From a tradefman to two, jointly and feverally, to recover and get in his flock in trade.

T

O ALL to whom thefe prefents fhall come, A. A. of &c. mercer, fends greeting: WHEREAS in and by certain articles of agreement indented, bearing date on or about the

day of now last past, and made, or mentioned to be made between the faid A. A. of the one part, B. B. of &c. grocer, and C. C. of &c. brewer, of the other part, among other covenants and agreements therein contained, and for the confiderations therein mentioned), they the faid B. B. and C. C. did agree with the said A. A. that in cafe he the faid A. A. his executors or adminiftrators, should think fit to make them the faid B. B. and C. C. or either of them, his attorney or attornies, to receive and get in fuch debts and fums of money as then were, and at Christmas then or now next fhould be due and owing to him the faid A. A. or his eftate, from any perfon or perfons in the way of trade, then they the faid B. B. and C. C. or the furvivor of them, fhould and would thereupon do his and their best endeavours to get in the fame debts and monies accordingly, and fhould and would, from time to time, pav over the fame (when fo received) upon demand unto the faid A. A. his executors or adminiftrators, and fhould and would, on the executing and tender of fuch letter or letters of attorney as aforefaid, enter into bond of fufficient penalty unto the faid A. A. his executors and adminiftrators, for the true payment of all monies fo to be received accordingly. NOW KNOW YE, That for divers good caufes and confiderations him the faid A. A. thereunto moving, he the faid A. A. hath made, ordained, conftituted, deputed, and appointed, and in his place and ftead put and depute, and by thefe prefents doth make, ordain, conftitute, and appoint, and in his place and ftead put and depute the faid B. B. and C. C. his true and lawful attorney and attornies, jointly and severally for him the faid A. A. and in his name, and to his ufe, to afk, demand, fue for, recover, and receive, all fuch fum and fums of money, debts and demands whatfoever, which now are, or at Christmas now next enfuing fhall be due and owing to the faid A. A. or his eftate, from any perfon or perfons, or customers of him the faid A. A. in his way of trade as a and to have, ufe, and take all lawful means in the name of the faid A. A. or otherwise for the recovery thereof; and on payment of the fame, or any part thereof, to give acquittances, or other fufficient difcharges for the faid A. A. and in his name to do all other acts and things whatsoever concerning the premises, as fully in every refpect as the faid A. A. himfelf might or could do if he were perfonally prefent, he the faid A. A. hereby ratifying and confirming, and agreeing to ratify and confirm whafoever his faid attornies, or either of them fhall lawfully do or caufe to be done in the premises, by virtue of thefe prefents. made, deputed, and in my place and ftead, by these prefents put, and conftituted, my very good friend J. T. of the parish of

in the county aforefaid, grocer, my lawful attorney and deputy for me, and in my name, and to my own proper ufe, to afk, demand, levy, fue for, recover, and receive, of all and every fuch perfon or perfons whatsoever, as is, or are, or fhall be tenant or tenants, occupier oroccupiers, of, in, or to, my feveral meffuages, or tenements, with their appurtenances, or any of them, or any part thereof, and all my wafte ground there near adjoining; which faid meffuages, or tenements, and wafte ground, I lately purchafed of one M. R. ALL which faid houfes and ground are fituate, lying, and being in a certain place commonly called in the faid parish of

in the faid county of Middlefex; AS WELL all fuch fum, and fums of money, to me now due and in arrear for rent, of and for the faid feveral meffuages, or tenements, or wafte ground, or any of them; AS ALSO all other fum and fums of money to grow due, and payable for rent, of and for the aforefaid feveral meffuages, or tenements, or wafte ground, or any of them; Giving, and hereby granting unto my faid attorney, full power and abfolute authority for me, and in my name, and to and for my own ufe, and benefit, to afk, demand, levy, fue for, recover, and receive, of all and every such person and perfons whatsoever, their feveral executors and adminiftrators, as is, or are, or shall be tenant, or tenants, of and for my faid feveral meffuages, or tenements, and premifes, or any of them, all fum and fums of money due, and to grow due and payable as aforefaid; And on non-payment thereof, diftrefs, or diftreffes, for me, and in my name, to make, feife, take, carry, or drive away and detain; and upon receipt thereof, or any agreement in that behalf had and made, for me, and to my use, to make, feal, and deliver, for me, and in my name, all and every fuch acquittance or acquittances, or other difcharges as by the faid 7. T. fhall be thought meet and convenient to be given; and to do, execute, and finifh, for the recovery and receipt thereof, all and every fuch act and acts, thing and things, device and devices whatsoever, as to the faid 7. F. fhall be thought fit and convenient; AND I do hereby further authorife and impower my faid attorney, to demife and let my faid feveral meffuages and wafte ground, or any of them, for me, and in my name, to fuch perfon or perfons, and for fuch term or terms of years, and at fuch annual fum or fums of money, as to my faid attorney fhall be thought meet and convenient; hereby ratifying, confirming, allowing, and approving, all and whatfo

C. of the faid parifh of county of Middlefex aforefaid, cooper, my true and lawful attorney for me and in my name, and for my use and benefit, to let, fet, or demife, unto any perfon or perfons whomfoever, all and every, or any of my meffuages, or tenements, and premifes, with the appurtenances, and every or any part or parts thereof, in the parifh of in the county of Middlesex aforefaid, or elfewhere, for any term or number of years as he fhall think proper; AND ALSO for me, and in my name, and for my ufe, to afk, demand, and receive of, and from, all and every, or any perfon or perfons whomfoever, who now is, or are, or at any time, or times hereafter, fhall or may be tenant or tenants to me; ALL fuch rent and rents, or arrears of rent, as now is, or are, or at any time or times hereafter, fhall or may become due and payable unto me, from any fuch perfon or perfons as aforefaid; AND on receipt thereof, or any part thereof, for me and in my name, or in his own name, acquittances, or other fufficient difcharges, for the fame, to give, make, feal, and execute; and in default of payment thereof, or any part into and upon all or any of my faid meffuages, or tenements, and premises, with the appurtenances, or any part thereof, to enter, feife, and diftrain, all or any goods or chattels that fhall or may from time to time be found, in or upon the faid premifes, or any part thereof, and to make fuch diftrefs of the premises as the law permits; AND the difrefs or diftreffes fo made, to detain until payment of fuch rent or rents fhall be made, or the fame fhall be delivered by due courfe of law; and for non-payment to difpofe thereof according to law, or to proceed in my name or otherwife by action, fuit, bill, or plaint, or to take fuch other lawful ways or means for the recovery thereof, as he the faid T.C. fhall think fit; and to do all and every other lawful and warrantable act and acts, thing and things, whatfoever, for the purposes aforefaid; AND I do hereby give and grant unto my faid attorney, his fubftitutes and affigns, all my power and authority in the premises for the purpofes aforefaid, as fully and effectually as I myfelf might, or could do, being perfonally prefent and did the fame; AND one or more attorney or attornies, to make, fubftitute and appoint, and aɛ

his pleasure to revoke; Hereby allowing, ratifying, confirming, and declaring, that I will allow, ratify, and confirm, all and whatfoever my faid attorney, his fubftitutes, and affigns, or any of them, 1hall lawfully do, or caufe to be done, in and about the premifes, by virtue of these prefents; AND I do hereby promife and agree, to fave harmless, and keep indemnified, the faid T. C. his fubftitutes and affigns, and his and their executors, and adminiftrators, and all his and their goods, chattels, lands, and tenements, of, from, and againft, all cofts, charges, damages, and expences, whatfoever, which he, they, or any of them, fhail or may, at any time or times hereafter, fuffer, fuftain, or be put to, for, or by reafon, or on account, of his the faid T. C. his heirs or affigns, in cafe he the faid F. D. deceafed, his executors or adminiftrators, fhould demife, affign, or otherwife depart with, or from, the faid demifed premifes, or any part thereof, to any perfon or perfons whatfoever, without the confent in writing of the faid J. C. his heirs or affigns, under his or their hands and feals first had and obtained, as by the faid recited indenture of leafe, relation being thereunto had, may more fully appear: AND WHEREAS the faid F. D. of is fince dead, having first made his laft will and teftament in writing, and thereof appointed the faid F. D. party hereunto, fole executor, whereby he the faid F. D. party hereunto, is become legally entitled unto the faid farm and leafe, for the remainder of the said term of years, which is yet to come and unexpired: AND WHEREAS the aid F. D, the teftator, in his life, was at great charge and expence

in cultivating and improving the faid farm, and the said F. D. party hereunto, doth hold by leafe a large farm at

by reafon whereof, and of the distance thereof from the faid F. D. party hereunto, cannot himself manage and ufe the faid farm, without confiderable lofs and damage; AND WHEREAS the faid F. D. party hereunto, for the reasons aforefaid, hath applied himself unto the faid 7. C. for a licence to let the faid farm to an under-tenant; AND WHEREAS ALSO the faid F. D. party hereto, hath also offered to furrender up unto the faid 7. C. the faid leafe or term, on condition that he the faid 7. C. would make him the faid F. D. party hereto, reafonable fatisfaction for fuch expence and charge in improving the faid farm; AND WHEREAS the faid 7. D. notwithstanding fuch reafonable requeft and offer of the faid F. D. party hereunto, hath refufed not only to give the faid F. D. party hereto, leave or licence to let or affign the faid farm to an under-tenant, but hath and doth alfo refufe to accept his furrender of the faid leafe or term on the conditions above-mentioned; NOW KNOW YE, that the said F. D. party hereunto, being willing and defirous to enjoy and reap the benefit of the faid leafe, and term, in order to be reimburfed the expences and costs that hath been laid out and expended in improving the faid farm, and repofing a fpecial confidence in 7. B. late of E. in the faid county of Surry, hufbandman, hath conftituted and appointed, and by thefe prefents doth constitute and appoint the faid J. B. his bailiff, for the managing and cultivating the faid farm and acres of land, during the remainder of the term of years, by the above-mentioned leafe granted, yet to come and unexpired: AND the faid F. D. party hereto, doth hereby give unto the faid J. B. full power and authority for him the faid F. D. party hereto, and in his name to do all things whatfoever neceffary for the managing the faid farm, according to the courfe of hufbandry, as he the faid .
