the burial of the body; AND also that he said D. F. his execators and administrators, shall not appoint any person or persons to act as his, their, or either of their substitutes, in the management, and direction, or government of the poor in the said workhouse, or any affairs to be transacted therein, whom the said committee shall not approve; AND that he the said D. F. his executors or administrators, fhall and will, at the end of the said term of one year, or other sooner determination of these presents, deliver back to the said churchwardens and overseers of the poor, or their successors for the time being, all such poor persons who (having been by them, or either of them, committed thereunto) shall be then remaining under his care, fitly and conveniently cloathed; AND at the same time shall and will, quietly and peaceably, yield and surrender up the possession of the said work house, and the appurtenances, unto the said church wardens and overseers of the poor of the said parith for the time being ; AND the said T. S. 7. W. and W.IV. the said church wardens, and the said W. H.T. L. IV.G. and 7. P. the said overseers of the poor, DO hereby for themselves and their successors, grant, covenant, and agree, to and with the said D. F. his executors and administrators, that he, they, or either of them, shall or may, during the said term of one year, or other sooner determination of these present articles of agreement, have, hold, occupy, possess, and use, for the purpose of employing and maintaining the said poor of the said parish only, ALL that brick building, with a large yard behind, situate in —

in the said parish, built, and now and for many years past used as a workhouse for the purpose aforesaid ; AND also the brewhoule there erected, and all the appur:enances thereunto belonging, together with all the goods, furniture, utensils for work, and other particulars mentioned in the schedule or inventory thereof hereunto annexed, free and clear of all, and all manner of rent, taxes, or expences whatsoever, except only the rent of the New River water ; AND that they the said charchwardens and overseers, or their fucceffors, tall and will lay oat and expend what Mall be needful and necessary to be done in and about the repairs of the said premises; AND also that they the said church wardens and overseers, and their succeflors for the time being, thall and will, in case the said D. F. his executors and adminiftrators, thall, from time to time, have fulfilied his part of this agreement, well and truly pay, or cause to be paid unto the said D. F. his executors, administrators, and assigns, the full sum of pounds on each of the days hereafter-named, or within fourteen days after, that is to say, the twenty-fifth day of December, the twentyfifth day of March, the twenty-fourth day of June, and the twentyninth day of September next ensuing the date hereof; AND also that if the number of poor persons by them committed to, and remaining under the care of the said D. F. his executors or administrators, fhall at any one time time exceed one hundred and fixty, they shall and will, for each and every one over and above the said number, pay, or cause to be paid unto the said D. F. his executors, administrators or 25 yns, the further sum of two hillings and four-pence per week, and

F. his executors and administrators, in the same manner as if he or they had maintained and provided for such poor persons during the whole week, if the number of poor persons remaining under his or their care do at the time of such admission, discharge, death, or absconding, exceed

--- and not otherwise ; AND also, that if any of the poor children belonging to the said parish shall be, by them the said churchwardens and overseers of the poor of the said parish, or their successors for the time being, put and placed apprentice, that then the confideration-money to be paid with such child or children, and the charge of binding shall be paid by the said church wardens and overseers, or one of them; AND also that it shall and may be lawful for the said D. F. his executors and administrators, to set to work all such poor persons as shall be by the faid church wardens and overseers committed to the care of him the said D. F. his executors and administrators, excepting such whose age or infirmities render them incapable, and to receive and take to his and their own proper use and benefit, whatever profit shall arise by or from the labour of the said poor persons, or any of them ; AND further, that they the said churchwardens and overfeers of the poor, and their successors for the time being, shall and will use their endeavours to affist the said D. F. his executors and ad. ministrators (if by him or them requested fo to do) in removing the poor not legally settled in the said parish of

unto their proper place of settiement; AND also shall and will, in all cases of murder, or accidental death, which shall happen in the said parish to any poor person, who hath not by them, or some or one of them, been committed to the care of the said D. F. his executors or administrators, pay the expence of burying the corps ; AND also, that the faid D. F. his executors and adininistrators, shall be exempt from any expence on account of such poor persons, as the said church warden's and overseers of the poor, or their successors for the time being, ar the committee shall think proper to relieve, unless the said poor perfons are by them, or some or one of them, sent into the said work. house, PROVIDED always, and it is hereby mutually agreed, by and between the parties to these presents, that he the said D. F. his executors and administrators, shall not be required to find or give any other cloathing, than what is absolutely necessary for or unto such poor persons as shall be by the said church wardens or overseers of the poor of the said parish, or their successors for the time being, committed to his or their care, nor to cause them to attend Divine Service on any Sunday in the said parish church as aforesaid, until such poor persons shall have remained fo three months, if at the same time

the number of poor persons remaining under his or their care doth exceed -- ---; AND also, that if the legislature of this kingdom fhall enact or appoint any other method and means of providing for the poor thereof than that which is now lawfully used therein, by which means the said churchwardens and overseers shall be withheld or restrained from performing this agreement, or any part chereof, that then the said agreement, or lo much, and such part thereof, as fhall then remain unperformed, shall be, and the same is hereby declared void, and of none effect. AND WHEREAS the goods, utensils, and things mentioned and contained in the schedule or inventory herein betore referred un'o, were on the — lait appraised and valued by Mr. B. H. and Mr. H. r. who have fixed the value thereof at the ruin of - pounds, THEREFORE it is mutually agreed by and between the parties hereto, that at the expiration of the said one year, or whenever this agree. ment shall become void, the like apprailement of the goods in the faid workhouse shall be again made by two indifferent appraisers, of which each party to these presents shall chule one; AND if by the faid second appraisement, the value of the goods then in the iaid workhouse in all amount unto less than the raid sum of pounds, so much as the value of the said goods in all fall short of the said sum of - pounds, shall be paid in money by the said D. F. his executors or administrators, unto the said church wardens and overseers, or their fucceflors for the time being; AND if on the said second appraisement, the said goods th Il be valued at more than the fum of --- pounds, so much as the value of the same thall exceed the said fum, fhall be paid in money by the said churchwardens and overseers, or their successors for the time being, unto the said D. F. his executors, administrators or asigns ; AND it is likewise agreed, that if any goods be brought into the said workhouse during the said term, being the properiy of any poor person, who hath been since the commencement of the said term of one year, or Bhall be resident therein at the time such second appraisement shall be made, fuch goods thall not be any way included in the said inventory or appraisement, but the same shall be disposed of as the said churchwardens and overseers of the poor, or their successors for the time being, Thall direct; AND it is also mutually agreed by and between the parties to these presents, that on failure of performance of all or any one of the articles of this agreement, which on the part and behalf of the said D. F. his executors and administrators, should and ought to be done, that he, they, or one of them, shall, on notice being given in writing, and left for him, them, or one of them, at the said workhouse, by order of the said committee, or the majosity of the said church wardens and overseers of the poor, or their fucceffors for the time being, forthwith rectify the fame; and thall also forfeit and pay to the said church wardens and overseers of the poor, or their successors for the time being, the sum of

also sign his name to a written acknowledgement thereof; and on the third omiffion or neglect, this agreement, or so much, and such part thereof as shall then remain unperformed, which on the part and behalf of the said church wardens and overseers of the poor, or their succesfors for the time being, Thould, and otherwise ought to be done and performed, shall cease and become utterly void ; and the said term of one year shall be esteemed as completely ended, as if the same had naturally run out by the effluxion of time, if the committee shall so determine ; AND it is hereby mutually agreed by the parties to these presents, that if any difference or dispute shall arise on account of any clause, condition, or article, in these presents contained, or the conftruction thereof, the same shall be referred to, and determined by two indifferent persons, of whom each party to these presents fhall elect one, within five days next after such difference or dispute shall arise ; and in cafe such two persons cannot agree and determine the matter to them referred, within six days after such reference, then the same shall be referred to, and be determined by, such one indifferent person as the said two first referrees fhall for that purpose appoint, who shall make his final award within six days after the expiration of the aforesaid fix days; and whatsoever order or 'determination the said two referrees, or their faid umpire, so to be elected as aforesaid, shall, within the times in that behalf before-mentioned, make between the said churchwardens and overseers, or their successors for the time being, and the said D. F. his executors, administrators, or assigns respectively, touching or concerning any clause, condition, or article, in these presents contained, or the construction thereof, the same shall be final, and each and every of the said parties shall stand to, abide, perform, and keep the same, without any further suit whatsoever ; AND it is also mutually covenanted and agreed, by and between the parties to these presents, that this present agreement, and the term of one year therein mentioned, shall not ceafe and determine, or be construed to expire at the end of the said one year, unless one of the parties thereto shall give notice in writing unto the other one month before the expiration of the said one year; AND for the true performance of all and singuJar the clauses, conditions, articles, and agreements herein-mentioned, the said churchwardens and overseers of the poor, do bind themfelves, and their fucceffors for the time being, and the said D, F. doth bind himself, his executors, administrators, and alligns, mutually to each other, in the penal sum of five hundred pounds, lawful money of Great Britain, firmly by these presents. and agreed upon, the - day of &c. between 7. L. A. P. 5. S. R. H. 1. C. T. G. W. A. T. F. 7. B. R. P. and H. N. tenants of several meffuages, lands and tenements, in the parish of

--, in the county of late of F. H. Efq; deceased of the one part, and D. H. widow, and relict of the said F. H. J. D. of &c. and T. B. of Ec. of the other part.

HEREAS R. H. and F. his wife, the only daughter,

and heir of the said F. H. did at the aflizes held for the county of — on or about the

day of — last past, upon a full and solemn trial by a special jury, of the most considerable gentlemen of the faid county, obtain a verdict against W. B. and several of the said tenants, for the poslefiion of the said meffuages, lands and tenements, or the greatest part of them, in an ejectment brought in His Majesty's Court of King's Bench, at Westminster, of the demise of the said R. H. and F. his wife; on which said verdict judgment has fince been duly entered, and poffeffion of the said premises duly delivered to the said R. H. by the sheriff of the said county of and the right, title, and interest of the said R. H. and F. his wife, and of the said D. H. dower, in and to the said premises were acknowledged by the said tenants, and they became tenants of the said premises to the said R. H. and F. his wife, and the D. H. AND WHEREAS the said R. H. by his indenture, cr deed of bargain and and sale, under his hand and real, well and duly executed in the month of laft paft, which is inrolled in the High Court of Chancery, for the confideration therein mentioned, did grant, bargain and sell all and every the said me Puages, lands, and premises, (whereof the late Vice Admiral Francis H. died seised,) to the said y. D. and T. B. (subject to the dower of the said D. H.) TO HOLD to them their executors, administrators and assigns, to and for such vses, trusts, intents and purposes, as are therein mentioned and expressed, for and concerning the same. AND WHEREAS several de clarations in ejectment have since been delivered to several of the said tenants, of the demise of the said W. B. some short time before term Jaft, and by reason of the default of appearance of such of the laid tenants to whom the same were so delivered, or suffering appearances and pleas to be entered for them, judgment hath been recovered against the casual ejector in such declarations mentioned, and a writ of poffeffion thereupon hath becn executed by the said sheriff, and poffeffion hath been delivered to the said IV. B. of the lands in poreffion of the respective tenants, (to whom such declarations have been delivered) by the said theriff; AND whereas the said premises being so recovered by the default aforesaid, and such tenants being
