CHAP. 100.

AN ACT to provide for the erection of a new court-house, jail, clerk's and surrogate's offices in the county of Richmond.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The board of supervisors of the county of Richmond Money to be shall cause to be assessed and collected, in the same man- tax. ner as ordinary county charges are by law directed to be assessed and collected, the sum of ten thousand dollars, in five equal annual instalments, beginning with the year one thousand eight hundred and thirty-seven, for the purpose of building a new court-house, jail, clerk's and surrogate's offices in said county.

§ 2. The said board of supervisors are hereby authorized old buildings to sell the present court-house, jail, clerk's and surrogate's offices, and the lots on which they stand, in said county, at public auction, or otherwise, and convey the same, at any time they shall think proper after the passage of this act, and to pay over the proceeds thereof to the treasurer of said county, to be applied towards the payment of any loan which may be hereafter made by the said treasurer, or in fulfilling any contract made in relation to said buildings.

§ 3. Richard D. Little, Harman B. Cropsey and Walter Building Betts of said county, are hereby appointed commissioners to contract for and superintend the building of said courthouse, jail, clerk's and surrogate's offices; and in case either of the said commissioners shall die, resign or refuse to serve, the supervisors of the said county shall supply the vacancy; and a majority of such commissioners shall in all cases have power to act under this act.

§ 4. The said commissioners, before they shall enter up- To give on their duties enjoined upon them by this act, shall each of them enter into a bond, with security to be approved of by the treasurer of said county, in the penal sum of five thousand dollars to the supervisors of the said county, for the due and faithful performance of the trust reposed in them; and the said commissioners shall receive for their services two dollars per day, each, when actually employed in the duties of their office, and their accounts shall be audited by the board of supervisors, and paid as other contingent charges of the county.

shall certify to the treasurer of said county, that the whole amount contemplated by the first section of this act, or any specified proportion thereof, will be required for the fulfiiment of any contract made by them in the performance of their trust, it shall be the duty of the treasurer, and he is hereby authorized, to borrow on the credit of the county, the amount specified in said certificate, and to reimburse the sum, with annual interest thereon, out of the moneys to be collected or received by virtue of this act, as soon as the same shall come into his hands.

It shall be the duty of the said treasurer to report annually to the board of supervisors the amount of interest becoming due in such year, upon any loan which may have been made by virtue of the fifth section of this act, which amount shall be audited by the board, and paid as other contingent charges of the county are paid.

§7. The said commissioners shall have full power to draw upon the treasurer of said county, from time to time, for such moneys as may be required for the purposes contemplated by this act; and the said treasurer is hereby directed to pay over to them, or a majority of them, any moneys in his hands which may have been collected or received in pursuant of this act, exclusive of the amount collected for interest due upon loans.

8. The commissioners appointed by virtue of this act, shall at all times when required by the supervisors of the said county, account with them for the faithful expenditure of all the moneys received by them, or either of them, by virtue of this act.

§ 9. The said court-house shall be built upon a certain lot on a map of the property of Henry J. Seanan, of the village of Richmond, in said county, and designated as contemplated lot for a new court-house, and the two lots adjoining, or fifty feet to the east, as the said Henry J. Seaman shall convey and assure to the said county in fee simple, free of expenses.

10. This act shall take effect immediately on its passage.

CHAP. 101.

AN ACT to amend "An act to incorporate the Galway academy," passed May, 26, 1836.

Passed March 24, 1837. The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The capital stock of the said corporation is increased to the sum of twenty-five hundred dollars, with the

privilege of increasing the same to the sum of three thousand five hundred dollars, at any time within five years, to be divided into shares in the manner provided in the act hereby amended.

AN ACT amending the "Act relative to the bank fund," passed April 29, 1833.

The fifth section of the act entitled "An act relative Rate of to the Bank fund," passed April 29, 1833, is so far amended, as to authorize certificates of stock hereinbefore issued, or hereafter to be issued, under that section, to bear an interest, from and after the passage of this act, of five instead of four and one-half per cent.

CHAP. 103.

AN ACT to provide for the building of a new court-house in the county of Chenango.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The board of supervisors of the county of Chenan- Money to be go are hereby directed at their next annual meeting, and at tax. each successive annual meeting for the term of four years next thereafter, to cause in each successive year as aforesaid, to be assessed, levied and collected, the sum of one thousand four hundred dollars, making in all the sum of seven thousand dollars, upon the taxable property in said county, for the purpose of building a new court-house; which sum, when collected, shall be paid to the treasurer of said county. § 2. The said court-house shall be built of stone, on the Building public ground now belonging to said county, in the village of Norwich, or adjacent to said public ground if a more eligible site can be obtained without affecting the interest of said county in such public grounds and William Randall of Norwich, William Knowlton of Smithville, and Erastus Lathrop of Sherburne, are hereby appointed commissioners

to superintend the building of the same; and they, or a majority of them, are hereby authorized to fix and lay out the site, and determine upon the plan, form and manner of the construction of said court-house, and, as often as may be necessary, to draw for and receive the moneys appropriated and borrowed for the construction thereof; and to do all such other acts and things as may be necessary and proper to be done to complete the same.

§ 3. The said commissioners shall, before they enter upon their duties, give a bond to the supervisors of the said county, with sufficient sureties, to be approved by the first judge of the county courts of the said county, in a penalty of fourteen thousand dollars, conditioned for the faithful expenditure of the moneys committed to their charge for the purposes aforesaid; which said bond shall be filed by the said judge in the office of the clerk of the county aforesaid.

§ 4. The said commissioners shall be allowed the sum of two dollars per day each for their services in the actual performance of their duties under this act; such allowance to be audited by the board of supervisors, and paid as part of the contingent expenses of the county; and shall render annually an account of their proceedings and expenditures to the said board of supervisors, until they shall have fully executed their duties under this act.

§ 5. The comptroller is hereby authorized to loan to the county of Chenango, a sum not exceeding seven thousand dollars, out of any moneys now or hereafter in the treasury of this state belonging to the capital of the common school fund, on receiving from the treasurer of said county, a bond conditioned for him as treasurer, and his successor in office, to repay the said sum in five equal annual instalments, together with the annual interest on said loan, from the time it is made, at the rate of six per cent per annum; and which bond said treasurer is hereby authorized to make and execute.

6. The board of supervisors of said county, if the same principal to shall become necessary, shall cause to be levied, assessed and collected, in addition to the sums hereinbefore directed to be levied, assessed and collected, annually, a sum sufficient to pay the interest of the said sum so to be loaned; and it shall be the duty of the treasurer of the said county to pay the said sums of money hereinbefore directed to be levied, assessed and collected, together with the interest thereon, when so collected and paid to him, into the treasury of this state, to apply in payment of his said bond.

7. The said commissioners are hereby authorized, at any time when they shall deem it practicable and beneficial. to the county, to sell the present court-house for as large a sum as can be obtained therefor, and to pay the amount received by them on such sale to the treasurer of the said

county, to be by him applied to the purposes specified in this act, and in payment of his said bond or interest.

CHAP. 104.

AN ACT to authorize the Harmony manufacturing company to extend their capital.

Passed March 24, 1837.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The Harmony manufacturing company of Cohoes, Capital, in the county of Albany, are hereby authorized to extend $150,000. their capital to one hundred and fifty thousand dollars.

CHAP. 105.

AN ACT to incorporate the Utica young men's association.
Passed March 25, 1837.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The members of the Young Men's association for Corporation mutual improvement, in the city of Utica, and all persons created. who shall hereafter be associated with them, are hereby created a body corporate, by the name of "The Young Men's Association of the city of Utica," for the purpose of establishing and maintaining a library, reading rooms, literary and scientific lectures, and other means of promoting moral and intellectual improvement; with power for such purposes, to take by purchase, devise or otherwise, and to hold, transfer and convey, real and personal property to the amount of twenty thousand dollars; and also further to take, hold and convey, all such books, cabinets, library, furniture and apparatus, as may be necessary for attaining the objects, and carrying into effect the purposes, of the said corporation.

§ 2. The control and disposal of the funds, property and estate, and the direction and management of the concerns of the said corporation, shall be vested in an executive committee, to consist of the president, the first and second vicepresidents, the corresponding secretary, the recording secretary, the treasurer, and ten managers of the said corporation; who shall be elected annually to their respective offi
