WHEREAS the nines, directs the tract of land to be granted in

pursuance thereof to be laid into a number of lots correfpondent to the number of shares in the faid at defcribed with intent to grant the faid lots in feveralty, to the perfons respectively intitled to fuch fhares, but no mode of defg ating the lots to be granted as an equivalent for fuch fhares respectively is prefcribed by the faid act: Therefore,

BE it enacted by the People of the State of New-York, reprefented in Senate and Affembly, That it fhall and may be lawful for the commiffiorers of the land-office to caufe the lots into which the faid tract has been divided by the furveyor general, to be ballotted for in their prefence, in fach mode as they shall deem beit calculated to make a fair and equal divinon thereof to and among the feveral perfons refpectively named in the faid act, in proportion to their feveral interefts in the faid act, as particularly defignated in the faid act, and to caufe letters patent to be iffled to the perions named in the faid act for the lots drawn to their shares refpectively on fach ballot, in the mode prefcribed in and by the faid act; and that in cafe of the death of any of the perfons named in faid act as entitled to any part of the faid tract before fuch letters patent fhall be iffued, the fhare or fhares of the perfons fo dead shall in like manner be granted to his or their heirs or affigns.

CHAP. XXVII.

An ACT Supplementary to the Act, entitled," an A for the Relief of Wilhem Willink, Nicholas Van Staphorst, Chriftian Van Eeghen, Hendrick Vollenhoven, Rutger Jan Schimmelpenninck and Peter Stadniski being Alie 18. Paffed 24th February, 1797.

E it enacted by the People of the State of New York, reprefented in se late entitled,An act for the relief of Wilnem Willink, Nicholas Van Straphort, Chriftian Van Eeghen, Hendrick Vollenhoven, Rarger Jan Schimmelpenninck and Peter Stadniki, being aliens," fhall be conftrued and taken to extend as well to lands within this hate for the purchase of which any of the faid fix perfons had contracted and paid before the paffing of the faid act, and which at the time of the paffing thereof were holden in truft for one or more of the faid fix perfons, lefs than the whole, and to lands then holden in truft for Jan Willink, Jacob Van Stap norit, Nicholas Hubbard, Peter Van Eeghen, Ifaac Ten Cate, Jan Stadniki nd Aernout Van Beeftingh, or any or either of them, together with the faid fix perfons or fome of them, as to lands which were holden in trust for the faid fix perfons collectively, and to the heirs or devifees of the faid perfons or of any of them fubject always to the conditions and re

Ei enaked by the People of the State of New-York, reprejented in Senate B and fembly, That from and after the first Monday of April next, Patore town of all that part of the town of Cherry Valley, beginning Verected on the eat bank of Lake Otfego, at the fouthwest corA W ten by Sprig ner of a petent granted to Joan Groefbeek and others, down and running easterly and northerly along the bounds of the faid patent, to the northeast corner thereof, then welderly along the north bounds thereof, and the fame line continued to the county of Herkemer, then foutherly along the eaft bounds of the And county, and the eaft bounds of the town of Otfego, to Lake Cuego, then easterly and foutherly along the waters thereof, to the place of beginning, fhall be and hereby is erected into a town by the name of Spingfield; and that the firft town meeting be held at the meeting house in the fald town. That all that part of the town of Cherry Valley, beginTown of Cheir Val ning at the mouth of the Adequatangie, or Charlotte en by the name of Creek, and running along the northerly bounds of the Worcester and firft town of Kortwright and Harpersfield to the county of Schoharie, then northerly along the bounds thereof to the fecond allotment of the tract of land called the Belvi4e patent, then weft along the fouth bounds of the faid allotment to a

patent granted to Alexander Mc. Gee and others, then northerly along the eaft bounds thereof to the northeast corner of lot number two in the faid patent, then wefterly along the north bounds thereof and the fame line continued to the town of Middlefield, then foutherly and wefterly along the caft and foutherly bounds thereof to the town of Suffrage, then foutherly along the fame to the place of beginning, fhall be and hereby is erected into a town by the name of Worcester, and that the first town meeting in the faid town be held at the houfe of Silas Crippen. That the remaining part of the town of Cherry Valley be and torn to be called remain a town by the name of Cherry-Valley; and that the first town meeting in the faid town be held at the the faid town.

And be it further enaded, That the freeholders and inhabitants of each of the refpective towns hereby erected fhall be and hereby are empowered to hold town meetings, and elect town officers, as the freeholders and inhabitants of any town in this State may by law, and that the freeholders and inhabitants of each of the faid towns refpectively, and the town officers by them elected, shall have the like powers and privileges, and be subject to the like regulatious and penalties as the freeholders, inhabitants and town officers of the other towns in this State are entitled and íubject to by law.

And be it further enacted, That the town of New Hempstead in Orange Names of towns in County, fhall hereafter be called, known and diftinguishOrange county alter ed by the name of Hemilead, and the town of New Cornwall fhall hereafter be called, known and diftinguifhed by the name of Cornwall, any law, ufage or cuftom to the contrary notwithstanding.

An ACT to erect part of the Town of Palatine into two new Towns. Paffed 3d March, 1797. E it enacted by the People of the State of New-York, reprefented in Senate and Affembly, That all that part of the town of Palatine, in the Part of the town of County of Montgomery, included within the following Palatine in Montgo boundaries, to wit: Beginning on the weft fide of the Eaft Canada creek, where it empties into the Mohawk the name of Man river, thence weiterly up faid river to the divifion line between the counties of Montgomery and Herkemer, thence north along the fame until an eaft line or courfe ftrikes the northweft corner of a large lot number fourteen in a tract of land called Glen's purchase, thence easterly to the northeast corner of Glen's purchase, thence eaft to faid Eaft Canada creek, thence foutherly along the fame to the place of beginning, fhall be and hereby is erected into a town by the name of Manheim. And that part of faid town of Palatine bounded fouth by faid town of Manheim, weft by the county of Another part of fad town erected in. And be it further enacted, That as foon as conveniently may be after Por of laid towns electing town officers in each of the reípective towns ahow to be apportion foresaid, the fupervifors and overfcers of the poor of the remaining part of the town of Palatine, and of each of the other towns atorelaid, thall meet at the house of John Baker, innholder, in the faid town of Palatine, by notice to be given for that purpofe by the supervitor of the town of Palatine, at least ten days before the time of meeting, and apportion the poor maintained by faid town of Falatine previous to the divifion thereof. between the aid former town and the towns hereby erected in an equitable manner; and if the fuperviors and overteers of the poor cannot agree upon fuch divifion of the poor as aforeland, then and in fuch cate the fupervitors of the county of Montgomery, fhall, at their next meeting thereafter, apportion and divide the poor maintained as aforelaid, in fuch manner as fhall appear to them just and equitable, and the laid towns thereafter thall respectively main their own poor

CHAP. XXX.

An ACT for raifing a further Sum of Money for repairing the Court-bouse and
Gaal in the County of ilerkemer.
Paffed 4th March, 1797.

WHEREAS the fupervifors of the county of Herkemer have reques

ed that a further fum of money be directed to be raised on the inhabitants of the faid county, to repair the court-house and gaol of faid County: Therefore,

BE it enacted by the People of the State of New-York, represented in Senate and Afembly, That the fopervifors of the county of Herkemer be, and they are hereby authorifed and required to direct to be levied and raised on the freenolders and inn.bitants of the faid county, the fum of feven hundred and twenty dollars, with an additional fum of five cents on the dollar for collecting the fame, which fum fhall be railed, levied and collected in like manner as the other neceffary and contingent charges of the said county are by law levied and collected.

And be it further enacted, That the faid fum of feven hundred and twenty dollars, fhall be colle&ed and paid into the treatury of the faid county, on or before the first day of October next; and the treafurer of the faid county is hereby required and directed to pay the mid fum of feven hundred and twenty dollars to the order of the commioncis appointed or to be appointed to repair the faid gaol, retaining in

his hands the fum of one cent on the dollar for receiving and paying out the fame.

And be it further enacted, That the faid commiffioners fhall account with the fupervitors of the faid county for the money fo by them to be receiv ed and expended for the purpoies aforefaid, when thereunto required.

CHAP. XXXI.

An ACT for erecting a public Building in the County of Albany, and for other purposes therein mentioned. Paffed 10th March, 1797.

E it enacted by the People of the State of New-York, reprefented in Senate and Ajembly, That Philip Schuyler, Abraham Ten Bioeck, Jeremiah Van Renfelder, Daniel Hale, and Teunis Ts. Van Vechten, be and they are hereby appointed commiffioners to fuperintend the erection of a fuitable building for the purpofes herein after mentioned, on fuch ground lying in the city of Albany as the corporation of the faid city may hereafter convey to this itate as a donation for that purple, or on fuch other ground lying within the limits of the faid city of Albauy, as the faid commiffioners by and with the confent of the perfon administering the govern ment of this ftate for the time being may for that purpo.e provide; and if no convenient ground can be obtained within the limits of the faid city at a reasonable price whereon to erect fuch building, then to erect the fame on fuch part of the lot of ground, purchased for to be erected. the use of the people of this ftate by the commisboners appointed by law to erect a ftate prifon in the county of Albany, as the coinmiffioners herein named, by and with the confent of the perfon adminiftring the government of this ftate, for the time being, hall deter mine on; which building fhall be fo conftructed as to contain commodious, fecure, and fufficiently extenfive apartments for the fafe keeping of all the records, books, papers, and other things belonging or in any wife appertaining to the office of the fecretary ofthis ftate, and for the ill es oftare, to the office of the clerk of the supreme court; and fuch tary offa, dok of other public papers as the legiflature may from time to and te pop rs wich time direct to be depofited therein; and fuch building dirt to be depofited fhall contain fuch additional apartments as may be requifite for offices for the fecretary of this ftate, and for an office for a clerk of the fupreme court. Provided always, That Prov f. Expente pot the expence of fuch building, including the expence of lars including lot, and fuch lot, and including the expence of the materials, fhall not exceed ten thousand dollars.
