and go along with the reverfion, freehold, and inheritance of the faid fourth part, now vefted in her the said M. B. in order to protect and preferve the fame from all mefne charges and incumbrances, if any fuch there be; and the faid A. A. doth hereby for himself, his heirs, executors, and adminiftrators, covenant, promife, and agree, to and with the faid N. N. and O. O. their executors, adminiftrators, and affigns, that he the said A. A. hath not at, any time heretofore done, committed, or wittingly, or willingly fuffered any act, matter, or thing whatfoever, whereby, or by means whereof the premifes mentioned, or intended to be hereby affigned, or any of them, or any part thereof, or the faid terin of three hundred years therein, is, are, fhall, or may be furrendered, forfeited, avoided, impeached, charged, or incumbered, in title, charge, eftate, or otherwife howfoever, (except fuch leafes of the faid premifes, or any part thereof, as are mentioned in the said schedule hereunto annexed) the rents, heriots, fines, duties, and services, referved, due, and payable, or to become due or payable, for, or in refpect of all which leafes, fhall, during the continuance thereof, refpectively be paid and become due and payable to the refpective perfon or perfons who for the time being fhall be entitled to the trufts and benefit of the faid hereby affigned term of three hundred years, of and in the premifes, according to their feveral and respective shares and interefts therein as aforefaid, [the like covenant from B. the other trustee mutatis mutandis]; and this indenture further witnesseth, that in confideration of the premises, and of the affignment hereby made, or mentioned to be made as aforefaid, the faid D. D. and at her requeft, and by her direction, and on her behalf, the faid T. T. her trustee, and alfo the said G. G. and H. his wife, J. J. and L. his wife, and M. B. have, and each and every of them, hath ratified, confirmed, and allowed, and by thefe prefents do, and each and every of them doth, ratify, confirm, and allow, all and every of the leafes of the premifes, or any part thereof mentioned and described in the faid fchedule hereunto annexed, subject nevertheless to the refpective rents, heriots, fines, duties, fervices, and covenants, in and by the faid leafes, refpectively referved and contained, and which on the part and behalf of the leffees of the premifes are, or ought to be paid, done, and performed, for or in refpect of fuch their faid refpective leafes: AND THIS INDENTURE FURTHER WITNESSETH, That the faid G. G. and H. his wife, J. J. and L. his wife, and M. B. do hereby acknowledge, teftify, and declare, that they refpectively have actually had, and received before the fealing and delivery of thefe prefents, of and from the faid A. A. and B. B. or one of them, or fome other or others of the faid trustees and executors of the faid C. B. all and every the refpective portions, legacies, and maintenance fo provided for, or given to them the faid H. L. and M. B. refpectively, in and by the faid first recited inden ture of release, and last will of the faid C. B. or either of them as aforefaid, and therefore, and in confideration thereof, they the faid G. G. and H. his wife, J. J. and L. his wife, and M. B. do hereby feveraily

rally and respectively acquit, release, and difcharge the faid A. A. and B. B. and each of them,. their, and each of their heirs, executors, and adminiftrators, and the executors and administrators of the faid C. B. of and from the faid refpective portions, legacies, and maintenance, and every of them, and every part thereof; and the faid D. D. and at her request, and on her behalf, the faid F. F. for her the faid D. D. her heirs, executors, and adminiftrators, and the faid G. G. and H. his wife, for themselves, and each of them, their, and each of their executors and adminiftrators, and the faid 7. J. and L. his wife, for themselves, and each of them, their, and each of their heirs, executors, and adminiftrators, and the faid M. B. for herself, her heirs, executors, and adminiftrators, in confideration of the premifes, do hereby remife, release, and for ever quit claim unto the said A. A. and the faid B. B. each of them, their, and each of their heirs, executors, and adminiftrators, and the executors and adminiftrators of the faid C. B. all, and all manner of action and actions, cause and causes of action, covenants, agreements, fuits, controverfies, differences, debts, duties, legacies, portions, maintenance, accounts, reckonings, fum and fums of money, and all other claims and demands whatsoever, both in law and equity, which they the faid D. D. G. G. and H. his wife, J. J. and L. his wife, and M. B. refpectively, or any other perfon or perfons on their respective accounts, or for their respective benefits, now have, or which they or any of them, their or any of their heirs, executors, and adminiftrators, at any time or times hereafter, can or may have, claim, challenge, or demand, against the faid A. A. and B. B. or either of them, their or either of their heirs, executors, or adminiftrators, or the executors or adminiftrators of the faid C. B. or any of them, for or by reafon or means of the premifes, or any of them, or for, or by reafon, or means of any other matter, caufe, or thing whatfoever, from the beginning of the world until the day of the date of thefe prefents; provided nevertheless that nothing herein contained fhall extend or be conftrued to extend to bar or hinder them the said D. D. G. G. and H. his wife, 7. J. and L. his wife, and M. B. refpectively, from having, taking, and enjoying their respective parts, fhares, and portions, of and in fuch, and fo much, and in fuch part and parts of the plate and household goods late of the faid C. B. as they are refpectively entitled unto, by virtue of his faid laft will, from and after the decease of the faid B. B. who, by virtue of the faid laft will, is to have and enjoy the fame for her life: AND WHEREAS it hath been agreed, by and between all the faid parties to these presents, that the faid recited indentures of leafe and release of the -, in the year aforefaid, fhall remain and continue in the hands and cuftody of the faid A. That the faid A. A. doth hereby for himfelf, his heirs, executors, and administrators, covenant, promife, and agree, to and with the faid F. F. G. G. and H. his wife, J. J. and L. his wife, and M. B. their heirs and affigns, that he the faid A. A. his executors and adminiftrators, fhall and will, at all time or times hereafter, at the requeft, costs, and charges of the faid D. D. G. G. and H. his wife, J. J. and L. his wife, and M. B. or any of them, their or any of their heirs or affigns, (unless hindered or prevented by fire, or other inevitable accident) produce and fhew forth, or caufe and procure the said indentures of leafe and release to be produced and fhewn forth unto them the faid D. D. G. G. and H. his wife, J. J. and. L. his wife, and M. B. or any of them, their or any of their heirs or affigns, or in any court of law or equity, or to any council or councils, agents, attornies, or folicitors, or otherwife, as occafion fhall be and require, for the better evidencing, maintaining, and proving the refpective titles of them the faid D. D. G. G. and H. his wife, J. J. and L. his wife, and M. B. their respective heirs and affigns, in and to their refpective parts and shares of and in the faid manors, lands, hereditaments, and premises, in the faid indentures comprifed, and not fold or conveyed away as aforefaid. Gent. for the confiderations therein mentioned, did grant and convey the capital mefluage, or farm-house, closes, lands, and hereditaments herein after granted, and releafed, or mentioned fo to be, with their appurtenances, unt and to the use of L. L. of &c. Efq; and O. L. of &c. Gent. their heirs and afiigns, by way of mortgage in fee, fubject to a provif in the faid indenture of release contained, for redemption of the premises, on payment of the fum ofpounds principal monéy, and intereft for the fame, at the rate of five pounds in the hundred by the year, by the faid H. H. his heirs, executors, or adminiftrators, unto the faid L. L. and O. L. their executors, administrators, or affigns, at a day therein for that purpofe limited, and long lince paft; AND WHEREAS

H. did grant, releafe, and convey, all and every the faid capital meffuage, or farm-house, closes, lands, and hereditaments, herein after granted and released, or mentioned or intended fo to be, with their appurtenances, unto and to the use of the faid A. A. his heirs and affigns, by way of mortgage in fee, fubject to a provifo in the faid laft mentioned indenture of release contained, for redemption of the premises, on payment of the sum of pounds, principal money, and intereft for the fame, at the rate of five pounds by the hundred by the year by the faid H. H. his heirs, executors, or adminiftrators, unto the faid A. T. and his heirs, of all the faid capital meffuage, or farm-houfe, clofes, lands, and hereditaments herein after granted, and released, or mentioned, or intended fo to be, with their appurtenances; which faid fine or fines, it was thereby declared fhould be and enure to the use of the faid A. A. his heirs and affigns for ever, fubject to the fame provifo for redemption, in the faid last recited indenture of releafe contained, as by the faid feveral recited indentures and fine, (which was duly levied in purfuance of the faid recited covenant in that behalf) relation being thereunto refpectively had, may more fully appear; AND WHEREAS pounds, or any part thereof, was not paid unto the faid A. A. at the day in the faid laft recited provifo for that purpose limited, nor at any time fince, but yet doth remain due and payable, by means whereof the faid eftate and intereft of the faid、 A. A. of and in the faid mortgaged premifes, have long fince become abfolute in law; AND WHEREAS by indenture of leafe and releafe, dated refpectively the day of which were in the year of our Lord the faid H. H. and S. his wife, for the confiderations therein mentioned, did abfolutely grant, convey, and affign, all and every the faid capital meffuage, or farmhoufe, clofes, lands, and hereditaments, herein after granted and releafed, or mentioned or intended fo to be, with their appurtenances, and the right and equity of redemption thereof, unto and to the ufe of the

A. A. in hand well and truly paid by the faid G. G. at or before the
fealing and delivery of these prefents, at the request, and by the di-
rection and appointment, and as the proper debt of the faid E. E.
(teftified by his being a party to, and his fealing and delivery of these
prelents), in full of all monies now due and owing to the faid A. A.
upon his faid recited mortgage and fecurity, the receipt and payment
of which faid fum of pounds accordingly he the faid A. A. doth
hereby acknowledge, and thereof, and therefrom, and of and from eve-
ry part thereof, doth acquit, release, and difcharge the faid G. G. and
E. E. and each of them, their and each of their heirs, executors, admi-
niftrators, and affigns, and every of them for ever by these presents:

known, together with all houses, out-houses, dove-houses, edifices,
buildings, barns, ftables, yards, gardens, orchards, backfides, and here-
