HIS INDENTURE, tripartite, made the

Efq; deceased, and alfo devilee named in his laft will and teftament, as to the manors, forefts, meffuages, lands, and hereditaments, herein-after mentioned to be bargained and fold, (among other lands and hereditaments) of the first part; B. B. of &c. Efq; and C. C. of &c. Efq; (trustees named in the act of parliament herein-after mentioned, for the fale of the eftate of the faid A. A.) of the second part, and D. D. E. E. and F. F. of the third part, WITNESSETH, That for and in confideration of the fum of pounds, of lawful money of Great-Britain, to the faid B. B. and C. C. in hand paid by the faid D. D. E. E. and F. F. at or before the fealing and delivery of these presents, the receipt whereof they the faid B. B. and C. C. do hereby acknowledge, and thereof, and of every part thereof do acquit, releafe and difcharge the faid D. D. E. E. and F. F. their heirs, executors, adminiftrators, and affigns, and every of them for ever by thefe prefents, (which faid fum of pounds, is the fame fum of pounds, mentioned to be the confideration-money of one indenture, tripartite, of release, bearing even date herewith, and made, or mentioned to be made, between the fame parties as are parties to thefe prefents, and purporting a grant or release of the faid manors, forefts, meffuages, lands, tenements, and hereditaments herein-after mentioned, to be hereby bargained and fold, with their appurtenances, unto and to the ule of the faid D. D. E. E. and F. F. their heirs and affigns); AND ALSO for and in confideration of the fum of ros. of like lawful money to the faid A. A. party hereunto, in hand paid by the faid D. D. E. E. and F. F. at or before the fealing and delivery of these prefents, the receipt whereof is hereby acknowledged; AND in purfuance of the trufts repofed in them the faid B. B. and C. day of now last past, in a caufe then and there depending between the said A. A. party hereunto, and P. A. an infant, by her next friend, and R. R. one of the creditors of the faid A. A. junior, on behalf of himself and other creditors of the fame A. A. by original and fupplemental bill, plaintiffs, and the faid B. B. C. C. and S. S. Efq; and the faid D. D. E. E. and F. F. defendants (in the faid indenture of release likewife recited) they the faid B. B. and C. C. at the request and by the direction of the faid 1. A. F. their heirs and affigns, ALL those manors, &c. and the reverfion and reverfions, remainder and remainders, yearly and other rents, iffues, and profits thereof, and every part and parcel thereof, and all the eftate, right, tithe truft, property, claim, and demand whatsoever, at law and equity, of them the faid A. A. party hereunto, B. B. and C. C. every or any of them, of, in, to, or out of the faid manors, forefts, meffuages, lands, tenements, hereditaments, and premifes, hereby mentioned or intended to be hereby bargained and fold, every or any part or parcel thereof, TO HAVE AND TO HOLD the faid manors, forests, meffuages, lands, tenements, hereditaments, and all and fingular other the premises hereby mentioned, or intended to be hereby bargained and fold, with their and every of their appurtenances, unto the faid D. C. by and from the faid B. B. upon a mortgage in fee to him the faid C. C. lately made (among other manors, lands, and hereditaments) of the manor or manors, advowfon, meffuages, farms, lands, tenements, and hereditaments herein-after granted, bargained and fold, the fum of pounds, of lawful money of Great Britain, which the faid B. B. doth hereby own and acknow ledge, AND WHEREAS the faid C. C. hath contracted and agreed

Of manors, &c. in three counties, in order to the paffing of three recoveries, to rectify a mistake in three former recoveries, in which the bargainor (the vouchee) was mifnamed, part of his name being omitted; to enure as to part, to corroborate a mortgage term in favour of the mortgagee, who is a party; and then as to that part, and immediately as to the refidue, to the use of the recoveror and his heirs.

H. of the one part, and the faid A. A. A. by the name of A. A. of the other part, and from and after the determination of the faid term, and subject thereunto to the use of the faid A. A.
