of years; and to furvive, in cafe one or more of them die before fuch age; but if all of them die before any of them attain the age of pounds

years, then the faid years for raifing the fame, to cease. And it is hereby agreed, that when and fo foon as the said sum of pounds shall be raised by the ways and means aforefaid, then alfo the faid term of years, of and in the premises to be comprised therein, or of and in fo much thereof as shall remain unfold and undifpofed of for the purpofes aforefaid, fhall ceafe and be void. And it is hereby agreed, that in fuch intended fettlement fhall be contained provifoes for impowering and enabling the faid Sir B. A. D. A. his wife, and C. A. as and when they fhall respectively 'come into and be in the feifin or poffeffion of the faid manors of and or any of them, by virtue of the limitations aforefaid, from time to time to demife, leafe or grant, all or any of the meffuages, lands and tenements, parcel of the faid manors, or any of them, which now are in grant by copy of court-roll, or in leafe for life or lives, or years determinable upon life or lives, to any perfon or perfons, for one, two or three life or lives in poffeffion or reverfion, referving the ufual and accustomed rents and fervices, or more, and with other ufual reftrictions. And alfo the like powers for the faid C. A. during his life, and after his decease for the faid E. his intended wife, during her life, to make the like leafes of the meffuages or tenements in , being now in like manner leafed out. And also a power for all parties, when in poffeffion of the premises or any part thereof, to leafe the fame for any term or number of years, not exceeding years in poffeffion, at the improved rent, and with other ufual restrictions. And in fuch fettlement fhall be lodged and vefted in trustees to be for that purpose named, the like powers of leafing for lives, or years determinable upon lives, or for years, in case the iffue male or female of the faid C. A. who fhall for the time being be entitled to the premifes or any part thereof by virtue of the limitations aforesaid, shall be under age at the time of his death, during the minority of fuch iffue male or female. And in fuch intended fettlement fhall be contained a provifo and agreement to this effect, that if the said €. A. fhall within the space of mind, mi calendar months next after the decease of the faid Sir B. A. or in cafe the said dame A. A. fhall

him furvive, fecure to the good-liking of the faid dame 4. 4. one annuity or yearly fum of pounds, during the life of the faid dame A. A. to commence from the death of the faid Sir B. A. in lieu of fuch her power of leafing, and all other her intereft in the faid manors; then and in such case fuch her powers of leafing, and other her interest in the fame manors, fhall ceafe and be void; and then and from thenceforth the faid C A. fhall have the like interest and power of leafing for his own benefit; and alfo all fuch profit and advantage as the said dame A. A. shall make by virtue of fuch her intereft and power at any time during the faid -months, from the death of the taid Sir B. 4. And also it is agreed, that in such settlement fhall be contained a liberty or power for the said Sir B. A. at any time during his life, to cut down fo much timber upon - farm aforesaid, as he fhall have occafion to ufe for building or repairs at not for fale or otherwife. And alfo it is agreed, that in fuch fettlement to be made as aforefaid, fhall be contained, a provifo or power for the faid C. A. in cafe he,fhall furvive the faid E. G. to make a jointure, to any other woman or women whom he shall hereafter hap pen to marry, or any part or parts of the premifes to be limited to the faid E. for her life as aforefaid, not exceeding in the whole, the yearly value of pounds. And the faid Sir B. A. for the confideration aforesaid, doth hereby for himself, his heirs, executors and administrators, covenant, promife and agree, to and with the faid F. F. and G. G. their executors and adminiftrators, in manner following; that is to fay, that he the faid Sir B. A. his heirs, executors or administrators, at his and their own cofts and charges, fhall and will, within the space of months next after the folemnization of the faid intended marriage, caufe and procure the life of the faid E. G. to be inferted in the feveral leafes of Hilton farm and Hilten folds, being part of the estate in aforefaid, herein before intended and agreed to be limited to her as part of her jointure; and also shall and will, from time to time during his life, renew the lease of mills, upon the death of any person or perfons on whose life or lives the fame doth or fhall depend, and leave the fame full at the time of his death. And that the faid freehold and leafehold mesfuages, farms, lands, tenements and hereditaments, herein before intended and agreed to be limited to the use of, or in truft for the faid E. G. for her jointure as aforesaid, befides the faid yearly rent or fum of pounds, made payable to her for her life as aforesaid, are now of the yearly rent or value of pounds. And the faid C. A. doth hereby covenant and agree with the faid F. F. and G. G. their executors and administrators, that he the faid C. A. thall and will, from time to time during his life, at his own cofts and charges, renew the faid leafes of Hilton farm and Hilton folds, on the death of any person or perfons, on whofe life or lives the fame doth or fhall depend, and leave the fame full at the time of his death; and alfo fhall and will at the end of every years, at his own charges, 3 A 2

renew the faid leafe of, and leave the fame renewed and filled up at the time of his death, after whofe death, in case the said E. his intended wife fhall him furvive, the fame is to be from time to time renewed by her at her own charge during her life. And it is hereby declared and agreed, that all and every new leafes hereafter to be taken of fuch parts of the premifes as are leafehold, fhall from time to time remain, continue and be to and for, and upon the several trufts herein before declared of and concerning the fame premifes refpectively. And for the better and more effectual establishing, ftrengthening and confirming of these prefents, and of the feveral ufes and eftates herein before mentioned or intended to be limited, of or concerning the freehold premifes above, by thefe prefents agreed to be fettled and conveyed as aforefaid, they the faid Sir B. A. dame A. his wife, and C. A. have agreed, and do hereby agree to levy one fine fur conuzance de droit come ceo, &c. with proclamations according to the ufual course of fines in fuch cases used, as of Trinity term laft paft before the date hereof, unto the faid F. F. and G. G. and the heirs of the faid F. F. to the use of them and their heirs, of all the faid manors, meffuages, farms, lands, tenements, hereditaments and premises (being freehold) herein before agreed to be fettled and conveyed as aforefaid. And whereas by force and virtue of one indenture quinquepartite, bearing date the day of laft paft, before the date hereof, and made or mentioned to be made between 7. 7. Efq; K. J. Efq; and L. his wife, and the faid Sir B. A. and dame A. his wife, of the first part, M. M. Efq; and N. D. Efq; of the fecond part, O. O. Efq; and P. P. gent. of the third part, D. D. Eiq; and E. E. Efq; of the fourth part, and Sir R. R. Bart. S. S. Efq; and T. T. Efq; of the fifth part, and three feveral fines therein mentioned, one moiety or half part of the manor or reputed manor of, with the rights, members and appurtenances thereof, in the faid county of and of all other the messuages, lands, tenements and hereditaments in the faid county of and in the county of — in the fame indenture mentioned, is vefted in the faid D. D. and E. E. and their heirs, upon truft, and to and for fuch ufes, eftates, trufts, intents and purposes, and to and for such person and perfons, and in fuch manner as the faid dame A. A. alone, or together with her husband, by any deed or deeds, writing or writings, to be by her figned and fealed in the prefence of three or more credible witneffes, fhould from time to time declare, direct, limit or appoint, for or concerning the fame moiety. And whereas by virtue of the fame indenture, and fines or otherwife, the fame moiety, together with the other moiety of the fame premifes, are chargeable with, and fubject to the payment of the feveral fums following, viz. — pounds to the faid 7. L. pounds to the faid damne A. A. (which hath been fince paid and difcharged) and pounds to 7. T. therein named, together with one annuity or rent-charge of — annum, to W. W. therein alfo named, during his life. And whereas by

indenture tripartite bearing date the day of last past before the date hereof, and made or mentioned to be made between the faid D. D. and E. E. and the faid dame A. A. of the first part, the aforefaid H. H. of the fecond part, and the faid Sir B. A. of the third part, reciting as therein is recited, and for the confiderations therein mentioned, the faid moiety or half-part of the said dame A. A. of and in the faid last mentioned manor, mefluages, lands, tenements and hereditaments, is granted and demifed to the faid H. H. his executors, adminiftrators and affigns, for the termn of without impeachment of wafte, under a provifo to be void upon payment to the faid H. H. his executors, adminiftrators and affigns, for the fum of pounds, and lawful intereft for the fame, at certain days therein mentioned and yet to come. NOW this indenture further witneffeth, that in confideration of the faid intended marriage and marriage-portion, they the faid Sir B. A. and dame . his wife, do hereby covenant and agree with the faid F. F. and G. G. their executors and adminiftrators, that they the faid Sir B. A. and dame A. his wife, and the faid trustees of the faid dame A. thall and will before thedate hereof, at the cofts and charges of the faid Sir B. A. by fuch good and fufficient conveyances and affurances in the law, as the counsel of the faid F. F. and G. G. or the furvivor of them, or the executors or adminiftrators of fuch furvivor fhall advife or direct, fettle, convey and affure the faid laft mentioned moiety of the faid manor, messuages, lands, tenemenis and hereditaments in the faid counties of and - -, fubject to the faid mortgage for

A, for and during the term of his natural life, without impeachment of wafte; and from and after his decease, then to the use of the faid dame A. A. his wife, for and during the term of her natural life, without impeachment of wafte; and from and after her decease, then to the use of the faid C. A. for and during the term of his natural life without impeachment of wafte; with provifion in fuch fettlement to be contained for fupporting the contingent ufes and eftates herein after limited as in fuch cafe is ufual; and from and after his decease, then to the use of the first fon of the faid C. A. on the body of the faid E. his intended wife to be begotten, and of the heirs male of the body of fuch first fon lawfully iffuing; and for default of fuch iffue, then to the use of the fecond, third, fourth and fifth, and of all and every other the fon and fons of the faid C. A. on the body of the faid E. his intended wife to be begotten, feverally, fucceffively and in remainder one after another, as they and every of them fhall be in feniority of age, and priority of birth, and of the feveral and refpective heirs male, of the body and bodies of all and every fuch fon and
