CHAP. III.

An ACT to raise a fum of Money for completing the Court-House and Gaol
in Kings County.
Paffed 7th December, 1792.
HEREAS the judges and fupervisors of Kings county, have, by

W their petition, requested the legislature, to enable them by law, to

raife a fum of money for completing of the court-house and gaol of the faid county; Therefore,

1. Be it enacled by the people of the fate of New-York, reprefented in fenate and affembly, That the fupervisors of the feveral towns in the faid county, for the time being, or the major part of them, shall be, and rect the railing 300l. they are hereby authorised and required to direct to be raised and levied on the freeholders and inhabitants of the faid county, a fum not exceeding three hundred pounds, for completing the court-house and gaol of the faid county, with the additional fum of nine pence in the pound for collecting the fame, which faid fums fhall be raised, levied and collected, in the like manner as the other neceffary and contingent charges of the faid county are levied and collected.

II. And be it further enacted, That the fupervifors of Kings Supervifors when county, or the major part of them, fhall meet at the house and where to meet. of James Van Buren, in Flat-Bush in the fame county, on the third Tuesday of December, in the prefent year, for the purpofe of directing fuch fum as they fhall order to be raised for the purposes aforefaid, together with the poundage for collecting the fame, to be raised and levied, and it is hereby made the duty of the clerk of the fupervisors of the county, to notify the said supervisors of fuch meeting.

III. And be it further enacted, That the fum fo to be raised, exclufive of the collectors poundage, fhall be collected and paid into the treafury of the faid county, on fuch day or days, as the fupervisors of the faid county for the time being, or the major part of them, shall direct.

IV. And be it further enaded, That it fhall and may be lawful for the treafurer of the faid county to retain in his hands the fum of three-pence in the pound, for his trouble in receiving and paying out the monies directed to be raised by this act.

V. And be it further enaded, That it shall and may be Treafurers duty in lawful for the treasurer of the said county, to pay to the paying faid monies to the commiflioners. commiffioners, appointed to erect and build the faid courthouse, from time to time, fuch part of the monies to be raised and collected in and by virtue of this act, as they fhall draw for, to be accounted for in the fame manner as the monies directed to be raised in virtue of the act, entitled, An act for building a court-house and gaol in Kings county, paffed the tenth of March, one thousand seven hundred and ninety-one, are to be accounted for.

An ACT to cede the Jurifdiction of certain Lands on Montock-Point, to the
United States of America, for the Purposes therein mentioned.
Paffed 18th December, 1792.

WHEREAS by an act of the congress of the Uniteit States of Ame

rica, entitled, An act to erect a light-houfe on Montock-Point, in the

ftate of New-York, paffed the 12th day of April, 1792, it is enacted and declared, That as foon as the jurifdiction of fuch land on Montock-Point, in the state of New-York, as the Prefident of the United States fhall deem fufficient and moft proper for the convenience and accommodation of a light-house, shall have been ceded to the United States, a light-house may be erected thereon. And whereas, it is meet and proper that fuch ceffion fhould be made under certain limitations; Therefore,

Be it enacted by the people of the fate of New-York, reprefented in fenate and affembly, and it is hereby enacted by the authority of the fame, That the Jarifdiction of Mon. jurifdiction in and over all that certain tract of land at tack-Point, ceded to Montock-Point, in the county of Suffolk, within this state, the United States. and herein after particularly defcribed, fhall be, and hereby is ceded to the United States of America, for the purposes aforefaid: Provided nevertheless, that fuch jurifdiction fo ceded as aforesaid, shall not extend, or be conftrued to extend, so as to impede or prevent the execution of any process at law under the authority of this flate, except fo far forth, as fuch process may affect any the real or perfonal property of the United States, within the faid tract, and that all the lands and tenements within the faid tract, fhall be, and forever hereafter are exonerated and discharged from any taxes which may be laid under the authority of the legislature of this ftate, and the tract of land above mentioned, in and over which the jurifdiction is fo ceded as aforefaid, is more particularly known by the name of Turtle Hill, and is butted and bounded as follows, to wit: Beginning at the beach and at a rock laying on a hommock at the bottom of the faid hill, and runs thence north, eighty-two degrees weft, eleven chains and fifty-eight links; thence fouth, five degrees weft, five chains; thence fouth, fifteen degrees eaft, nine chains, to a rock marked John Champlain, 1788; thence on the fame courfe to low water mark; thence north-eafterly, along low water mark, until the point of beginning bears north, eighty-two degrees weft; thence to the place of beginning.

III. And be it further enaded, That the firft election in First election and this ftate for fuch reprefentatives as aforefaid shall begin future general elec tions, when to be and be held on the fourth Tuesday of January next; and the next general election for fuch reprefentatives in this ftate fhall begin and be held on the fecond Tuesday of December, which will be in the year one thoufand feven hundred and ninety four; and every fubfequent general election for fuch reprefentatives in this ftate fhall be held on the fecond Tuesday of December in every fecond year thereafter; and from which days the fame may be refpectively continued to exceed five days. by adjournment, if neceflary, from day to day, not exceeding five days, until the fame fhall refpectively be completed. IV. And be it further enaded, That the committee anCommittee of can- nually to be appointed by virtue of the act entitled, An act Their authority & for regulating elections, or the major part of them, shall, and hereby are authorized and required, to canvass and eftimate the votes to be taken at any election for fuch representatives, and fhall on the fourth Tuefday after the commencement of every general election, meet together at the office of the fecretary of this flate, and there on that day, and on fo many days next fucceeding thereto (Sundays exAs to the time of cepted) as fhall be neceffary for that purpofe, proceed to meeting and canvas open the faid boxes, one after the other, and the enclofures therein contained respectively, and canvafs and eftimate the votes therein contained, returned into the office of the secretary of this state as aforefaid; and as foon as they fhall be able to determine upon fuch canvass and eftimate, who by the greatest number of votes fhall have been chofen a member of the house of reprefentatives of the Congress of the United States of America, in each of the faid diftricts respectively, and, within fourteen days next after the firft day of their meeting as aforefaid, they fhall determine the famme; and thereupon, without delay, When they hail make and fubfcribe, with their own names and hands determine who are writing, a certificate of fuch determination, in a book to be certicate thereof kept for that purpose, in the faid fecretary's office, there to notify the members remain of record, and without delay deliver, or caufe to be delivered, a true copy thereof, fo fubfcribed as aforesaid, to each of the perfons fo elected refpectively, and another copy, fo fub

V.
