HEREAS D. J. late of, &c. by his note of hand dated the 4th day of May, 1772, promifed to pay to J. B. or order the fum of pounds, three months after date, for value received; which note the faid J. B. indorsed to . H. AND WHEREAS in Michaelmas term lait a judgment was recovered, on a warrant of attorny against the faid 7. B. in his Majefty's Court of King's Bench at Weftmirfter, after an action brought upon the faid note for - pounds debt, and 63 fhillings cofts, defeazable on payment of the fum of and intereft and cofts: And in Hilary term Jaft, another judgment was allo recovered on the faid note against the faid D. J. in his Majefty's Court of Common Pleas at Westminster, for the fum of for damages and cofts; whereupon the faid D. J. hath brought a writ of error for delay only. AND WHEREAS it is hereby agreed, by and between the faid . H. and D. 7. that no other writ of error fhall hereafter be brought by the faid D. J. upon the said judgment recovered against him, and that if any fuch fhall be brought, that he shall and will non-. profs the fame at his own expenée, and that he shall not, nor will further profecute his prefent writ of error, but shall and will non-profs it at his own like expence, within fix months from the date hereof, and that he within that time, fhall and will pay the fum of pounds in part of the faid damages and cofts recovered against him and the faid 7. B. and within a year from the date hereof, a further fum of pounds, and fo continue the like payments half-yearly, until the whole of the faid damages and cofts recovered against him and the faid F. B. fhall be by: him the faid D. J. fully fatisfied and difcharged. NOW the faid f. H. in confideration thereof doth agree to discharge, or caufe him the faid D. J. to be difcharged forthwith, from and out of cuftody of the warden of his Majefty's prifon of the Fleet. And it is hereby alfo agreed, by and between the faid parties hereto, that this agreement fhall be made a rule of the faid Court of Common Pleas, if the faid: court fhall fo think fit. HE faid B. R. agrees to let unto the faid W. H. a fet of chambers, up three pair of ftairs, (No. -in) from Michaelmas laft, for one year, and a quarter's warning on either fide to be given; at the reat of pounds a year, payable quarterly.

The faid W. H. agrees to take the faid chambers for the time, and at the rent payable as aforefaid.

Provided always nevertheless, that if the said B. R. fhall at any time hereafter have occafion to use the faid chambers himself, or shall happen to depart this life, this agreement fhall be void. As witnefs,

E. and now offor the term of three years certain, and a quarter's warning, or notice afterwards to be given or left in writing by either of the faid parties, to or for the other of them, at the end of the said three years. The rent thereof to commence from Lady-day next, at and under the yearly rent of payable quarterly. The firft payment thereof to begin and be made at Midfummer-day next.

The faid G. H. doth agree to take the said house of the faid 7. M. for the term, and at the rent payable in manner aforefaid, AND ÄLSO that he will at his own cofts and charges make good, or cause to be made good, and put into the fame or as good condition and order as the fame lately was in, the kitchen or ground room of and belonging to the faid house, which he hath now converted, or caufed to be converted into a cheefemonger's fhop, at the expiration, or other fooner determination of this prefent demife. And likewife then leave the paper hangings in the chamber, the back window flutter, the hearth ftone, two fhelves in the closet, one shelf in the kitchen, and another shelf in the wash-house, of and belonging to the faid house. HE faid W. S. in confideration of the rent herein after mentioned and agreed to be paid to him, hath demifed, and hereby doth demile and let unto the faid M. H. a meffuage or tenement, fituate and being in court, in the parifa of

To hold to the faid M. H. for the term of one year, to commence from Chriftmas-day next, at the yearly rent of pounds to be paid quarterly; and the faid W. S. hereby agrees, by or before Christmas-day next, well and fufficiently to repair, amend, and put in good and tenantable order and condition the faid boufe, with

with its appurtenances, in all needful and necessary reparations and amendments whatfoever, in cafe the fame is not already in fuch good and fufficient repair and condition, and the fame premises so to continue and keep in fuch repair, from thence, for and during all such time as the faid M. H. fhall be and continue therein as tenant at will only.

The faid M. H. in confideration thereof, hereby agrees to take and rent the said houfe, of the faid W. S, for the term, at the rent, and payable as aforefaid; which faid rent the agrees accordingly to pay unto him quarterly.

And it is hereby mutually agreed between the said parties, that after the expiration of the faid term of a year, if either of them shall be minded or defirous to quit, leave, or part with each other, or from the faid premifes, the or he fhall give one quarter's warning, or notice in writing thereof, to the other of them.

And if after the faid term of a year be expired, the the faid M. H. hall be minded or defirous to have and take a leafe of the faid premises, with common and usual covenants for a further term of three or seven years, at pounds a year, payable quarterly; and of fuch her intention and defire, fhall give notice in writing to the faid W. S. within three months after the expiration of the faid term of a year; that then he the said W. S. fhall and will grant her fuch leafe, for fuch further term or terms, and at such rent, and payable as aforefaid; the cofts and charges whereof is to be paid and difcharged equally, by and between the faid parties. HAT the faid J. B. doth let unto the faid R. W. the rooms and apartments following, viz. An intire first floor, the fore kitchen and a cellar under it, and a fore garret, being part of the house which he the faid J. B. now lives in, fituate and being To have and to hold the faid premifes, for and during the term of half a year, to commence from Midsummer-day next, after the date hereof, at and under the yearly rent of pounds, of lawful money of Great Britain, payable quarterly by even and equal portions; the first quarterly payment to be made on Michaelmas-day next enfuing the date hereof. And it is further agreed by and between the faid parties hereto, that the faid R. W. after the expiration of the faid half year, may hold and enjoy the faid premifes from quarter to quarter, fo long as both parties fhall agree, at the rent of pounds every quarter, and each party is at liberty to give a quarter's warning, for the quitting the poffeffion of the faid premifes. And it is alfo further agreed between the faid parties, that when the faid R, W. fhall leave the faid premises, he shall leave the glass windows and other things belonging

to the faid premifes in as good condition as they now are, (reafonable wear only excepted). As witness, &c.

HE faid R. C. doth hereby agree, by good and fufficient con

veyances in law, at or before Chriftmas-day next, to affign, fell, and convey unto the faid E. Y. her heirs and affigns, free from all incumbrances whatfoever and howsoever, all those three houses, yards and appurtenances, together with all and every the grates, locks, and fixtures therein and thereon, fituate in in the parifh of London; and alfo a piece of ground near thereto adjoining, in the poffeffion of T. B. Efq; to hold unto her, and her heirs and affigns for ever, at and for the price or fum of pounds, to be paid unto him by her, on a fufficient title being made and executed unto her by him; and alfo to affign over unto her the feveral policies of infurance of the faid houfes, and to clear, pay and difcharge all taxes, charges, incumbrances, and impofitions, charged or affeffed on or for the faid premifes, up to Chriftmas-day aforefaid, and to indemnify her, or reimburfe her on account thereof.

The faid E. Y. on her having, by the conveyances aforefaid, the faid premises affigned and conveyed unto her, at or by the time aforefaid, in manner aforefaid, doth hereby agree to pay unto the faid R. C. the price or fum aforefaid for the fame, and hath now paid unto the faid R. C. the fum of pounds in part of the purchase money aforefaid. As witnefs,

of all that meffuage late in the poffeffion of 7. M. fituated in with the appurtenances, to hold to him the faid 7. C. his executors and affigns, from Midsummer-day now next enfuing, for the term of years, at and after the annual rent of pounds, payable quarterly, free of taxes (except the land-tax) which leafe thall contain all ufual and reasonable covenants; and particularly covenants, that the faid W. B. fhall allow out of the first year's rent of the premifes the fum of pounds towards the repairs thereof, and that he fhall also pay all the taxes in refpect of the faid houfe to Midfummer-day next; and shall also indemnify the faid F. C. and his

affigns,

affigns, from the ground-rent thereof during the faid term; and there fhall be alfo inferted in the faid leafe an exception against damages happening by fire to the premifes during the faid term. MEMORANDUM made this day of 17725 between L. R. of, &c. and G. W. of, &c. as follows, viz.

AHAT he the faid L. R. in confideration of the rent and agreements herein after-mentioned, doth agree to demife and 1 t, by a good and fufficient leafe in the law thereof, unto the said G. W. ali that field, with the appurtenances thereunto belonging, fituate pear or adjoining to, &c. late in the occupation of 7. B. a gardener, together with all ways, paths, paffages, waters, watercourfes, eafements, privileges, and appurtenances what foever, to the fame belonging or appertaining, or therewith held, ufed, occupied, or enjoyed, or accepted, reputed, taken, or known to be part, parcel, or member thereof, or of any part thereof, to hold for the term of years from Christmas-day laft paft, at and under the yearly rent of pounds, fhillings, payable quarterly; the first payment thereof to be made at Lady-day next enfuing the date hereof. And the faid G. W. is to have full and free liberty to lop and top the trees and hedges of the faid premifes at feafonable and convenient times, and to plow up, and erect upon the fame any fhed or fheds, or other convenient buildings during the faid term, he, from time to time, fcouring and cleanfing the ditches, and repairing and making good the fences, hedges, and gates thereof.

W. in confideration thereof, doth agree to take the aforefaid premises for the term and at the rent payable in manner aforefaid, and to execute a counterpart of the aforefaid leafe; and alfo to fcour and cleanse the ditches, and repair, make good, and keep up the fences, hedges, and gates of the faid premifes. HE faid F. G. for the confiderations herein after-mentioned; doth agree with the faid R. K. that he the faid F. G. or his affigns, will, within the space of three calendar months, next following the day of the date of these presents, find and provide all fit and proper materials and things, and erect, build, and finish, in a good, found, fubftantial, and workman-like manner, one brick house or building, on a piece or parcel of waste ground, fituate, &c. according
