lighters, crafts, tackle, apparel, implements, and all other things belonging to the faid copartnership, to be appraised or fold by one or more proper perfon or perfons, and the produce thereof to be divided and diftributed in the manner following, (that is to fay) one moiety or equal one half part to the faid furviving copartner, and the other moiety to such perfon or perfons as the pounds, as the cafe may happen, is herein before appointed to be paid; AND it is hereby further covenanted and agreed, by and between the faid parties, that the faid copartnership is to continue from the faid day of next enfuing, for, and during, and unto the full end and term of years, in cafe both the faid parties fhall fo long live, and unless either of them fhall be minded or defirous to diffolve the fame at the end of the fift seven years, part of the said years, which is agreed upon between the faid parties may be done, the party fo defiring the fame giving fix months notice under his hand to the other of fuch his intention. AND LASTLY, it is hereby mutually agreed, by and between the faid parties to these prefents, that in cafe any difference or difpute hall happen to arife between the faid parties during the full term, or continuance of this intended copartnership, or in case of the death of one of them, between the furviving copartner and the executors or adminiftrators of the deceased, that the fame fhall be entirely and finally fettled and adjusted by two arbitrators indifferently to be chofen, and by oath of the parties, their executors or adminiftrators, and in cafe the faid two arbitrators fhall not agree, they the faid two arbitrators are to name a third perfon or umpire, the faid parties refpectively promifing hereby, to ftand to, abide by, hold for good, firm, and valid, and truly and faithfully perform and comply with the determination or award of fuch arbitrators or umpire, and that such arbitration or umpirage for greater validity thereof, fhall be made a rule of his Majelly's Court of King's Bench; AND for the true performance of all and every the covenants, payments, articles, promifes, and agreements, herein contained, on the part and behalf of the faid parties, their executors or adminiftrators, to be done and performed, each of them doth bind and oblige himself, his executors, and administrators, to the other of them, in the penal fum of pounds of lawful money of Great Britain, firmly by these prefents. ARTICLES OF AGREEMENT, indented &c. between the honourable A. B. Efq; Colonel of his Majefty's Regiment of ——————, of the one part; and C. D. of the parish &c. of the other part.

HEREAS the faid A. B. by a certain writing under

pointed the faid C. D. to be his agent to the faid Regiment, for which

B. the fum of pounds Sterling, the receipt whereof is hereby acknowledged, upon fuch conditions and agreements nevertheless as are hereafter mentioned and agreed upon. NOW THESE PRESENTS WITNESS, that it is mutually covenanted, declared and agreed, by and between the faid parties to these prefents, and the faid A. B. for himself, his heirs, executors, and adminiftrators, DOTH covenant, promise, and agree, to and with the faid C. D. his executors, administrators, and affigns, by thefe prefents in manner following, (that is to fay) that if the faid A. B. and C. D. or either of them, fhail happen to die before the end of years, to be computed from the day of the date of these presents; or if the faid Regiment fhall before that time be broke or reduced, or be put on the Irish establishment, or be difpofed of to any other perfon, that then, and in either, or any of the faid cafes fo happening within the faid term, and not otherwife, the said A. B. or his heirs, executors, or adminiftrators, fhall and will immediately after any fuch cafe fo happening, return and repay, or caufe to be returned and repaid unto the faid C. D. his executors, adminiftrators, or affigns, fo much of the said sum of —— pounds, (after a deduction of profits made thereout of the yearly fum of pounds, and in proportion thereto for lefs than a year for the fame time) as fhall then remain behind and unfatisfied; AND the faid C. D. for himfelf, his executors and adminiftrators, doth covenant and agree, to and with the faid A. B. his executors and adminiftrators, by these prefents, that he the faid C. D. his executors and adminiftrators, fhall and will accept of fo much, or fuch part of the faid fum of pounds, (after the deduction of the yearly fum beforementioned, and in proportion thereto for lefs than a year made thereout as aforefaid) as fhall happen to become returnable to him or them in any fuch cafe fo happening within the faid term as aforefaid, in full performance and fatisfaction of all money to be returned purfuant to this agreement; AND it is agreed by and between the faid parties, that if the said A. B. fhall at any time hereafter be appointed Colonel of any other regiment of -upon the British establishment in lieu of his prefent regiment, that then the faid C. D. fhall continue Agent thereto, and shall have and enjoy the fame place in like manner as is herein mentioned and agreed upon for this prefent regiment, any thing herein contained to the contrary thereof notwithstanding; AND IT IS FURTHER agreed between the parties, that the faid C. D. fhall have, take, and enjoy, to his own ufe, ALL the pay, poundage, perquifites, and profits, belonging to the faid place of Agent, according to the custom and ufage of the army now practised; PROVIDED ALWAYS, and thefe prefents are upon this conditition, and it is declared and agreed, by and between the faid parties hereunto, that if the faid A. B. fhall at any time, before the end of the faid term of years, or afterwards, be minded to remove the faid C. D. from the faid place of Agent to his faid Regiment, or any other regiment of upon the British eftablishment, which may come to be under his command, and do and fhall well and truly

pay, or caufe to be paid unto the faid C. D. the full fum of pounds Sterling for that purpofe, that then, and from thenceforth upon fuch payment, thefe prefent articles of agreement, and every covenant, claufe, and thing herein contained, fhall ceafe, determine, and be utterly void and of none effect, to all intents and purposes whatfoever, any thing herein contained to the contrary thereof in any wife notwithstanding. Of a Game-keeper.

TO ALL TO WHOM thefe prefents fhall come, I H. C. of, in the county of Efq; Lord of the manor of with its refpective rights, royalties, members, and appurtenances, in the county of, have made, nominated, conftituted, and appointed, and hereby do make, nominate, conftitute, and appoint W. B. of &c. in the county of, yeoman, my lawful game-keeper of and for my faid manor or lordship aforefaid, to look after, take care of, and preferve the game there. AND I the faid H. C. do hereby allow him in my name, to hunt, hawk, fish, and fowl, within my faid manor, and the demefnes thereof, and all other places thereto belonging, from time to time during my free will and pleasure, according to the feveral acts of parliament in that cafe made and provided. ALL TO WHOM thefe prefents fhall come, I f. A. of c. fend greeting. WHEREAS W. W. Efq; Lord of the main the county of, is an infant, under the age of twenty-one years, and I am appointed by virtue of an order of the High Court of Chancery, receiver of the rents and profits of the faid manor of, and of all other the farms, lands, tenements, and hereditaments of the faid W. W. the infant, and for better prefervation of the game from time to time, upon and within the faid manor, and for other the purposes hereafter mentioned, I the laid 7. A. DO hereby (pursuant to the faid feveral statutes made for the better prefervation of game) fo far as by law I can or may, immediately employ and appoint W. D. of &c. to take and kill after the day of the date hereof, fuch hares, pheasants, partridges, and other game which he fhall find upon the manor or lordship aforefaid, for the fole use and immediate benefit of the faid W. W. And I do hereby direct the faid W. D. to fend all fuch game as he fhall take and kill by virtue of these presents to the faid W. . or as he fhall appoint. And I do by these presents, fo far as I may by law, further authorife and appoint the faid W. D. (by virtue of the feveral acts of parliament in that cafe made and provided) to take and feize all fuch guns and ferrets, trammels, hays, and other nets, fnares, and engines, for the taking, killing, or deftroying of hares, pheasants, partridges, or other game, within the aforefaid manor or lordship, and the precincts thereof, as fhall be kept or used by any perfon or perfons not legally qualified to do the fame; and further, to act and do all and every acts and things which belong to the faid office of a game-keeper of a manor or lordfhip, according to the directions of the faid ftatutes, TO HOLD the fame during my will and pleasure.
