direct or appoint, in and by which faid recited indenture of release, it was (among other things) provided, that the faid last named truftees, and the survivors or furvivor of them, and the executors, administrators, and affigns of each furvivor, should and might, from time to time, after the decease of the faid C. B. until the inheritance of the premises should come unto, or be vefted in fome perfon or perfons, who fhould have attained his, her, or their age or ages of twenty-one years, make and grant fuch leafes of the premises, or any part thereof, as are therein in that behalf mentioned, being the like leafes as are herein after excepted; and it was thereby further provided, that the fame trustees, and the furvivors and furvivor of them should, out of the rents, iffues, and profits of the said premises, pay and difcharge all the juft debts of the said C.B. and it was thereby declared and agreed, that after the performance of the trufts aforefaid, the faid term of three hundred years should wait and attend on the inheritance of the faid premises, as by the faid recited indentures, relation being thereunto respectively had, may more fully and at large appear; AND WHEREAS the faid C. B. did, in and by his last will and testament, in writing, bearing date on or about the day of, which was in the year of our Lord , (among other things therein contained) give, devife, and bequeath, unto his faid daughter H. the now wife of the faid G. G. L. the now wife of the faid 7.7. and M. B. the fum of pounds each, to be raised by his faid truftees for them, over and above the aforefaid portions of - pounds a piece, and of his faid will made and appointed the fame trustees executors in truft, as by the faid in part recited will, relation being thereunto had, may (among other things therein contained) more fully and at large appear: AND WHEREAS the faid C. B. foon after the making of the faid recited will, departed this life without iffue-male, leaving iffue only his faid four daughters, the faid D. D. (his only daughter by his first wife) the faid H. wife of the faid G. G. the faid L. wife of the faid 7. 7. and the faid M. B. who is yet fole and unmarried; which faid H. D. L. and M. were his daughters by the faid B. B. his fecond wife, and have all fome time fince attained their age of twenty-one years: AND WHEREAS the faid S. S. one of the faid trustees, and executors in the faid recited indentures and will named, departed this life foon after the decease of the faid C. B. AND WHEREAS the faid P. 2, and R. R. two others of the faid trustees and executors, having refused to act in the faid recited truft, did, by indenture, bearing date on or about the day of, in the year of our Lord (in pursuance and obedience to a decree or decretal order of the High Court of Chancery, in the fame indenture recited or referred to), releafe unto the faid P. A. A. A. T. T. and B. B. all their eftates, rights, title, truft, claim, and demand, of, in, and to the faid premifes, comprised in the faid term of three hundred years, on the trufts, in the faid recited indenture of release, expreffed and declared: AND WHEREAS the faid P. A. and T. T. two other of the aforefaid trustees and executors, are fince alfo deceased, by reafon whereof the faid recited trufts and executor ship,

B. and the rents and profits of the faid truft eftate, or otherwife: AND WHEREAS by force and virtue of the faid first recited indentures, and of an act of parliament paffed in the— year of the reign of

(entitled an act &c.) and in order to the raifing of monies for payment and fatisfaction of all the reft and refidue of the faid portions, legacies, and maintenance of the faid daughters, not paid and fatiffied by the ways and means last above mentioned, they the faid A. A. and B. B. the faid furviving acting truftees and executors, together with H. H. of &c. Efq; and 7. 7. of &c. Efq; (the truftees for the inheritance in the faid act of parliament named) or fome of them, in purfuance and execution of the trufts in them refpectively repofed, have lately fold and conveyed away not only the refidue of the faid term of three hundred years, but alfo the reverfion, freehold, and inheritance, of and in fuch part and parcels of the faid truft eftate and premifes, as are next herein after particularly mentioned and defcribed, that is to fay, ALL that the faid farm commonly called or known by the name of now or late in the poffeffion of V. V. his affigns or under-tenants, and all that the faid moiety of one meffuage or tenement, commonly called or known by the name of aforefaid, now or late in the poffeffion of the faid X. X. &c. ALL which faid farms, meffuages, tenements, lands, hereditaments, and premises laft herein before particularly mentioned and defcribed, and fo fold and conveyed away as aforefaid, are part and parcel of the faid trust eftate, and premifes comprised in the faid first recited indentures: AND WHEREAS by and out of the monies arifing by fuch fale of the faid farms, meffuages, tenements, lands, hereditaments, and premises, fo fold and conveyed as aforefaid, and by and out of the rents and profits of the faid truft eftate and premifes, or otherwise, all the reft and refidue of the faid portions, legacies, and maintenance of the faid daughters of the faid C. B. (not before paid as aforefaid) are now fully paid and fatisfied, fo that all the trufts of the faid term of three hundred years are now fully performed: AND WHEREAS by indenture of leafe and releafe, the leafe bearing date the day next before the day of the date of these presents, and the release being tripartite, bearing date on or about the

D. or any other person or persons, in truft for her, was or were feifed of any estate or inheritance, at the time of her intermarriage with the faid E. D. in poffeffion, reverfion, remainder, or expectancy, and all other the Jands, tenements, and hereditaments, whereof the faid E. D. was then feifed, or whereunto he was then entitled, by force or virtue of one indenture tripartite, bearing date on or about the --- ། day of which was in the year of our Lord, therein recited, and the fines and recoveries in the fame indenture recited, or mentioned to have been levied, or fuffered, or any of them; and all the eftate, right, title, intereft, power, and powers of leafing, and renewing, and filling up of leafes, truft, property, claim, and demand whatsoever, both in law and equity, of him the faid C. D. junior, of, in, to, or out of the fame premifes, or any part of them, or any part or parcel thereof, TO HOLD unto, and to the ufe of the faid F. F. his heirs and affigns, for and during the natural life of the faid E. D. in truft nevertheless, to difpofe of the rents, iffues, and profits of the premifes, as the fame hould be received, unto fuch person or perfons, and for fuch ufes and purposes as fhe the faid D. D. notwithstanding her coverture, by any writing or writings under her hand, fhould, from time to time, direct or appoint, to the intent that the fame might not be at the difpofal, or fubject or liable to the controul, debts, or engagements of the faid E. D. her husband, but only at her fole and feparate difpofal; and in default of, and until fuch direction or appointment, to the proper hands of the faid D. D. or otherwife to permit and fuffer her to receive and take the fame, whofe receipt fhould, from time to time, be a fufficient difcharge to the perfon or perfons who fhould fo pay the fame to her; and on this further truff, to convey and difpofe of the fame premifes unto fuch perfon or perfons, and in fuch manner as fhe the faid D. D. by any writing or writings under her hand and feal, or by her laft will and teftament, in writing, or any writing, purporting to be her laft will and teftament, fhould direc or appoint; and in default of fuch appointment, to her right heirs, a's by the faid laft recited indentures, relation being thereunto had, may more fully and at large appear: AND WHEREAS the faid farm in aforefaid, or fome other parts or parcels of the faid truft eftate and premifes are now in jeinture to the faid B. B. for her life: AND WHEREAS in regard of all the faid debts and legacies of the faid C. D. and the faid portions, and the maintenance provided for his faid three younger daughters, are all now paid and fatisfied as aforefaid, whereby all the faid recited trufts of the faid term of three hundred years are now fully performed and difcharged,

B. to affign and transfer all the reft and refidue of the faid manors, farms, lands, tenements, hereditaments, and truft eftate, not fold and conveyed away for the purposes aforefaid, and the now refidue of the faid term of three hundred years therein, unto the faid N. N. and O. O. their executors, adminiftrators, and affigns, upon fuch trufs, and in fuch manner as are herein after mentioned, to which request they the faid A. A. and B. B. have agreed. NOW THIS INDENTURE WITNESSETH, That in confideration of the premifes, and in full performance and execution of the trufts repofed in them, the faid A. ▲. and B. B. in relation to the refidue of the said truft eftate, and the now refidue of the faid term of three hundred years therein, and in confideration of the fum of of lawful

money of Great Britain, to them the faid A. A. and B. B. in hand paid by the faid N. N. and O. O. at, or before the fealing and delivery of these prefents, the receipt whereof is hereby acknowledged, they the faid A. A. and B. B. at the request and by the direction, nomination, and appointment of the faid D. D. and F. F. her truftee, G. G. and H. his wife, J. J. and L. his wife, and M. B. teftified, by their being parties to, and their fealing and delivery of thefe prefents, have, and each of them hath, bargained, fold, affigned, tranfferred, and fet over, and by these prefents do, and each of them doth, bargain, fell, affign, transfer, and fet over unto the faid N. N. and 0.0. their executors, adminiftrators, and affigns, all and every the faid manors, farms, lands, tenements, hereditaments, and premises, in and by the faid first recited indenture of releafe, limited, or mentioned to be limited, to the faid trustees of the faid C. B. for the faid term of three hundred years, upon truft as aforefaid, (except and always referved out of these presents, and the affignment hereby made, or mentioned, or intended to be made, all and every the faid farms, meffuages, lands, tenements, hereditaments, and premifes, herein before particularly mentioned, and recited, to have been fold and conveyed away for the purposes aforefaid) and the reverfion and reverfions, remainder and remainders, arrears of rent, and fines, and all other rents, iffues, and profits of the faid hereby, or mentioned to be hereby affigned, manors, farms, meffuages, lands, tenements, hereditaments, and premises, and of every of them, and of every part and parcel thereof, (except as before excepted) and all the eftate, right, title, intereft, term of years yet to come and unexpired, truft, property, claim, and demand whatfoever, both in law and equity, of them the faid A. A. and B. B. and each and either of them, of, in, to, or out of the faid manors, farms, meffuages, lands, tenements, hereditaments, and premifes, or any of them, or any part or parcel thereof, by force or virtue of the faid first recited indentures, and laft will of the faid C. B. or any of them, (except as is herein before excepted), TO HAVE and TO HOLD the faid manors, farms, meffuzges, lands, tenements, hereditaments, and

O. their executors, adminiftrators, and affigns, from henceforth for and during all the rest and refidue yet to come, and unexpired, of the faid term of three hundred years therein (fubject to fuch leases of the premises, or any part thereof, as are mentioned in the fchedule hereunto annexed), upon fuch trufts nevertheless as are herein after mentioned and expreffed, of and concerning the faid premifes refpectively, that is to fay, as to, for, and 'concerning the faid farm of with the appurte

nances, and all fuch other parts and parcels of the faid hereby, or mentioned to be hereby, affigned premifes, as are now in jointure to the faid B. B. as aforefaid, in truft for, and for the only benefit of her the faid B. B. and her affigns, for and during fo much, and f● long time of the faid term of three hundred years therein as the fhall live, and as to the faid premifes, from and immediately after her decease, and as to all the reft and refidue of the fid manors, farms, meffuages, lands, tenements, hereditaments, and premifes mentioned, or intended to be affigned, with their appurtenances, from and immediately after the execution of thefe prefents, upon fuch trufts, and to and for fuch afes, intents, and purposes as are herein aftermentioned, expreffed, and declared, of, and concerning the fame; that is to fay, as to, for, and concerning one fourth part thereof, (the whole in four equal parts to be divided) in truft for, and for the only, fole, and feparate ufe and benefit of the faid D. D. her heirs and affigns, and to be difpofed of as the or they fhall, notwithstanding her coverture, direct or appoint, by writing under her hand and feal, and in the mean time to attend, wait upon, and go along with the reverfion, freehold, and inheritance of the faid 4th part, now vested in her the faid D. D. and the faid F. F. her trustee, or one of them, in order to protect and preferve the fame from all mefne charges and incumbrances, if any fuch there be, and as to, for, and concerning one other full fourth part thereof, in truft for, and for the benefit of the faid G. G. and H. his wife, to attend, wait upon, and go along with the reverfion, freehold, and inheritance of the faid fourth part, and be fubject to the ufes, trufts, and eftates thereof, limited, or agreed to be limited upon their intermarriage, or otherwife, in order to protect and preferve the fame from all mefne charges and incumbrances, if any fuch there be, and as to, for, and concerning, one other fourth part thereof, in truft, for, and for the ufe and benefit of the faid 7. 7. and L. his wife, and to attend, wait upon, and go along with the reverfion, freehold, and inheritance of the faid fourth part, and be fubject to the ufes, trufts, and eftates, limited, or agreed to be limited upon their intermarriage, or otherwife, in order to protect and preferve the fame from all mefne charges and incumbrances, if any fuch there be; and as to, for, and concerning the remaining 4th part thereof, in truft, for, and for the only use and benefit of the faid M.
