CHAPTER 137.

AN ACT to repeal chapter 500 of the private and local laws of 1870, entitled "an act to perpetuate the Bayfield and Saint Croix Railway Company."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Chapter 500 of the private and local Repealed. laws of 1870, entitled "an act to perpetuate the Bayfield and Saint Croix Railway Company," is hereby repealed.

SECTION 2. All acts or parts of acts conflicting with, or in any manner contravening the provisions of this act, are hereby repealed.

SECTION 3. This act shall take effect and be in force from and after its passage. Approved March 25, 1872.

CHAPTER 138.

AN ACT to repeal section 19 of chapter 407 of the private and local laws of 1869, entitled "an act to incorporate the Bayfield and Saint Croix Railway Company."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section 19 of the private and local laws Repealed. of 1869, entitled "an act to incorporate the Bayfield and Saint Croix Railway Company," is hereby repealed. SECTION 2. All acts or parts of acts conflicting with, or in any manner contravening the provisions of this act, are hereby repealed.

SECTION 3. This act shall take effect and be in force from and after its passage. Approved March 25, 1872.

CHAPTER 139.

AN ACT to amend chapter 455, private and local laws of 1865, and chapter 253, private and local laws of 1870, and to prescribe further conditions upon which the Northern Pacific Railroad Company may construct and operate its railroad and telegraph line in this state.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Any consent heretofore given by the legislature of this state to the Northern Pacific Railroad Company to construct, operate and maintain a railroad and telegraph line in the state of Wisconsin, is hereby made subject to the further conditions, that the said Northern Pacific Railroad Company shall construct and forever maintain and operate to some point on the southwesterly shore of the Bay of Superior, between the Nemadji river and Conner's Point, a line of railroad, connecting with and continuous of the main line. of said Northern Pacific Railroad, by a route running south of St. Louis river from the junction of said Northern Pacific Railroad with the Lake Superior and Mississippi Railroad, intersecting the western boundary of Wisconsin at some point between the St. Louis and Nemadji rivers, and running thence all the way in Wisconsin between said rivers, and also shall construct and forever maintain, at some place where said railroad shall touch the said Bay of Superior, between the said Nemadji river and Conner's Point, sufficient docks or piers, suitable and convenient for the transfer of passengers and freight from its cars on said road to lakegoing craft, and from said craft to said cars. And also, shall establish and forever maintain at some place between the said Nemadji river and Conner's Point, a sufficient depot for the accommodation of passengers. And until the said Northern Pacific Railroad Company shall construct and operate such railroad to the southwesterly shore of the Bay of Superior as aforesaid, and shall so construct said docks or piers and the said depot, it shall not be lawful for the said company to construct or maintain or operate any other railroad in Wisconsin : provided, that the provisions of this section shall no

SECTION 2. CHAPTER 140.

AN ACT to amend chapter 474 of the private and local laws of 1866, entitled an act to reduce the act incorporating the city of Janesville," and the several acts amendatory thereof, into one act, and amend the same.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section 4 of said chapter 2 of said act Amended. is amended by inserting therein after the words, "remove

SECTION 2. Section 5 of said chapter 2 of said act is amended so as to read as follows: "Whenever a vacancy shall occur in the office of mayor or alderman, justice of the peace or police justice, after the commencement of the term of service and more than two months before the next general election of ward and city officers, such vacancy shall be filled by a new election, which may be ordered by the common council, and held within fifteen days after such vacancy shall occur. Any vacancy in either of the offices above named in this section, which shall not have been supplied by an election before the general election of ward and city officers next succeeding the happening thereof, may be supplied at such general election. Any vacancy happening in any other office shall be filled by the common council. The person elected or appointed to fill such vacancy shall hold his office and discharge the duties thereof for the unexpired term, and with the same rights and subject to the same liabilities as the person whose office he may be elected or appointed to fill."

SECTION 3. Section twelve of chapter three of said city treasurer. act is hereby amended so as to read as follows: The treasurer shall have power and perform the duties hereinafter prescribed, in the collection of taxes and assessments, and in addition thereto, have the same powers and duties, and be subject to the same liabilities as treasurers in towns, so far as said powers, duties and liabilities are not inconsistent with the provisions of this act, and shall receive for collecting all taxes and assessments levied by said city, and for all other services performed by him as treasurer of said city, such annual compensation or salary, to be paid quarterly as shall be fixed by the common council, on or before the first of March for the ensuing year, except for the year 1872, which salary shall not be increased nor diminished during his term of office; and all fees received by said treasurer as such treasurer, shall be paid into the treasury of and belong to said city, and constitute a part of the general fund. Section 17 of chapter 3 of said act is hereby amended by inserting therein, after the word, "report," the words, "under oath.”
