in the year of c. (after the fame was &c. received by the faid F. E. as executrix of the faid F. E.) It was (among other things) ordered, that in cafe notice had been given to any of the perfons concerned in fuch fecurities to pay in their monies due thereon, they were to bring the fame before O, N. one of the mafters of the faid court, to whom the account in the faid cause by the decree ftands referred; AND WHEREAS the faid caufe hath, fince the death of the faid E. E. been revived by her faid executors; AND WHEREAS there is now due and owing by the said N. N. for intereft of the aforefaid fum of pounds, until the day

N. bearing date herewith. may appear; NOW THIS INDENTURE WITNESSETH, That in purfuance of, and obedience to, the faid feveral recited orders, decrees, and for and in confideration of the faid fum of pounds, fo paid to the faid O. N. by the faid P. P. in full for all principal money and intereft now due and owing by the faid N. N. on the faid recited fecurity as aforefaid, And also in confideration of the fum of five fhillings of like money &c. to the faid A. A. B. A. C. A. D. A. G. G. and . his wife, and M. M. in hand paid by the said P. P. R. R. and S. S. at or before the fealing and delivery of these prefents, the receipt whereof is hereby acknowledged, they the faid A. A. B. A. and M. M. at the requeft, and by the direction and appointment of the faid N. N. and by and with the confent, direction, and appointment of the faid C. A. D. A. G. G. and 7. his wife, and M. M. teftified by their being parties to, and their fealing and delivery of thefe prefents; AND ALSO that they the faid C. A. D. A. G. G. and J. his wife, have, and each of them hath, bargained, fold, affigned, transferred, and fet over, and by thefe prefents do, and each, and every of them, as far as in them refpectively lieth, ab bargain, fell, align, transfer, and fet over, unto the faid P. P.

R. R. and S. S. their executors, administrators, and affigns, ALL the faid moiety of the faid manors, lands, tenements, and hereditaments, and all and fingular other the premises, in and by the faid two several recited indentures, of the

S. their executors, and adminiftrators, from henceforth for and during all the reft and refidue yet to come and unexpired of the said two feveral terms of. years, and years therein respectively as aforefaid; AND THIS INDENTURE FURTHER WIT. NESSETH, That for and in confideration of the faid fum of pounds fo paid to the faid O. N. by the faid P. P. at the request of the faid N. N. as aforefaid, and alfo in confideration of the further fum of pounds of lawful money of Great Britain by the faid N. N. in hand paid to the faid P. P. at or before the fealing and delivery hereof, (being the reficue of the faid fum of pounds) the receipt and payment of which faid feveral fums of pounds, and

pounds, he the faid N. N. doth hereby acknowledge, and thereof doth acquit, release, and discharge the faid P. P. his executors and adminiftrators for ever, by these prefents, and for other the confiderations before mentioned, he the faid N. N. hath ratified and confirmed, and by thefe prefents doth ratify and confirm unto the faid P. P. R. R. and S. S. their executors, adminiftrators, and affigns, ALL the faid moiety of the faid lands, tenements, hereditaments, and other the premises hereby mentioned, or intended to be hereby affigned, with their and every of their appurtenances, TO HAVE AND TO HOLD the fame, and every of them, and every part and parcel thereof, unto the faid P. P. R. R. and S. S. their executors, adminiftrators, and affigns, from henceforth for and during all the reft and refidue yet to come and unexpired of the faid two feveral terms .of years and years, without impeachment of waste, freed and abfolutely difcharged of the aforefaid provifoes, and agreements, for redemption of the fame premifes, and all equity thereupon, fubject nevertheless to the provifoe and agreement next

herein after mentioned; that is to say, PROVIDED ALWAYS, and it is hereby declared and agreed by and between the said N. N. P. P. R. R. and S. S. that if the faid N. N. his heirs, executors, or adminiftrators, fhall and do, well and truly pay, or caufe to be paid, unto the faid P. N. if the fame fhall happen to be before the time of payment, then, and in fuch case, they the faid P. P. R. R. and S. S. or the furvivor of them, or the executors, adminiftrators, or affigns, of fuch furvivor fhall, and will, at the requefts, cofts and charges of the faid N. N. his heirs or affigns, reaffign and furrender the faid two feveral terms of years,

years, of and in the premises hereby mentioned to be hereby affigned as aforefaid, unto the faid N. N. his heirs or affigns, or unto fuch perfon or perfons as he or they fhall for that purpose nominate and appoint, freed and difcharged of and from all incumbrances made or done, or to be made or done by them the faid P. P. R. R. and S. S. or any of them, their or any of their executors, administrators, or affigns; AND the faid N. N. doth hereby for himfelf, his heirs, executors, and adminiftrators, covenant, promife, and grant, to and with the faid P. P. R. R. and S. S. their executors, administrators, and affigns, in manner and form following, that is to fay, that he the faid N. N. his heirs, executors, or administrators, fhall and will well and truly pay, or cause to be paid, unto the faid P. P. or fuch other perfon or perfons as the faid High Court of Chancery fhall in that behalf order or appoint, the faid fum of pounds, and fuch intereft as (after his decease) fhall become due and payable for the fame, at the rate aforefaid, at fuch time, and in fuch manner and form as are herein before mentioned, for the payment thereof, according to the purport of the faid laft mentioned provifoe, and the true intent and meaning of thefe presents; AND FURTHER, that it fhall and may be lawful to and for the faid P. P. R. R. and S. S. their executors, adminiftrators, and affigns, from time to time, and at all times, from and after breach fhall happen to be made of and in the faid laft mentioned provifoe, peaceably and quietly to enter into, have, hold, occupy, poffefs, and enjoy, the faid moiety of the faid manors, lands, tenements, hereditaments, and premises, hereby mentioned, or intended to be hereby affigned, and to receive and take the rents and profits thereof, for and during all the reft and refidue which fhall be then to come and unexpired of the said two feveral and refpective terms of —

years, and years, without the lawful let, fuit, trouble, or interruption of or by the faid N. N. his heirs or affigns, or of or by

any other perfon or perfons whomfoever, and that free and clear, and freely and clearly acquitted, exonerated, and difcharged, or otherwife by the faid N. N. his heirs, executors, or adminiftrators, well and fufficiently faved, defended, kept harmless, and indemnified, of, from, and against all former and other gifts, grants, bargains, fales, leafes, mortgages, jointures, dowers, titles of dower, ufes, trufts, wills, intails, ftatutes, recognizances, judgments, extents, executions, rents, arrears of rent, forfeitures, re-entries, and of, from, and against all and fingular other eftates, titles, troubles, and incumbrances whatsoever, had, made, done, committed, or fuffered, or hereafter to be had, made, done, committed, or fuffered by the faid N. N. his heirs or affigns, or by any other perfon or perfons whomfoever; AND MOREOVER, that he the faid N. N. his heirs and affigns, and all and every perfon or perfons having or lawfully claiming, or which fhall or may have, or lawfully claim any eftate, right, title, truft, or intereft, of, in, to, or out of the premifes, mentioned, or intended to be hereby affigned, or any of them, or any part thereof, fhall and will, from time to time, and at all times, from and after breach shall happen to be made of and in the faid laft mentioned provifoe, contrary to the true intent and meaning of these prefents, upon every reasonable requeft of them the faid P. P. R. R. and S. S. their executors, adminiftrators, and affigns, or any of them, make, do, and execute, or caufe to be made, done, and executed, all and every fuch further and other reasonable acts, deeds, things, devifes, conveyances, and affurances in the law whatfoever, for the further, better, more perfect and abfolute granting and conveying of the faid moiety of the faid manors, lands, tenements, hereditaments, and premises, hereby mentioned, or intended to be hereby affigned, with their appurtenances, unto the faid P. P. R. R. and S. S. their executors, adminiftrators, and affigns, for and during all the rest and refidue which shall be then to come and unexpired of the said two several and respective terms of years, without impeachment of wafte, difcharged of the faid last mentioned provifoe, for redemption of the faid premifes, and all equity thereupon, as by the said P. P. R. R. and S. S. or the furvivor of them, or the executors or adminiftrators of fuch furvivor, or his or their, or any of their council learned in the law, fhall be reasonably devifed, advised, and required; AND each of them the faid A. A. B. A. C. A. and M. M. doth hereby for himself, his heirs, executors, and adminiftrators, covenant, promife, and agree, to and with the faid P. P. R. R. and S. S. their executors, adminiftrators, and affigns, that he hath not at any time heretofore done, committed, or executed, any act, matter, or thing whatsoever, whereby, or by means whereof the premifes mentioned, or intended to be hereby affigned, or any of them, or any part thereof, for the faid feveral term of years, and

G. and 7. his wife, or either of them, have not, nor hath not, at any time heretofore done, committed, or executed any act, matter, or thing whatfoever, whereby, or by means whereof the premises mentioned, or intended to be hereby affigned, or any of them, or any part thereof, or the faid feveral terms of years, and years therein, is, are, fhall, or may be furrendered, forfeited, or avoided, or impeached, charged, or incumbered, in title, charge, eftate, or otherwife howfoever; AND LASTLY, it is hereby declared and agreed, by and between the faid P. P. R. R. S. S. and N. N. that if in the mean time any breach fhall happen to be made of the faid laft mentioned provifoe, contrary to the true intent and meaning of these prefents, it fhall and may be lawful to and for the faid N. N. and his heirs, peaceably and quietly to have, hold, and enjoy, all and fingular the premifes hereby mentioned, or intended to be hereby affigned, and to receive and take the rents, iffues, and profits thereof, and of every part thereof, to and for his and their own use and benefit, without the lawful let, fuit, trouble, denial, eviction, or interruption, of or by the faid P. P. R. R. and S. S. their executors, adminiftrators, or affigns, or of or by any other person or perfons, claiming, or to claim, from, by, or under them, or any of them. In witness &c.
