dents of ChriftChurch, may act without

fhall be in his own Right, or in Right of his Wife, in the actual Poffeffion or Receipt of Lands, Tenements, or Hereditaments, of the clear yearly Value of Forty Pounds, or poffeffed of, or intitled to, a perfonal Estate of Eight Hundred Pounds, under the Penalty in the faid Act contained:

For further Security against improper Perfons prefuming to act, It is bereby further Enacted, That from and after the paffing of this Act, no Perfon fhall be capable of acting as a Commiffioner in the Execution of the faid former Act or this Act, until he fhall have taken and fubfcribed an Oath before any Two or more of the faid Commiffioners, who are hereby authorized and required to adminifter the fame, and which Oath fhall be in the Words, or to the Effect following, that is to say:

JA. B. do fwear, that I truly and bona fide am in

my own Right, or in the Right of my Wife, in the actual Poffeffion and Enjoyment, or Receipt of the Rents and Profits of Lands, Tenements, or Hereditaments, of the clear yearly Value of Forty Pounds, above Reprizes, or poffeffed of, or intitled to, perfonal Eftate to the Amount of Eight Hundred Pounds; any Thing in the faid former A&t contained to the contrary notwithstanding.

Provided always nevertheless, and it is bereby Enacted and Declared, That all Perfons who have been or fhall be named or appointed by any College, or Hall, and all Members of the faid Univerfity appointed Commiffioners in or by Virtue of the faid former Act, or to be hereafter fo appointed, being Fellows of Colleges or any other Students of Chrift-Church, within the faid University, Qualifica fhall be to all Intents and Purposes Commiffioners for putting the faid former Act and this Act in Execution, in all Refpects, except fo far as relates to the Appropriation of the Tolls for the Amendment of the MileWays, Stone Bridge, and Avenues thereto, without proving any other Qualification, or taking the abovementioned Oath, any Thing in the faid former A&t or this Act, or in any other Law or Statute to the contrary in any wife notwithstanding.

And be it further Enacted, That all Penalties and Manner of Forfeitures by this Act impofed, the Manner of levying Recovering and recovering whereof is not hereby otherwise parti- plying Pecularly directed, fhall and may be levied and recovered nalties and in fuch Manner, and under the fame Powers and Forfeitures. Authorities, as by the faid former A&t is provided for recovering fuch Penalties and Forfeitures, and that one Moiety of the Money fo from Time to Time recovered, both under the Authority of the faid former Act, and of this Act, fhall, after deducting all Charges and Expences incurred in recovering the fame refpectively, be paid to the Informer or Informers, and the other Moiety to the Treasurer, or fuch other Perfon as the faid Commiffioners, or any Five or more of them, fhall appoint, to be applied towards the Purposes of the faid former Act, or this Act, on Account whereof the said refpective Penalties or Forfeitures fhall have been impofed and incurred.

And be it further Enacted, That all the Expences Expences incurred in and about procuring and paffing this Act of this A&t. shall be paid out of the first Money arifing by the Tolls

or Duties and Rates which fhall be collected by Virtue of this A&t.

And be it further Enacted, That all the Clauses, Former A&t Powers, Provifions, Regulations, and Authorities in-continued cluded in and granted or given by the faid former Act, except fuch as are hereby repealed, fhall, fubject to and under the Alterations made thereto by this Act, be, together with this Act, executed and put in Force, for the Purposes therein and herein mentioned and specified, in as full and ample a Manner as could or might be done, if both the faid Acts were but one Act.

And be it further Enacted, That this Act fhall be Publick deemed, adjudged, and taken to be a Publick Act, and fhall be judicially taken Notice of as fuch by all Judges, Juftices, and other Perfons whomfoever, without specially pleading the fame.
