CHAP. LXXXVIII.

An ACT for the better Extinguishing Fires in the Village of Cats Kill, in the
County of Albany.

E it enadled by the People of the State of New-York, reprefented in Senate
and inhabitants of the town of Cats Kill, having a right to vote at town
meetings, and refiding within the following limits, viz. Beginning at a
ftore of Samuel Haight, at the mouth of Vaffen Kill, where it enters into
the Cats Kill creek, thence following the faid Cats Kill as it runs erof-
fing the Flats until it ftrikes the channel of the Hudfon river, then fol-
lowing the channel until it ftrikes the north point of the Flats, then
northerly until it ftrikes the Vaffen Kill thirty chains above the ftore of
the faid Samuel Haight, then down the faid kill to the place of begin-
ning, to meet together at fuch place in the village of Cats Kill as the
trustees hereafter directed to be chofen fhall appoint, on the firft Mon
day in May in every year, and then and there proceed to choose by
ballot not less than three nor more than five truflees, to be called the
truftees of the fire company in the village of Cats Kill.
Trustees to nominate And be it further enatied, That the faid truffees to be
a fufficient number of chofen as aforefaid, or a major part of them, fhall have
power and authority to nominate and appoint a fufficient
number of firemen (willing to accept) not exceeding
fourteen to each fire engine now provided or hereafter to be provided
for the ufe of the faid village, out of the inhabitants being freeholders or
perfons renting tenements to the value of one hundred dollars per an-
num, to have the care, management, working and ufing the faid fire en-
gines, and the other tools and inftruments now or hereafter to be provi-
ded for the extinguifhing fires within the faid village, which perfons fo
to be nominated and appointed fhall be called the firemen of the village
of Cats Kill, who are hereby required to be ready at all fires as well by
night as by day, to manage, work and ufe the faid fire engines and
other tools and implements aforefaid.

Firemen exempted And be it further enacted, That each perfon fo to be nofrom ferving on ju minated and appointed a fireman shall during his contiries, or as conftaules. nuance in office be exempted and privileged from ferv ing in the office of conftable, and from being impannelled upon any jury or inqueft (except in the juftices courts within the faid village) and for this purpote the name of each fireman to be appointed by virtue of this act fhall be entered with the clerk of the town of Cats Kill, and his certificate fhall be fufficient evidence in all courts and elsewhere of fuch exemption and privilege; and further that the faid trustees, or a major part Trufters may remove of them, fhall have power from time to time to remove an appoint others in any firemen fo to be appointed and others to appoint in their places, &c. the ftead of thofe removed when and as often as they fhall think proper, and further that it shall be lawful for the faid trustees or a major part of them, to make, establish and ordain fuch rules and regulations for the government, duty and behaviour of the perfons fo to be appointed firemen as aforefaid, in the working and frequent using and trying the faid fire engines, tools and inftruments, and to impofe fuch reafonable fines and penalties; not exceeding three dollars for any one

offence upon fuch firemen or any of them for default in not performing the duties hereby to be enjoined or required from them, as they from time to time may think proper.

And be it further enacted, That upon the breaking out of a fire to repair to the any fire within the faid village, that the truftees aforefaid and the conftables of the faid town of Cats Kill, together with the juftices of the peace then being prefent in faid village, on notice thereof, fhall immediately repair to the place where fuch fire shall happen, with flaves and fuch other badges of authority as fhall be ordained by a majority of them to be worn, and be aiding and affifting as well in extinguishing the faid fires as in preventing any goods from being ftolen, and alfo in removing and fecuring the fame, and in the execution of the duties required of them by this act, and it fhall be the duty of such juftices of the peace, if any fhall be prefent, and they are hereby authorifed to command the affittance of all and every of the able bodied inhabitants of faid village, whofe duty it fhall be to obey and execute all orders and directions of the trustees and magistrates aforefaid in extinguifhing faid fires, removing and fecuring of the goods, providing water for the engines, and affifting the firemen in working the fame.

And be it further enacted, That it fhall be lawful for the trustees aforefaid, or a major part of them, to direct and require the inhabitants or owners of dwelling houfes and other buildings in faid village to provide themfelves with fuch and fo many fire buckets, to be ready in fuch houfes and buildings for the purpose of extinguishing fires, and to impose such reasonable fines and penalties for difobedience thereof as they fhall think proper, not exceeding five dollars for each bucket which thall be neglected to be furnished as aforefaid.

And be it further enacted, That all fines incurred and adjudged to be levied by the truttees aforefaid, fhall be recovered by any one of the trustees aforefaid in his own name, before any juftice of the peace in the fame county, with costs of fuit, to be reported to faid board of trustees, and appropriated by a majority of the fame for the purpofe of procuring and keeping the fire engines and other inftruments necefiary for the extinguifhing fires in the faid village of Cats Kill.

CHAP. LXXXIX.

An ACT for the Relief of William Moulton.

Paffed the ift of April, 1797. DE it enacted by the People of the State of New-York, reprefented in Senate Dand Affembly, That it shall and may be lawful for the commiffioners of the land office and they are hereby required to grant letters patent to William Moulton, for the like quantity of unappropriated lands in the tract fet apart for the ufe of the line of this ftate ferving in the army of the United States, and in the fame manner as has been granted to officers of the rank of lieutenant ferving in the line of this itate.

An ACT concerning the Salt Springs in the County of Onondaga.

Paffed the it of April, 1797. E it enasted by the People of the State of New-York, reprefented in Senate and diffembly, and it is hereby enacted by the authority of the fame, That it fhall be lawful for the furveyor general of this fate, and he is hereby directed and required as foon as may be after the paffing of this act, to caufe fuch part of the lands and marth adjoining to the falt lake in the county of Onondaga as are comprehended in the following defcription, to wit, of lots number eleven, twelve, thirteen, fourteen, -fifteen, twenty-eight, twenty-nine and thirty, being part of the lots referved by law for the ufe of the falt fprings, and alfo the lands adjoining the faid lake on the north fide of lots number eleven and fourteen, andextending from the points where the north lines of the faid lots number eleven and fourteen touch the lake down the lake forty chains on a straight line and extending back to a diflance not exceeding ten chains, to be laid out into lots not exceding ten acres, in fuch manner as may be moft convenient and beneficial for the manufactories already or hereafter to be erected on the lots and tracts above described: Provided, That no lot fhall contain more than five acres of the marth, except fuch part of the tract within the defcription aforefaid, as he may deem beft fuited for the fite of fuch ftarehoufe as is herein after directed to be erected; and to caufe a map thereof to be made, on which the lots fhall be numbered, and to file one copy thereof in the office of the fecretary of the ftate, and another copy in the office of the clerk of the county of Onondaga, keeping the original in his own office.

Surveyor general to And be it further enaded, That it shall be the duty of attend fuch furvey the furveyor general to attend the making of fuch furvey in perfon, and that he fhall as foon as may be after the furvey is commenced, give notice of this act to the occupier of each of the falt works already erected, and as foon as the furvey is completed it shall be lawful for the furveyor general for and in behalf of the people of this flate to make and execute a leafe of each of the faid lots upon which there are now falt works erected, for the term of three years, upon the following terms and conditions, that is to fay: that for every kettle or pan now ufed or to be ufed in the manufacturing of falt on the faid premifes, the leffee fhall caufe at least ten bushels of falt to be made on the premifes fo leafed to him every year during the faid term, and pay as a rent for the fame premifes four cents for every bufhel of falt made thereon during the faid term; and ifthe fpring or fprings on any of the faid lots fhall yield more water from which falt can be extracted than is fufficient for the manufactory established or to be established on fuch lot,it fhall and may be lawful for the leffees of any of the adjoining lot or lots to lead the furplus water to his or their manufactory, and if fuch furplus fhoud exceed the quantity required for the manufactories on fuch adjoining lot or lots the fecond furplus may be led to the next adjoining lots, and fo fucceffively from one lot to the other until fuch furplus fhall be exhaufted; and ifany controverfy fhall arife in the premifes, the fuperintendant fhall interpofe and determine the fame between the parties in conteft, and his determination fhall be final and conclufive. And that fuch leffee, his executors, adminiftrators or affigns fhall not at any time directly or indirectly ask, de

mand or take more than fixty cents a bufhel for any falt to be made on the faid premises, and that no falt thall be fold on the leafed premifes, but all the falt made on the faid premifes fhall by the maker or proprietor thereof be put into barrels or cafks, upon each of which his name and the quantity of falt contained therein fhail be branded, and then the fame fhall be de livered to the fuperintendant of the falt works at the ftore or ftores mentioned for that purpofe in this act, to be by him stored therein until the fame shall be fold; and that fuch lefiee, his executors, adminiftrators of aigns, fhall not cut any timber or wood on any land belonging to the people of this ftate for the ufe of the falt works, or for any other purpose, except fuch as the faid fuperintendant fhall from time to time permit and allow, and that a claufe be inferted in every fuch leafe that in cafe of the breach or non-performance of any of the faid conditions or articles fuch leafe thall become void.

And be it further enacted, That if the occupier of any falt works already erected on any fuch lot fhall not within eight days after fuch map fhall be filed in the of fice of the clerk of the county of Onondaga as aforefaid, acceptand take fuch leafe thereof as aforefaid, then it shall be lawful for the furveyor general, and he is hereby directed to leafe every fuch lot upon the terms and conditions aforefaid, to the highest bidder at a public vendue to be held as herein after mentioned, that is to the perfon who will give the higheft yearly rent for the fame over and above the faid four cents for every bushel of falt made thereon. And the furveyor general hall as foon as may be after the expiration of the faid eight days caufe a notice to be affixed up at fome public place at or ed time is expire (far- near the faid falt fprings, that at a certain day to be mentioned therein, not less than ten weeks after the date a certain day leafe.&c. thereof, the faid lots, if any, together with ten of the other lots upon which there are no falt works erected, will be leafed according to the directions of this act, to the highest bidder, at a public vendue, at the city hall of the city of Albany; and fhall caufe a copy of the fame notice to be published in the newfpaper printed at Whitestown, and in one of the newspapers printed in the city of Albany, and in the newfpaper printed by the printer to this ftate in the city of New-York, and at the day mentioned in the faid notice he hall fet up each of the faid lots at public vendue, and leafe the fame to the highest bidder, and make and execute leafes for the fame upon the terms and conditions aforefaid, with a claufe for fecuring the payment of the additional rent yearly to the fuperintendant of the falt works for the time being, for the ufe of the people of this ftate, but omitting in the leafes of the lots upon which no falt works are erected, the provision in the claufe requiring the lefee to make a certain quantity of falt every year, and inferting inftead thereof a claufe that fuch leffee, his executors, adminiftrators or affigns thall within one year after the date of his leafe, erect proper works on the premises fo leafed to him for making falt, and fhall thereafter caufe at least five hundred bushels of falt to be made at fach works every year.

Any o cupait re fu- And be it further enalted, That if any occupant of any his lot may remove he manufactory already erected on any of the lots to be laid Redles, furniture, ær. out agreeably to this act, fhall refate or neglect to take a belonging to his filt leafe for fuch lot on the terms and conditions contained in this aft, it fhall then be lawful for fuch occupant to take out and remove the kettles, furniture and implements incident to the manufactory of ialt, and the fuperintendant and furveyor general fhail in every inch cafe eftimate and appraise the value of the buildings in which fuch manufactory has been profecuted, and having determined the fame, thall certify the amount of the appraised value in favor of each of fuch occupants to the comptroller of this itate, who shall thereupon direct payment out of any monies in the trealary unappropriated. Governor and council And be it further enacted, That a fuperintendant of the of appoutine it to ap falt works thall be appointed by the perfon adminiftering the government of this ftate for the time being, by and with the advice and confent of the council of appointment, who fhall hold his office during the pleasure of the laid council, and who shall refide at or near the laid falt fprings, and who shall have no intereft therein, and whofe dny it fhall be to receive and itore the falt made at the faid falt works, and brand his name and the year when made on each cafk, and to deliver the fame to the refpective owners thereof as they fell the fame, upon their paying to him the faid rent and one cent upon each Superintendant to take bufhel for ftorage, always taking care to keep in ftore a care to keep alwaysin due quantity of the falt made at each of the faid works, fo the fore at ka 2000 that there may be at least two thousand bufhels in store from and after the first day of October next until the expiration of one year from the date of fuch leafe as aforefaid, and that annually thereafter there fhall be an annual increase of five hundred bufhels, to be keptatall times in the faid ftore, for the fupply of the citizens of this ftate who depend upon getting their falt from the faid works, which quantity fhall be coinpofed of the falt made at the feveral manufactories in proportion to the number of kettles or pans employed in each feparate And if it shall happen manufactory. And if at any time in any year there fhall any year, that there not be daily made at the faid falt works a fufficient hallnotadly be made quan a fufficient quantityto tity of falt for the fupply of the citizens of this ftate who Phy the citizens, depend upon getting there falt at the faid works, then and in every fuch cafe it fhall be lawful for the said fuperintendant, and he is hereby required to fell to every fuch citizen fuch quantity of the falt fo referved as may be neceflary for his own ute at the price aforefaid, and fhall pay to the owner or owners of the falt fo fold fifty-five cents for every bushel fo fold, being at the rate of fix:y cents a bufhel, including the faid rent and ftorage: Provided always, That if any lefee fhall have a proper ftore of his own near the falt works he fhall occupy, and fhall fit and appropriate the fame, or fome convenient part thereof for the reception and floring of the falt made by him, and fhall deliver the keys thereof to the faid fuperintendant fo that he may have the care and cuftody thereof in the fame manner as of the faid public ftore, then and in every fuch cafe the faid fuperintendant fhall ftore and keep the falt made at fuch falt works, in such store of the owner of fuch falt works, in the fame manner as in the public ftore, and in fuch cafe fuch owner fhall not be chargeable with any forage.
