waters, water-courfes, hedges, ditches, fences, liberties, privileges, profits, commodities, advantages, emoluments, hereditaments, and appurtenances whatfoever, to the faid capital meffuage or farm-house, clofer, lands, hereditaments, and premifes, every and any part or parcel thereof, belonging, or in any wife appertaining, or therewith, or with any part thereof, ufed, occupied, poffeffed, or enjoyed, (all which faid capital meffuage, clofes, lands, hereditaments, and premifes, are now in the actual poffeffion of the faid G. G. by virtue of a bargain and fale to him thereof made by the faid A. A. and E. E. for the term of one whole year, in confideration of five fhillings to them in hand paid by the faid G. G. in and by one indenture, bearing date the day next before the day of the date hereof, and by force of the ftatute for transferring ufes into poffeffion in that cafe made and provided, and the reverfion and reverfions, remainder, and remainders, yearly, and other rents, iffues, and profits thereof, and of every part and parcel thereof; and alfo all the eftate, right, title, intereft, truft, property, equity of redemption, claim and demand whatsoever, both at law and in equity, of them the faid A. A. and E. E. and of each or either of them, of, in, to, or out of the faid capital meffuage, clofes, lands, hereditaments, and premises, or any of them, or any part or parcel thereof, TO HAVE and to HOLD the faid capital meffuage, or farm-houfe, closes, lands, hereditaments, and all and fingular other the premises, with their, and every of their appurtenances, unto the faid G. G. his heirs and affigns, to and for the only proper ufe and behoof of him the faid G. G. and of his heirs and aligns for ever, fubject nevertheless to the provifo herein after contained, for redemption of the fame premifes, that is to fay, PROVIDED ALWAYS, and it is hereby declared and agreed, by and between the faid G. G. and E. E. that if the faid E. E. his heirs, executors, or adminiftrators, fhall, and do, well and truly pay, or caufe to be paid unto the faid G. G. his executors, adminiftrators, or affigns, at or in the Guildhall, of the city of London, the full and juft fum of pounds, of lawful money of Great Britain, without any deduction or abatement whatfoever out of the fame, or any part thereof, for or in refpect of any taxes, charges, affeffments, payments, or other matter, caufe, or thing whatsoever, taxed, charged, or impofed, or to be taxed, charged, or impofed upon the faid premises, or any part thereof, or upon the faid G. G. his heirs, executors, adminiftrators, or affigns, for or in respect thereof, by authority of parliament, or otherwife howfoever, in manner following, that is to fay, pounds (part thereof) on the day of now next

G. his executors, adminiftrators, or affigns, the faid fum of pounds, at fuch times and place, and in fuch manner and form, as are herein before mentioned, for payment thereof, without any deduction or abatement out of the fame, or any part thereof, for taxes or otherwife as aforefaid, according to the purport of the faid provifo herein before contained for the payment thereof, and the true intent and meaning of thefe prefents; AND FURTHER, That the faid G. G. his heirs and affigns, fhall, or lawfully may, from time to time, and at all times, from and after default fhall happen to be made, of or in payment of the faid fum of pounds, or any part thereof, contrary to the form and effect of the aforefaid provifo and covenant for paying the fame, and the true intent and meaning of thefe prefents, peaceably and quietly enter into, have, hold, occupy, poffefs, and enjoy the faid capital meffuage, or farm-house, closes, lands, hereditaments, and premises, with their appurtenances, and every part and parcel thereof, and receive and take the rents and profits thereof, and of every part thereof, to and for his and their own ufe and benefit, without the lawful let, fuit, trouble, denial, eviction, or interruption, of or by the faid E. E. his heirs or affigns, or of, or by any other perfon or perfons whom foever, and that free and clear, and freely and clearly acquitted, exonerated, and discharged, or otherwife, by the faid E. E. his heirs, executors, or administrators, well and fuficiently faved, defended, and kept harmless, and indemnified, of, from, and again ft, all former and other gifts, grants, bargains, fales, leafes, mortgages, jointures, dowers, ufes, wills, trufts, intails, ftatutes, recognizances, judgments, extents, executions, and of, from, and against all and fingular other eftates, titles, troubles, charges, and incumbrances whatsoever, had, made, done, committed, occafioned, or fuffered, or to be had, made, done, committed, occafioned, or fuffered, by the faid E. E. and his heirs, or any other perfon or perfons whomfoever; AND MOREOVER, That he the faid E. E. and his heirs, and all other perfons having, or lawfully claiming, or which shall or may have, or lawfully claim any eftate, right, title, truft, or intereft at law or in equity, of, in, to, or out of the faid capital meffuage, or farm-houfe, clofes, lands, hereditaments, and premifes, or any part or parcel thereof, fhall and will, from time to time, and at all times, from and after default shall happen to be made, of or in payment of the faid fum of pounds, or any part there

of, contrary to the form and effect of the aforefaid provifo, and covenant for payment of the fame, and the true meaning of thefe prefents, upon every reasonable request, and at the costs and charges of the faid G. G. his heirs, executors, adminiftrators, and affigns, make, do, and execute, or caufe to be made, done, and executed, all fuch further and other lawful and reasonable acts, deeds, conveyances, and affurances in the law whatfoever, for the further, better, more perfect, and abfolute granting, conveying, and affuring of the faid capital meffuge, or farm-houfe, clofes, lands, hereditaments, and premifes, with their appurtenances, unto, and to the use of the faid G. G. his heirs and affigns, freed and abfolutely difcharged of and from the faid Taft mentioned provifo or agreement, for redemption of the faid premifes, and all equity thereupon, as by the said G. G. his heirs, exècutors, administrators, or affigns, or his or their council learned in the law fhall be reasonably advised, devifed, and required; AND it is hereby declared and agreed, by and between the faid G. G. and E, E. that in the mean time, and until default fhall happen to be made of or in the payment of the faid fum of

pounds, or fome part thereof, contrary to the form and effect of the faid provifo and covenant for payment of the fame, and the true meaning of these prefents, it fhall and may be lawful to and for the faid E. E. and his heirs, peaceably and quietly to have, hold, and enjoy the faid capital mefluage or farm-houfe, clofes, lands, hereditaments, and premifes, and to receive and take the yearly rents and profits thereof, and of every part and parcel thereof, to and for his and their own ufe and benefit, without the lawful let, fuit, trouble, or interruption of or by the faid G. G. his heirs, executors, adminiftrators, or affigns, or any of them, or, of, or by any other perfon or perfons, lawfully claiming, or to claim by, from, or under them, or any of them; AND the faid A. A. doth hereby for himself, his heirs, executors, and administrators, covenant, promise, and agree, to and with the faid G. G. his heirs, executors, adminiftrators, and affigns, that he the faid A. A. hath not heretofore done or committed any act, deed, matter, or thing whatsoever, whereby, or by means whereof the premises, or any part thereof, is, are, fhall, or may be impeached, charged, or incumbered, in title, charge, eftate, or otherwife how foever : AND LASTLY, the faid E. E. doth hereby for himself, his heirs, executors, and adminiftrators, covenant, promise, grant, and agree, to and with the said G. G. his heirs, executors, adminiftrators, and affigns, that for fo long time as the faid principal fum of pounds, fo now lent and advanced by the faid G. G. on the fecurity of the faid capital meffuage, clofes, lands, hereditaments, and premises as aforefaid, or any part or parcel thereof (over and above the fum of. pounds) fhall remain due and owing thereupon, unto the said G. G. his executors, adminiftrators, and affigns, he the faid E. E. his heirs and affigns, fhall not, nor will (without the consent and approbation of the faid G. A. at his own proper coft and charge, AND WHEREAS the faid C. C. hath lately contracted and agreed with the faid A.
