HIS INDENTURE made the

of the reign &c. BETWEEN A. B. of .. widow, of the one part; and R. T. of &c. Efq; of the other part; WHEREAS (here infert the name and defcription of the corporation) by their indenture under their common feal, bearing date the day of ——, which was in the year of our Lord for the confiderations therein mentioned, did, with one affent, demife, grant, and to farm let, unto the faid A. B. all that their rectory and parfonage of, in the faid county of -, together with the barn covered with tiles, and a garden plot called with the appurtenances; and alfo the tithes of all manner of corn, grain, and hay, and all other manner of tithes, belonging, or which of right ought to belong unto the faid church and parfonage of with the appurtenances, with free entry, egrefs, and regrefs, coming in, and going out, into and from the faid barn at both fides, at all times, and as often, and when neceffity and convenient occafion fhould be, (except unto the faid mafter, fellows, and fcholars, and their fucceffors, the advowfon and patronage of the vicarage of ——— aforefaid, with the courts and profits thereof, and the tithe corn and grain which hould be on the ground, which the vicar of then held of the faid mafter, fellows, and fcholars, in the parish and fields of aforefaid), to hold unto the faid A. B. her executors, adminiftrators, and affigns, from the Feast of St. Michael the Archangel, then laft paft tbefore the date hereof, for the term of YIELDING, PAYING, and DELIVERING therefore yearly, during all the faid term, un'o the faid mafter, fellows, and scholars, and their fucceffors, at the faid colledge, to the hands of their treasurer, at Lady-day and Michaelmas-day, by even and equal portions, as well the yearly fum of — pounds, of lawful money of Great Britain, as alfo bufhels, and pecks of good and quarters, bufhels and pecks of good and marketable malt made of barley; or for default of delivery of the faid wheat and malt, at the election of the faid A. B. her executors, adminiftrators, and affigns, to pay in lieu thereof, in manner aforesaid, fo much lawful money of Great Britain, after the raté and price as the best wheat and malt in the market of

Thould be fold the next market-day, before the faid rent of wheat and malt shall become due, without fraud and covin; in which faid recited indenture is contained, (among others) a PROVISO, that it should not be lawful for the faid B. her executors, administrators, and affigns, to alienate, affign, or make over, her faid leafe and term of years in the premises, or any part thereof, to any perfon or perfons whatfoever, without the licence of the faid mafter, fellows, and fcholars, or their fucceffors, to be had and obtained in fuch manner as therein is mentioned. NOW THIS INDENTURE WITNESSETH, That by force and virtue of the fpecial licence of the faid mafter, fellows,

B. granted by deed-poll, in writing under their common feal, bearing even date with the faid recited indenture; and for and in confideration of a competent fum of lawful money of Great Britain to the faid A. B. in hand paid by the faid R. T. at or before the fealing and delivery of these prefents, the receipt and payment whereof the the faid A. B. doth hereby acknowledge, and thereof, and of every part thereof, doth acquit, release, and discharge the faid R. T. his executors, administrators, and affigns, and every of them, for ever by these prefents, fhe the faid A. B. hath granted, bargained, fold, affigned, transferred, and fet over, and by these prefents doth grant, bargain, fell, affign, transfer, and fet over, unto the faid R. T. his executors, adminiftrators, and affigns, ALL the faid rectory and parfonage, barn, garden plot, tithes, hereditaments, and premifes, in and by the faid recited indenture of leafe, demifed or granted, with their and every of their appurtenances (except as in the faid recited indenture of leafe is mentioned to be excepted) and the reverfion and reverfions, remainder and remainders, rents, iffues, and profits thereof, and of every part and parcel thereof, and all the eftate, right, title, intereft, term of years yet to come and unexpired, truft, property, right, and benefit of renewal, claim, and demand whatfoever, both in low and equity, of her the faid A. B. of, in, to, or out of, the faid rectory and parfonage, barn, garden, plot, tithes, hereditaments, and premises, or any of them, or any part or parcel thereof, by force or virtue of the faid recited indenture of leafe, or otherwife how foever, together with the faid indenture of leafe, TO HAVE AND TO HOLD the faid rectory and parfonage, barn, garden, plot, tithes, hereditaments, and all and fingular other the premifes mentioned, or intended to be hereby affigned, with their and every of their appurtenances, (except as before excepted) unto the faid R. T. his executors, adminiftrators, and affigns, from henceforth for and during all the reft and refidue yet to come and unexpired of the faid term of years (fub ject to the rent and covenants in the faid recited indenture of leafe referved and contained, and which from henceforth are to be paid, done, and performed;) AND the faid A. B. doth hereby for herself, her heirs, executors, and administrators, covenant, promise, and agree, to and with the faid R. T. his executors, adminiftrators, and affigns, in manner following, that is to fay, that (for and notwithstanding any act, matter, or thing, by her the faid A. B. done, committed, or wittingly or willingly fuffered to the contrary) the faid recited indenture of leafe is a good and fufficient demife, and leafe valid in law, of and for the faid rectory and parfonage, barn, garden, plot, tithes, 'hereditaments, and premifes, mentioned or intended to be hereby affigned, not forfeited, furrendered, or otherwife avoided, or avoidable; AND ALSO, that fhe the faid A. B. (for and notwithstanding any fuch act, matter, or thing, as aforefaid, hath, at the time of the fealing and delivery of thefe prefents, in her felf good right, full power, and lawful and abfolute authority, to bargain, fell, and affign the faid rectory and parfonage, barn, garden plot, tithes, hereditaments,

and other the premises mentioned, or intended to be hereby affigned, with their appurtenances, to the faid R. T. his executors, administrators, and affigns, for all the now refidue of the faid term of

years therein; AND FURTHER, that it fhall and may be lawful to and for the faid R. T. his executors, adminiftrators, and affigns, from time to time, and at all times hereafter, during the continuance of the said term of years, peaceably and quietly to enter into, have, hold, occupy, poffefs, and enjoy the faid rectory and parfonage, barn, garden plot, hereditaments, and other the premifes mentioned, or intended to be hereby affigned, and to receive, and take the rents, iffues, and profits thereof, and of every part thereof, to and for his and their own ufe and benefit, for and during all the reft and refidue yet to come, and unexpired of the faid term of years therein, without the lawful let, fuit, trouble, or interruption of, or by the faid A. B. her excutors, adminiftrators, or affigns, or of, or by any other perfon or perfons lawfully claiming, or to claim by, from, or under, or in truft for her, them, or any of them, and that free from, and against all and fingular former and other grants, bargains, fales,' affignments, eftates, titles, troubles, charges, and incumbrances whatsoever, had, made, done, committed, or fuffered, or to be had, made, done, committed, or fuffered by the faid A. B. her executors, administrators, or affigns, or by any other perfon or perfons, lawfully claiming, or to claim any eftate, right, title, truft, or intereft, of, in, to, or out of the faid rectory and parfonage, tithes, and other the premifes mentioned, or intended to be hereby affigned, or any of them, or any part thereof, from, by, or under, or in truft for her, them, or any of them, (the rent and covenants in the faid recited indenture of lease referved and contained, and which are from henceforth to be paid, done, and performed, only excepted): AND MOREOVER, That the the faid A. B. her executors and adminiftrators, and all and every other perfon and perfons having, or lawfully claiming, or who fhall or may have, or lawfully claim any eftate, right, title, truft, or intereft, either in law or equity, of, in, to, or out of the faid rectory and parfonage, tithes, hereditaments, and other the premifes mentioned, or intended to be hereby affigned, or any of them, or any part thereof, from, by, or under, or in truft for her, them, or any of them, fhall and will, from time to time, and at all times hereafter, during the continuance of the faid term of years, on every reasonable request, and at the costs and charges in law of the faid R. T. his executors, adminiftrators, or afligns, make, do, and execute, or caufe to be made, done, and executed, all and every fuch further and other lawful and reasonable acts, deeds, and things, conveyances and affurances in the law whatfoever, for the further and better affigning and conveying of the faid rectory and parfonage, tithes, hereditaments, and other the premifés mentioned, or intended to be hereby affigned, with their and every of their appurtenances, unto the faid R. T. his executors, adminiftrators, and affigns, for and during all the reft and refidue which shall be then to come and unexpired of the faid term of years therein, as by the faid R. T.

R. T. his executors, adminiftrators, or affigns, or his or their council learned in the law, fhall be reafonably advised, devifed, or required, so as such further affurances contain in them no further or larger covenants in extent than are in these presents contained, and fo as the party or parties who fhall be requested to make fuch further affurances be not compelled or compellable for making or doing thereof, to go or travel above five miles from his, her, or their respective dwellings, or places of abode. Efq; of the third part; WHEREAS in and by certain indentures of leafe and releafe, bearing date refpective, ly, on or about the which was in the and made, or mentioned to be made, between the faid C. B. of the one part; and P. A. then of &c. Efq; deceafed, the faid A. A. party hereunto, by the name of A. A. fon and heir of the faid P. A. P. 2. of &c. R. R. of &c. Efq; S. S. then of &c. Efq; (fince alfo deceased) T. T. then of &c. clerk (fince also deceased) the faid B. B. then wife, and now the widow and relict of the faid C. B. of the other part; for the confiderations therein mentioned, the faid C. B. did grant, bargain, fell, releafe, and confirm, unto the faid P. A. A. A. P. Q, R. R. S. S. T. T. and B. B. and their heirs, ALL that farm commonly called, or known by the name then in the poffeffion of V. V. his affigns or undertenants, all that farm commonly called, or known by the name of in the parish of, then in the poffeffion of W. W. or his aligns, all that moiety of one meffuage or tenement commonly called, or known by the name of aforefaid, then in the poffeffion of X. A. P. 2. R. R. S. S. T. T. and B. B. for the term of his natural life, without impeachment of wafte, and from and immediately after his de-. ceafe to the ufe of the faid P. A. P. 2. R. R. S. S. T. T. and B. B. and the furvivor and furvivors of them, and the executors, adminiftrators, and affigns, of fuch furvivor, for the term of three hundred years, then next immediately following, fully to be complete and ended, for fuch trufts, ufes, interefts, and purposes, as are therein, and in part herein after expreffed and declared; the remainder to the heirsmale of the body of the faid C. B. and for default of fuch iffue, then. to the use and behoof of the daughters of the faid C. B. begotten,. or to be begotten; and for default of fuch iffue, then to the ufe and behoof of the right heirs of the faid C. B. for ever; in which faid in-. denture of releafe, the faid term of three hundred years is declared to be on the truft following, that is to fay, that they the faid P. A. A. A. P. Q. R. R. S. S. T. T. and B. B. the trustees in the fame indenture named, and the furvivors and furvivor of them, and the executors, adminiftrators, and affigns, of fuch furvivor, fhould, by and out of the rents, iffues, and profits of the faid premifes, and by leafing, mortgaging, or felling the fame, or any part thereof, for all or any part of the faid term, raife and levy the fum of pounds, to end for the ufe of the faid H. now wife of the faid G. G. (then H. B. the second. daughter of the faid C. B.) for her portion, and the fum of pounds, to and for the use of the faid D. S. now wife of the faid 7. 7. (then L. B. the third daughter of the faid C. B.) for her portion, and the fum of pounds, to and for the ufe of the faid M. B. the fourth daughter of the faid C. B. for her portion, to be paid unto them at their refpective ages of eighteen years, together with fuch maintenances for them in the mean time, as in the fame indenture are. for that purpose mentioned; and also should and might, by the like ways and means aforefaid, raife, levy, and pay, fuch fum and funis of money, for the refpective portion and portions, and maintenance of all and every other daughter and daughters, which the faid C. B. fhould at any time then after happen to have born, as were therein in that behalf mentioned and directed, and alfo fhould and might, by the like ways and means as aforefaid, raife, levy, and pay, all and every fuch further fum and fums of money to fuch perfon or perfons, and to and for fuch ufes, intents, and purpofes, as the faid C. B. by any deed or writing under his hand and feal, to be attested by two or more credible witneffes, or by his laft will and tettament in writing, fhould
