alfo fign his name to a written acknowledgement thereof; and on the third omiffion or neglect, this agreement, or fo much, and fuch part thereof as fhall then remain unperformed, which on the part and behalf of the faid churchwardens and overfeers of the poor, or their fucceffors for the time being, fhould, and otherwife ought to be done and performed, fhall cease and become utterly void; and the faid term of one year fhall be efteemed as completely ended, as if the fame had naturally run out by the effluxion of time, if the committee fhall fo determine; AND it is hereby mutually agreed by the parties to these prefents, that if any difference or difpute fhall arife on account of any claufe, condition, or article, in these prefents contained, or the conftruction thereof, the fame fhall be referred to, and determined by two indifferent perfons, of whom each party to these prefents fhall elect one, within five days next after such difference or difpute fhall arife; and in cafe fuch two perfons cannot agree and determine the matter to them referred, within fix days after fuch reference, then the fame fhall be referred to, and be determined by, fuch one indifferent perfon as the faid two first referrees fhall for that purpofe appoint, who fhall make his final award within fix days after the expiration of the aforefaid fix days; and whatsoever order or determination the faid two referrees, or their faid umpire, fo to be elected as aforefaid, fhall, within the times in that behalf before-mentioned, make between the faid churchwardens and overfeers, or their fucceffors for the time being, and the faid D. F. his executors, adminiftrators, or affigns refpectively, touching or concerning any claufe, condition, or article, in thefe prefents contained, or the conftruction thereof, the fame fhall be final, and each and every of the faid parties fhall ftand to, abide, perform, and keep the fame, without any further fuit whatsoever; AND it is also mutually covenanted and agreed, by and between the parties to these prefents, that this prefent agreement, and the term of one year therein mentioned, fhall not ceafe and determine, or be conftrued to expire at the end of the faid one year, unless one of the parties thereto fhall give notice in writing unto the other one month before the expiration of the faid one year; AND for the true performance of all and finguJar the claufes, conditions, articles, and agreements herein-mentioned, the faid churchwardens and overfeers of the poor, do bind themfelves, and their fucceffors for the time being, and the faid D. F. doth bind himself, his executors, adminiftrators, and affigns, mutually to cach other, in the penal sum of five hundred pounds, lawful money of Great Britain, firmly by thefe prefents. ARTICLES OF AGREEMENT, indented, made, concluded, and agreed upon, the day of &c. between J. L. A. P. 7. S. R. H. W. C. T. G. W. A. T. F. J. B. R. P. and H. N. tenants of feveral mefluages, lands and tenements, in the parish of —————————, in the county of ——, late of F. H. Efq; deceased of the one part, and D. H. widow, and relict of the faid F. H. J. D. of &c. and T. B. of &c. of the other part.

HEREAS R. H. and F. his wife, the only daughter, and heir of the said F. H. did at the affizes held for the County of on or about the last past, upon a full and folemn trial by a special jury, of the moft confiderable gentlemen of the faid county, obtain a verdict against W. B. and several of the faid tenants, for the poffeffion of the faid meffuages, lands and tenements, or the greateft part of them, in an ejectment brought in his Majefty's Court of King's Bench, at Westminster, of the demife of the faid R. H. and F. his wife; on which faid verdict judgment has fince been duly entered, and poffeffion of the faid premifes duly delivered to the faid R. H. by the fheriff of the faid county of. and the right, title, and intereft of the faid R. H. and F. his wife, and of the faid D. H. dower, in and to the faid premifes were acknowledged by the faid tenants, and they became tenants of the faid premises to the faid R. H. and F. his wife, and the faid D. H. AND WHEREAS the faid R. H. by his indenture, or deed of bargain and and sale, under his hand and feal, well and duly executed in the month of laft paft, which is inrolled in the High Court of Chancery, for the confideration therein mentioned, did grant, bargain and fell all and every the faid meuages, lands, and premises, (whereof the late Vice Admiral Francis H. died feifed,) to the faid 7. D. and T. B. (fubject to the dower of the faid D. H.) TO HOLD to them their executors, adminiftrators and affigns, to and for fuch uíes, trufts, intents and purpofes, as are therein mentioned and expreffed, for and concerning the fame. AND WHEREAS feveral declarations in ejectment have fince been delivered to feveral of the faid tenants, of the demife of the faid W. B. fome fhort time before term laft, and by reason of the default of appearance of fuch of the faid tenants to whom the fame were fo delivered, or fuffering appearances and pleas to be entered for them, judgment hath been recovered against the cafual ejector in fuch declarations mentioned, and a writ of poffeffion thereupon hath been executed by the faid fheriff, and poffeffion hath been delivered to the faid W. B. of the lands in poffeffion of the refpective tenants, (to whom fuch declarations have been delivered) by the faid fheriff; AND whereas the faid premifes being fo recovered by the default aforefaid, and fuch tenants being

defirous to do juftice as far as in them lies, and to restore the poffeffion of the faid premises fo loft by their default as aforefaid, and all the faid tenants having due regard to the faid verdict, and being willing to become tenants of the faid premifes, to the faid D. H. 7. D. and T. B. fo as they be indemnified for fo doing: NOW THIS INDENTURE WITNESSETH, that the faid feveral tenants and every of them, feverally doth hereby promise, covenant and agree, upon request to attorn and become tenants of the faid D. H. J. D. and T. B. and each of the faid tenants for him and herfelf, and for his and her heirs, executors and adminiftrators, upon giving fuch fecurity as is hereafter mentioned, covenant and agree feverally, and not the one for the other of them, to and with the faid D. H. J. D. and T. B. their executors, adminiftrators and affigns, that they the faid feveral tenants, and their refpective executors, adminiftrators and affigns, will not at any time or times hereafter, by any default of any of them, fuffer the faid D. H. 7. D. and T. B. or any of them, to be evicted or oufted of the poffeffion of the faid premifes, and that they and every of them shall and will, from time to time, and at all and every time and times hereafter, permit and fuffer, and do hereby authorize and impower the faid D. H. J. D. and T. B. and every of them, to make ufe of their feveral and refpe&ive names, either as plaintiffs or defendants, in profecuting and defending all and every fuits and fuit that fhall or may be brought, profecuted or defended by or against them the faid D. H. J. D. and T. B. every or any of them, their or any of their executors, adminiftrators or affigns, as their or any of the council for them, or any of them fhall advise, without any further or other authority whatfoever from the faid tenants, or any of them; and that the faid feveral tenants, their and every of their executors, adminiftrators or affigns, will not depart from poffeffion of the faid premifes, or at any time hereafter deliver the poffeffion, or become tenants thereof to any other perfon or perfons whatsoever, than the faid D. H. J. D and T. B. their executors, administrators or affigns, without the lawful order, decree, or judgment, of fome of his Majefty's Courts at Westminster; and that they the faid tenants and every of them fhall and will, in the prosecuting and defending of all and every fuit or fuits, touching the right, title, and interest of the faid D. H. J. D. and T. B. or any of them, in and to the faid premifes, upon the request of any of them, produce upon all and every trial, or other juft and reasonable occation, and deliver all fuch evidences as they the faid several tenants, or any of them, now have, or hereafter shall or may have, concerning the faid mesfuages, lands and tenements, and every or any part or parcel thereof; and the faid D. H. J. D. and T. B. do, and every of them doth hereby for themselves, their heirs, executors and adminiftrators, feverally covenant, promife and agree, to and with all and every of the faid tenants, their and every of their executors, adminiftrators and affigns, that they the faid D. H. J. D. and T. B. their feveral and respective heirs, executors, administrators, and affigns, fhall and will well, and truly fave harmless, and keep indemnified the said several tenants,

their and every of their heirs, executors and adminiftrators, of, from, and against all, and all manner of actions, fuits, costs, damages and troubles whatsoever, which shall or may at any time or times hereafter arife or happen to them, or any of them, for or by reason of any of the covenants and agreements herein contained, mentioned, or expreffed, and against the claims and demands of all and every perfon or perfons whatfoever; and alfo that they the faid D. H. J D. and T. B. and every of them, their and every of their heirs, executors, and adminiftrators, thall and will, at their own proper cofts and charges, defray all charges of profecuting or defending all and every fuch actions and suits which the faid tenants, or any of them, fhall neceffarily have occafion to profecute and defend, touching or concerning the faid premifes; and fhall alfo indemnify and acquit them, of and from all payments which have been made by every or any of them to the faid W. B. or any of his agents, and fhall and will alfo give fuch other fecurity for the indemnity of the faid tenants, as fhall be juft and reafonable, or as council fhall reasonably advife; but upon default of giving fuch juft and reasonable security as aforefaid, thefe articles to be void; and it is further agreed, that the faid rents, when paid, fhall be kept and preferved in the hands of fome perfon of fufficient fubftance and ability, to be agreed upon between the faid parties, until all differences between the faid W. B. and the feveral perfons now contending about the fame, shall be determined, or until fome order or decree fhall be made by the faid Court of Chancery, concerning the fame: IN WITNESS whereof, the parties to these presents have interchangeably fet their hands and feals the day and year first above written.

HEREAS the faid M. K. the daughter, is feifed in fee, or of fome other good eftate of inheritance to her and her heirs, of, in, and to ALL that brick meffuage or tenement, with the appurténances, fituate, lying, and being in (place where premises fituated, and defcription thereof) and alfo all that other meffuage or tenement lying behind the firft-mentioned meffuage or tenement, & both which faid meffuage or tenements are fituate, lying, and being in the faid parish of together with all ways, paffages, lights, eafements, profits, commodities, and appurtenances whatsoever to the faid two meffuages or tene→ NUMB. ments belonging or in any wife appertaining, SUBJECT nevertheless to a term of years, created by indenture of leafe, bearing date on or about the day of-, in the year of our Lord and made between the faid 7. K. deceased, of the first part, G. B. doctor in divinity, and Jane his wife of the fecond part, and T. H. Efq; and S. B. widow and exceutrix of her late husband S. B. Efq; deceafed, of the third part, for better fecuring the repayment of pounds, and intereft, to the faid T. H. and S. B. by the faid 7. K. in manner in the said indenture of lease mentioned. AND WHEREAS, by God's permiffion, a marriage is fhortly intended to be had and folemnized between the faid J. T. and M. K. (who hath not yet fully attained the age of twenty-one years) and in profpect and confideration of the faid marriage, in cafe the fame fhall be had and folemnized, it hath been agreed, that the faid M. K. by fine or fines, common recovery or recoveries, or other good and fufficient conveyances and affurances in the law, fhould well and fufficiently convey and affure the faid herein before recited freehold meffuages or tenements, with their appurtenances, as foon as conveniently may be after fhe fhall have attained her age of twenty-one years, UPON THE TRUST, and for the uses, intents, and purposes herein after-mentioned, expreffed and declared concerning the fame: NOW THESE PRESENTS WITNESS, and it is hereby covenanted, concluded, and agreed upon, by and between the faid parties to these prefents (with the privity and confent of the faid M. K. teftified by her being a party to, and figning and fealing of the fe prefents) that in cafe the faid marriage fhall be had and folemnized, the the faid M. K. together with the faid J. T. as foon as conveniently may be after the shall have attained her age of twenty-one years, by fine or fines, common recovery or recoveries, or other good and fufficient conveyances and affurances in the law, fhall and will well and fufficiently convey and affure all and fingular the herein before-mentioned premifes, and the reverfion and reverfions, remainder and remainders, rents, iffues, and profits, of all and fingular the faid premises, and alfo all the eftate, right, title, intereft, ufe, trust, poffeffion, equity of redemption, property, claim, and demand whatfoever, of them the faid M. K. and J.T. of, in, and to the faid premifes, and every part and parcel thereof, SUBJECT NEVERTHELESS as aforefaid unto the faid 7. H. and E. O. and their heirs, to and upon the feveral trufts, uses, intents, and purposes herein after-mentioned, expreffed and declared concerning the fame, that is to fay, in truft for the faid M. K. and her affigns, for and during the term of her natural life, without impeachment of, or for any manner of wafte, for her fole and feparate ufe and maintenance, not to be fubject or liable to the debts, controul, or engagements of the faid 7.T. her intended hufband, or any future hufband fhe may happen to marry, the receipt of the faid M.
