TO AMEND THE PACKERS AND STOCKYARDS ACT

JULY 28, 1937

UNITED STATES SENATE,

SUBCOMMITTEE OF THE COMMITTEE ON

AGRICULTURE AND FORESTRY,

The subcommittee met, pursuant to call, at 10:30 a. m., in the caucus room, Senate Office Building, Senator George McGill (chairman) presiding.

Present: Senator McGill (chairman) and Senator Pope.
Present also: Representative Henry C. Luckey, of Nebraska.
Senator MCGILL. The committee will come to order.

First, we will incorporate a copy of the bill.

A BILL To amend the Packers and Stockyards Act, 1921, as amended

Be it enacted by the Senate and House of Repreesntatives of the United States of American in Congress assembled, That subsection (b) of section 301 of the Packers and Stockyards Act, 1921, as amended, is amended by inserting after the word "handling" the following: "(including loading and unloading for any carrier that is subject to the Interstate Commerce Act, as amended)". SEC. 2. Section 311 and subsection (a) of section 312 of such Act, as amended, are amended by inserting after the word "weighing", wherever such word occurs, a comma and the following: "loading, unloading".

SEC. 3. Subsection (a) of section 406 of such Act, as amended, is amended by inserting before the period the following: "except that the Interstate Commerce Commission shall have no jurisdiction with respect to stockyard services furnished by a stockyard owner or a market agency".

SEC. 4. All additional schedules of rates and charges required to be filed with the Secretary and to be published, by reason of the amendments made by this Act to the Packers and Stockyards Act, 1921, as amended, may be filed and published at any time within sixty days after the date of enactment of this Act.

SEC. 5. Nothing in this Act shall be construed to relieve any carrier of any obligation imposed by paragraph (5) of section 15 of the Interstate Commerce Act, as amended.

Senator MCGILL. The clerk of the committee has reports from the Interstate Commerce Commission, and also from the Department of Agriculture. We will incorporate also these two letters from the Interstate Commerce Commission covering the reports of that Commission on S. 2129, and the reports from the Department of Agriculture and Federal Trade Commission on the same bill. (The letters in question are as follows):
