A Demife by Way of collateral Security. The Vendor of Lands which were liable to certain Rent-Charges (orfo fuppofed to be,) to indemnify the Parchafer, bargains and demifes other Lands to a Trustee for the Purchafer for a long Term of Years.

C. of, &c. gent. of the fecond part, and D. D. of, &c. Efq; of the third part. WHEREAS the faid C. C. hath bought and purchased in the names of himself and E. E. gent. his fon and heir apparent, of and from the faid A. A. for the price or fum of- -pounds, of lawful money of Great Britain, the manor or manors of -and with their rights, royalties, members, and appurtenances, in the faid county of and the fcite of the late monaftery, or house and the park, at aforefaid; and the demefne lands of the faid manor or manors, and the rectory of the parish church of -, and the advowfon of the vicarage of the fame church; and the glebe lands, tenths, tithes, and hereditaments, to the fame rectory belonging or appertaining; and divers other meffuages, lands, tenements, and hereditaments, with their appurtenances, in or fome of them, in the faid county of and the fame are by indentures of leafe and release, and bargain and fale, intended to be inrolled in the High Court of Chancery, the leafe bearing date the day next before the day of the date of the releafe, and the releafe and bargain and fale bearing date the day next before the day of the date hereof, and made, or mentioned to be made, between the faid A. A. of the one part, and the faid C. C. and E. C. of the other part, in confideration of the faid fum of pounds, in the faid indenture of release and bargain and file mentioned to be paid by the faid C. C. to the faid A. A. granted and conveyed unto and to the ufe of the faid C. C. and E. E. and the heirs and affigns of the faid C. C. in truft for the faid C. C. his heirs, and aligns. AND whereas the faid manor or manors, lands, hereditaments, and other the premiffes fo purchased by the faid C. C. as aforefaid, or fome part thereof, are by indenture bearing date the -, day of which was in the year of our Lord and made, or mentioned to be made, between the faid B. A. of the one part, and Sir I. I, of, &c. Bart. L. L. of, &c. Efq; M. M. of, &c. batchelor in divinity; N. N. of, &c. gent. and O. O. of, &c. gent. of the other part; charged, or supposed to be charged, together with the manor, caftle,

meffuages, lands, tenements, and hereditaments, herein after mentioned to be hereby granted and demised, with the payment of several annuities, or yearly fums of money, amounting in the whole to the yearly fum of pounds, for the purpofes in the fame indenture mentioned, and alfo with the payment of a further annuity or yearly fum of pounds, upon a certain contingency therein mentioned, together with divers powers of entry and diftrefs, and other remedies for recovering of the fame annuities or yearly fums, in fuch manner as in the faid last mentioned indentures are for that purpose provided and given. AND whereas the faid A. A. did undertake and agree with the faid C. C. previous to the faid recited purchafe, to free, defend, fave harmlefs, and keep indemnified, him the faid C. C. his heirs and affigns; and the faid manors, lands, hereditaments, and other premifles fo by him purchafed as aforefaid, of, from, and against all and every the faid annuities or yearly fums of money in the faid laft recited indenture mentioned, and of, from, and against all and every the powers, remedies, or authorities, by the fame indenture provided or given for recovery of the fame annuities and yearly fums, and every or any them; and alfo, of, from and against all lofs, cofts, charges, damages, and expences, which he the faid C. C. his heirs and affigus, or any of them, fhould or might at any time hereafter fuftain, expend, or be put unto, for or by reafon, or on account of the fame annuities or yearly fums, or any of them, or of the levying or raifing the fame, or any of them, or any artears thereof, in or upon the faid purchafed premiffes, or any part thereof, by virtue of or under the faid laft mentioned indenture, or otherwife howfoever. NOW this indenture witneffeth, That in pursuance of the faid recited agreement, and in confideration of the faid recited purchase, and for the intent and purpofe aforefaid, and for and in confideration of the fum of fhillings, of lawful money of Great Britain, to the faid A. A. in hand, paid by the faid D. D. at or before the enfealing and delivery of these prefents, the receipt whereof is hereby acknowledged, he the faid A. A. at the nomination and appointment of the faid C. C. (teftified by his being a party to, and his fealin, and delivery of these presents) hath granted, bargained, fold, and demifed, and by thefe prefents doth grant, bargain, fell, and demife, unto the faid D. D. his executors, adminiftrators, and affigns, ALL that the manor of -, with the rights, royalties, members, and appurtenances thereof, in the county of and all that the castle of -, with the appurtenan ces, in the faid county, and all other the meffuages, cottages, farms, lands, tenements and hereditaments whatfoever, late of the faid B. R. and now of him the faid A. A. or whereof or wherein he, or any perfon or perfons in truft for him, is or are feized of any eftate of freehold or inheritance, in poffeffion, reverfion, remainder or expectancy, fituate, lying or being within the faid county of with their and every of their rights, members, and appurtenances,

and the reverfion and reverfions, remainder, and remainders, rents, iffues, and profits thereof, and of every part and parcel thereof; To have and to hold the faid manor, caftle, meffuages, cottages, farms, lands, tenements, hereditaments, and all and fingular other the premiffes hereby, or mentioned or intended to be hereby granted and demised, with their and every of their appurtenances, unto the faid D. D. his executors, adminiftrators and affigns, from the day next before the day of the date hereof, for and during the full time and term, and unto the full end and term of years

from thence next enfuing, and fully to be compleat and ended; upon fuch trufts, nevertheless, and to and for fuch intents and purposes as are herein mentioned, expreffed and declared, of and concerning the fame ; that is to fay, upon truf, that he the faid D. D. bis executors, adminiftrators and affigns, fhall and do permit and suffer the faid A. A. his heirs and affigns, to receive and take the rents, iffues and profits of the faid manor, caftle, meffuages, cottages, farms, lands, tenements, hereditaments and premifles, hereby, or mentioned or intended to be hereby granted and demifed, and of every of them, and of every part and parcel thereof, to and for his and their own use and benefi', until all or any of the faid annuities or yearly fums fo charged, or fuppofed to be charged, upon the faid manors, lands and premiffes in the faid county of

purchased by the faid C. C. as aforefaid, fhall be actually raised and levied thereupon, or upon fome part thereof, or until he the faid C. C. his heirs or affigns, or the faid manors, lands, hereditaments and premiffes by him purchased as aforefaid, or any part thereof, fhall be fome way impeached or prejudiced, by reafon or on account of the fame annuities or yearly fums or fome of them, or by reason or on account of any entry, diftress or other remedy to be taken for recovery of the fame, or any of them, or any part of them, or any of them, by force or virtue of the faid recited indenture of the

C. his heirs or affigns, fhall be fued, molefted, or otherwife damnified, for or on account of the fame annuities or yearly fums, or fome of them, or fome part thereof; and upon this further trust, that from time to time, and fo often as the faid annuities or yearly fums, or any of them, or any part of them, or any of them, fhall be actually raised or levied upon the faid manors, lands, hereditaments and premiffes in the faid county of , fo purchased by the faid C. C. as aforefaid, or upon fome part thereof, or as he the faid C. C. his heirs, or affigns, or the faid purchased premiffes, or any part thereof, fhall be any way impeached or prejudiced, by reafon or on account of the fame annuities or yearly fums, or any of them, or of any entry, diftrefs, or other remedy to be taken for recovery of the fame or any of them, by force or virtue of the faid laftmentioned indenture, or otherwife, or as he the faid C. C. his heirs or affigns, fhall be fued or molcfted, or otherwife damnified, for or on account of the fame annuities or yearly fums, or any of them,

then and fo often he the said D. D. his executors, administrators affigns, fhall and do by and out of the rents, iflues and profits of the faid manor, caftle, lands, hereditaments and premiffes, comprised in the faid term of years, or by demife, fale or mortgage of the fame premiffes, or any part thereof, for all or any part of the faid term of years therein, raise, levy and pay fo much monies as fhall be fufficient from time to time to anfwer and fatisfy to the faid C. C. his heirs and affigns, all fuch fum and fums of money, as fhall at any time or times hereafter be raised or levied upon the faid manors, lands, hereditaments, and other the premiffes by him purchased as aforefaid, or upon any part thereof, for or towards the faid annuities or yearly fums, or any of them, by force or virtue of the faid recited indenture, or otherwise how soever, together with all fuch lofs, cofts, charges, damages, and expences, as he the faid C. C. his heirs or affigns, or any of them, fhall in any wife fuftain, expend, or be put unto, for or by reason or on account of the fame annuities, or yearly fums, or any of them, or for or by reason of any entry, diftrefs, or other remedy or moleftation, at any time hereafter to be taken or given for the recovery of the fame or any of them, by force or virtue of the said recited indenture, or otherwife howfoever, and alfo fuch cofts, charges, and expences, as fhall at any time hereafter attend the execution of the aforefaid trufts. AND the faid A. A. doth hereby for himfelf, his heirs, executors, and adminiftrators, covenant, promife, grant, and agree, to and with the faid D. D. his executors, administrators, and affigns, in manner following; that is to fay, That the faid manor, castle, meffuages, lands, hereditaments, and premises, mentioned or intended to be hereby granted and demifed, fhall or lawfully may,. from time to time, and at all times hereafter, during the faid term of years, remain, continue and be, unto the faid D. D. his executors, adminiftrators and affigns, upon the trufts and for the purposes aforefaid, and fhall and may be accordingly peaceably and quietly had, held and enjoyed, without the lawful let, fuit, moleftation, eviction, or interruption, of or by the faid A. A. his heirs or affigns, or of or by any other perfon or perfons whomfoever. AND morcover, that he the faid A. A. and his heirs, and all others claiming or to claim, any eftate, right, title, truft or interest, of, in, to or out of the premiffes hereby, or mentioned or intended to be hereby demifed, or any of them, or any part thereof, from, by or under, or in trust for him, them, or any of them, fhall and will, from time to time, and at all times hereafter, during the space of years next enfuing the date hereof, make, do and execute, or caufe to be made, done and executed, any further or other lawful and reasonable acts, deeds or things, conveyances or affurances in the law whatsoever, for the better, more perfect, and abfolute conveying and affuring the fame premiffes, with their appurtenances, unto the faid D. D. his executors, adminiftrators and affigns, for all the then refidue of the faid term of years therein, upon the trufts and

and for the purposes aforefaid, as by the faid C. C. his heirs or affigns, or his or their counfel learned in the law, fhall be reasonably advifed or devifed, and required, fo as fuch further affurances contain in them no further or other covenants in extent, than are in these prefents contained, and fo as the party or parties who fhall be requested to make fuch further affurances, be not compelled, or compellable, for making or doing thereof, to go or travel above

miles from his or their then refpective dwellings, or places of abode. AND laftly, it is hereby declared and agreed, by and between all the faid parties to thefe prefents, That in cafe the faid A. A. his heirs, executors, or adminiftrators, fhall at any time hereafter, at his or their own proper cofts and charges, procure and obtain an act of parliament, or any claufe in an act of parliament, for the total exemption, and abfolute freeing and difcharging of the faid manor, meffuages, lands, tenements, and hereditaments, bought and purchafed by the faid C. C. as aforefaid, of, from, and againft, all and every the aforefaid annuities, or yearly fums, in and by the faid recited indenture of the granted, or mentioned to be granted, whether in present or in contingency, and of and from all diftreffes, entries, and other remedies for the fame, and every or any of them; then and at all times from thenceforth, thefe prefents, and the term and eftate hereby granted, and every clause and sentence herein contained, fhall ceafe, determine, and be utterly void to all intents and purposes, any thing herein contained to the contrary thereof notwithstanding.
