fituated near Dotton aforesaid, and defired to be admitted tenant to ALL and fingular the cuftomary meffuages, lands, tenements, and hereditaments mentioned and contained in the fame furrender, and their and every of their appurtenances, to whom the lord of the manor, by his own proper hands, in the prefence of N. N. the lord's fteward for this turn, did then and there grant feifin thereof by the rod, To have and to hold the fame meffuages, lands, tenements and hereditaments, with their and of every of their appurtenances, unto the faid C. C. fhall in and by her last will and teftament in writing, limit, declare, or appoint.

EMORANDUM, That on the

A. A. of B- in the faid county of Cambridge, Efq; one of the cuftomary tenants of the faid manor, did in his own proper perfon furrender into the hands of the lord of the faid manor, by the proper bands and acceptance of D. D. fen. Efq; lord of the aforefaid manor, ALL, &c. to the ufe of E. E. of F in the parish of Gin the faid county of Cambridge, Efq; his heirs and affigns for ever, according to the custom of the faid manor, fubject to the provifoe or condition herein after contained for making void this furrender; that is to fay, Provided always, and on condition nevertheless, that in cafe the marriage intended to be fhortly had and folemnized between the faid E. E. and K. A. daughter of the faid D. A. fhall not take effect; or in cafe the fame fhall take effect, then if the heirs, executors, or adminiftrators of the faid A. A. fhall and do within three months next after his deceafe well and truly pay, or caufe to be paid unto the faid E. E. his executors, adminiftrators or affigns, the fum of of lawful money of Great Britain, being the refidue of the the marriage portion of the faid K. A. and being alfo mentioned in a certain indenture quadrupartite of releafe and fettlement, bearing even date with thefe prefents, and made or mentioned to be made between the faid E. E. of the first part, the faid D. A. and K. A. of the fecond part, and the faid A. A. of the third part, and 7. A. Efq; and D. A. jun. Efq; fon and heir apparent of the faid D. A. fen. Efq; of the fourth part, and therein covenanted and agreed to be paid in fuch manner, and at fuch time as is herein before mentioned, then and in either of the fame cafes this prefent furrender fhall ceafe and be void, or otherwife shall be and remain in full force and effect.

year of the reign of our fovereign Lord George the Third, by the grace of God of Great Britain, France and Ireland, King, Defender of the Faith, &c. and in the year of our Lord between A. A. of B in the county of Chefter, Efq; of the one part, and D. D. of E- in the county of Flint, Efq; G. G. of H in the county of Kent, Efq; and L. L. of the parish of M in the county of Norfolk, Efq; of the other part. WHEREAS the faid A. A. is lawfully feised to him and his heirs in fee-fimple of the manor of 0 in the county of Pembroke, and the faid D. D. G. G. and L. L. are, and ftand fejfed to them and their heirs according to the cultom of the faid manor, of and in, &c. the feveral parcels of land, ground, and hereditaments herein after granted, bargained and fold, or mentioned fo to be (being copyhold lands, lying and being within and parcel of the faid manor) as by the court-rolls of the faid manor

it does appear. AND whereas the faid A. A. for the confiderations herein after expreffed, hath agreed with the faid D. D. G. G. and L. L. that the faid feveral herein after granted, bargained and fold, parcels of lands, ground and hereditaments, fhall be enfranchifed, and from henceforth for ever hereafter stand and be freed, and discharged of and from all and all manner of fines, heriots, rents, fuits, fervices and cuftoms whatfoever, and be and continue as freehold lands. NOW this indenture witneffeth, That in purfuance and performance of the aforefaid agreement, and for the purpose, and to the intent aforefaid, and alfo for and in confideration of the fum of of lawful money of Great Britain to him the faid A. A. at or before the fealing and delivery of thefe prefents in hand well and truly paid by the faid D. D. G. G. and L. L. their heirs, executors, adminiftrators and affigns, and every of them for ever by these prefents, he the said A. A. bath granted, bargained, fold, and confirmed; and by these prefents doth grant, bargain, fell and confirm unto the faid D. D. G. G. and L. L. their heirs and affigns, ALL those feveral parcels of land and ground lying and being in the faid parish of O and herein after particularly defcribed, butted and bounded, and containing together in the whole by eftimation thirty acres, be the fame more or less; that is to fay, ALL those two several parcels of land or ground lying and being in an inclofure commonly called Queen Field, each of which faid parcels of land or ground doth abut upon an inclosure now or late, or fome time fince of R. R. widow, on the northweft part, and upon half an acre of land or ground late of S. S. widow, and S. S. fpinfter her daughter, and T. T. or fome or one of them, on the fouth-eaft part; and the other of the faid two parcels of land or ground doth abut upon an acre of freehold land lately belonging to V. V. on the north-weft part; and upon an acre of land or ground lately belonging to W. W. widow, on the fouth east part. AND alfo, all that the faid parcel of land or ground lately belonging to the faid S. S. widow, S. S. fpinfter, and T. T. or fome or one of them, alfo lying and being in Queen Field aforefaid, and containing about one acre more or lefs, and abutting upon the north weft part upon the first of the said two firft herein before mentioned parcels of Jand or ground; and on the fouth east part upon an acre of land now or late, or fome time fince belonging to the faid R. R. lying in Queen Field aforefaid, or howfoever otherwife the faid lands, grounds, hereditaments and premiffes, or any of them, are, or have been called, known, diftinguifhed, or how foever otherwife the fame or any of them abutted or bounded; and alfo all plantations and trees of what kind or nature foever, hedges, ditches, ways, paffages, waters, water-courfes, commons, profits, commodities, emoluments, liberties, privileges, advantages and hereditaments whatsoever to the faid lands, grounds, hereditaments and premiffes, or any of them belonging, or in any wife appertaining, or with them or any of them used, occupied, poffeffed or enjoyed, and the reverfion and reversions, remainder and remainders, rents, iffues and profits of all and fingular the faid hereby granted lands, grounds, hereditaments and premiffes,

and of every of them, and of every part thereof, and all the eftate, right, title, intereft, ufe, truft, poffeffion, freehold inheritance, property, claim and demand whatfoever, both in law and equity, of him the faid A. A. in, unto, or out of the fame lands, grounds, hereditaments and premiffes, or any of them, or any part thereof, To have and to hold the fame lands, grounds, hereditaments, and all and fingular other the premifles hereby granted, bargained and fold, or meant, mentioned or intended fo to be, with their and every of their appurtenances, unto the faid D. D. G. G. and L. L. their heirs and affigns, to the only use and behoof of them the faid D. D. G. G. and L. L. and of their heirs and affigns for ever, freely, clearly and abfolutely enfranchifed, acquitted and difcharged by thefe prefents, from henceforth for ever hereafter, of and from all and all manner of yearly and other payments, rents, quit-rents, chief-rents, cuftomary or copyhold-rents, fines, heriots, fealty, fuit of court, and all other ufual or customary or copyhold payments, duties, fervices or customs whatsoever, which by or according to the custom of the faid manor of O the faid parcels of land, ground, hereditaments and premiffes hereby granted, bargained and fold, or any of them, is or are, or have or hath been, or ought otherwife to be fubject or liable to, or charged with, or which otherwife ought to be paid, done or performed, for or in refpect of the fame parcels of land, ground, hereditaments and premiffes, or any of them, or any part thereof, as copyhold, holden of or as parcel of the faid manor. Provided always, and it is the true intent and meaning of these prefents, and of the parties hereunto, that these prefents, or any claufe, matter or thing herein contained, fhall not extend, or be deemed, taken or conftrued to extend, to enfranchise or make free the remaining or any other parts of the feveral copyhold lands or tenements (not herein before granted) and now or late of them the faid D. D. G. G. and L. L. or any of them, or to acquit or difcharge the faid remaining or other parts from any payments, duties, cuftoms or fervices, which by or according to the cuftom of the aforefaid manor, the faid refpective copyhold lands or tenements, or any of them, have at any time heretofore been fubject or liable to, or charged with, or which have been or ought to have been paid, done or performed, for or in respect of the faid refpective lands or tenements, as copyhold and parcel of the faid manor; neither fhall the yearly quit-rents whereby the faid lands or tenements are feverally holden, be apportioned, divided, leffened or extinguifhed by reafon of thete prefents, or of the grant and enfranchifement hereby made, but the fame fhall be paid, done and performed only out of and for and in refpect of the faid remaining parts of the faid copyhold lands or tenements not hereby granted, and no part thereof out of or for or in refpect of the faid hereby granted lands, grounds, hereditaments and premiffes, or any part thereof, AND the faid A. A. for himself, his heirs, executors and adminiftrators, doth covenant, grant and agree to and with the faid D. D. G. G. and L. L. their heirs and affigns, by thefe prefents, in manner following (that is to fay) that he the faid

A. at the inftant of the fealing and delivery of thefe prefents is, and stands rightfully, lawfully and folely feifed to his own ufe, of a good, abfolute, indefeafible and perfect eftate of inheritance in fee-fimple of and in the manor of O aforefaid, without any condition, provifoe, or any ufe or ufes, remainder or remainders, truft or trufts, or other reftraint, matter or thing whatsoever, to alter, change, charge, fruftrate, determine, make void, or incumber the fame, in law or equity. AND alfo, that he the faid A. A. now hath in himself good right, full power, and lawful and abfolute authority, to grant, bargain, fell and enfranchise all and fingular the aforefaid feveral parcels of land, ground, hereditaments and premiffes hereby, or mentioned to be hereby granted, bargained and fold, with their appurtenances, unto them the faid D. D. G. G. and L. L. their heirs and affigns, to the ufe of them, their heirs and affigns for ever, according to the purport and intent of thefe prefents. AND further, that they the faid D. D. G. G. and L. L. their heirs and affigns, fhall and may now, and at all times for ever hereafter, lawfully, peaceably and quietly enter into, have, hold, use, occupy, poffets and enjoy all and fingular the lands, grounds, hereditaments and premiffes hereby, or mentioned to be hereby granted, bargained, fold and enfranchifed, with their appurtenances, and receive and take the rents and profits thereof, and of every part thereof, to and for their own ufe and benefit, without the lawful let, fuit, trouble, denial, eviction or interruption of or by the faid A. A. his heirs or affigns, or any of his anceftors, and that free and clear, and freely, clearly, and abfolutely acquitted, exonerated and difcharged, of, from and against all and all manner of former and other gifts, grants, bargains, fales, alienations, eftates, intails, ufes, wills, legacies, ftatutes, recognizances, judgments, extents, outlawries, executions, rents, annuities, jointures, dowers, and right and title of dower, fines, feizures, trufts, amerciaments, iffues, debts, and all other eftates, interefts, titles, demands, charges and incumbrances whatfoever, had, made, done, committed, omitted, procured, fuffered, given or executed, or to be had, made, done, committed, omitted, procured, fuffered, given or executed, by or against the said A. A. his heirs or afligns, or any of his ancestors, or any other perfon or perfons lawfully claiming or to claim, by, from or under him or them, or any of them; and alfo of, from and against all and all manner of yearly and other payments, rents, quit-rents, chief-rents, cuftomary or copyhold-rents, fines, heriots, fealty, fuit of court, and other cuftomary or copyhold duties, fervices or cuftoms whatfoever, which by or according to the cuftom of the manor aforefaid, the faid hereby bargained and fold premises, or any of them, have or hath been, or ought otherwife to have been fubject or liable to, or charged with, or which otherwife ought to have been paid, done or performed, for or in refpect of the fame premiffes, or any part thereof, as copyhold holden of, and as parcel of the faid manor.
