§ 3. It shall be the duty of the said commissioners, with- To account. in two years from the passage of this act, to account to the supervisor of said town for all moneys received or expended under this act, and the balance, if any remains after completing said bridge, shall be paid to the commissioners of highways of said town, to be expended in repairing roads and bridges therein.

4. The said commissioners shall, before they enter up- To give on their duties as aforesaid, execute a bond to the super- bond. visor of said town, in the penal sum of eight hundred dollars, conditioned for the faithful discharge of their duties under this act.

§ 5. Each commissioner shall be allowed one dollar per day for every day necessarily employed in the discharge of his duties under this act, and are hereby permitted to retain the same out of the moneys which may come into their hands as aforesaid.

CHAP. 134.

AN ACT authorizing the erection of a fire-proof clerk's office in the county of Wayne.

§ 1. The board of supervisors of the county of Wayne Money to be are hereby authorized, in their discretion, at their next annual meeting, and sooner if they see fit to convene for such purpose, to cause to be levied and collected from the taxable inhabitants of said county, in the same manner as the contingent expenses of the county are directed by law to be levied and collected, a sum not exceeding fifteen hundred dollars, for the purpose of paying for the building of a fire-proof clerk's office in said county, and for the purchase of a lot for the same, if necessary; and the said sum of fifteen hundred dollars may be borrowed in such portions, and at such times, as the said supervisors may deem expedient.

§ 2. Herman Jenkins, John M. Holley and Cullen Fos- Building ter are hereby appointed commissioners to superintend the commissionbuilding of said fire-proof clerk's office, to fix the site for the same in the village of Lyons, to receive any moneys from the treasurer of said county by this act authorized to be raised, to contract for materials and work upon said of fice; and in case of the death or refusal to serve of the said commissioners, or either of them, it shall be lawful for the first or senior judge of said county to appoint a person or persons in the place of him or them so dying or refusing to serve as aforesaid.;

§ 3. It shall be the duty of the commissioners so appointed as aforesaid, before they proceed in the discharge of the trust aforesaid, to execute each a separate bond, with at least one sufficient surety, to the board of supervisors of the said county of Wayne, to be approved by the first or senior judge of said county, in the penal sum of two thousand dollars, conditioned for the faithful discharge of their duties under this act.

§ 4. It shall be the duty of the said commissioners to account with the board of supervisors of the county of Wayne, for all moneys expended or received by them, when required.

§ 5.. The board of supervisors of said county are hereby directed to allow to each of the said commissioners, one dollar and fifty cents for each day they, or either of them, may necessarily be employed by virtue of this act, which shall be allowed, audited and paid, in the same manner as other contingent charges are audited, allowed and paid in said county.

CHAP. 135.

AN ACT to extend the charter of the union insurance com

pany.

Passed April 1, 1837. The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The act entitled "An act to incorporate the Union insurance company," passed the thirty-first day of March, in the year one thousand eight hundred and eighteen, as amended by the act to amend the same, passed the seventh day of April, one thousand eight hundred and nineteen, is hereby extended, and the said act shall continue and be in force for the period of twenty-two years from and after the first day of January, one thousand eight hundred and forty. § 2. The legislature may at any time alter, modify or repeal this act.

CHAP. 136.

AN ACT to amend the charter of the Eighth Ward mutual insurance company, in the city New-York.

Passed April 1, 1837.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The Eighth Ward mutual insurance company in the Charter city of New-York, are hereby authorized to receive ten per cent on their deposite notes, to be paid at the time of effecting insurance, by every person who shall become a member of said corporation.

§ 2. This act shall take effect on its passage.

AN ACT to repeal an act entitled "An act to subject certain debts owing to non-residents to taxation."

AN ACT to incorporate the Tioga county mutual insurance

company.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. Asa Woolverton, Henry McCormick, Anson Camp, Corporation Francis Armstrong, Ira Clizbe, Thomas Farrington, James Pumpelly, Stephen Strong, William Platt, George Fisher, Otis Lincoln, Samuel Barrager, Elijah Shoemaker, and all other persons who may hereafter associate with them in the manner hereinafter prescribed, shall be a corporation by the name of "The Tioga County Mutual Insurance Company," for the purpose of insuring their respective dwelling-houses, stores, shops and other buildings, household furniture, merchandize and other property, against loss or damage by fire.

§ 2. The persons named in the first section of this act, shall be the first directors of the said corporation. The business of the said corporation shall be carried on and conducted at such place in the village of Owego, in the county of Tioga, as shall be designated by a majority of the directors thereof present at any regular meeting.

§ 3. The corporation hereby created shall possess all the power and privileges, and be subject to all the restrictions and limitations which are granted to or imposed upon "The Madison County Mutual Insurance Company," by the act incorporating that company, which was passed March 23d,

1836.

4. This act shall take effect immediately after the passage thereof.

CHAP. 139.

AN ACT to incorporate the village of Ellicottville.

Passed April 1, 1837.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

Corporation § 1. All that part of the town of Ellicottville, county of Cattaraugus, which is contained in the following bounds, to to wit: Beginning at a post standing in the centre of the road leading from Ellicottville to Great-Valley, said post being on a line running south thirty degrees east, from the centre of the public square, and at the distance of thirtyfive chains, thirty-five and a half links from the centre of said public square; thence south sixty degrees west, thirtyfive chains and thirty-five and a half links, to a post; thence north thirty degrees west, seventy chains and seventy-one links, to a post; thence north sixty degrees east, seventy chains, seventy-one links, to a post; thence south sixty degrees west, thirty-five chains, thirty-five and a half links, to the place of beginning; shall hereafter continue to be known and distinguished by the name of the "Village of Ellicottville;" and the freeholders and inhabitants residing in said village, are hereby constituted a body corporate, by the name of "The Trustees of the Village of Ellicottville."

§ 2. The corporation hereby created shall possess all the powers and privileges, and be subject to all the restrictions and liabilities, which are granted to or imposed upon the trustees of the village of Angelica, in the county of Allegany, by the act incorporating said village, passed May 2, 1835, with the following alterations and additions, to wit: The first meeting of the inhabitants of said village, for the

election of such officers as are authorized by this act, shall be held on the first Tuesday in May next, and the annual meeting thereafter for such election, shall be held at such time as a majority of the inhabitants entitled to vote for members of assembly therein, at their first meeting shall designate.

§3. All taxes upon any real estate in said village shall be Taxes. collected in like manner as the taxes of counties and towns are collected; and if the same cannot be collected by the collector of said village in the time provided by the by-laws of the corporation, he shall make a return thereof to the trustees of said village, and it shall be lawful for said trustees to advertise such lands for six weeks successively, in some newspaper printed in said village, or if no paper shall be printed in said village, then in any newspaper printed in the county of Cattaraugus, requiring the owner or owners to pay the sum assessed thereon to the treasurer of the corporation; and in case default shall be made in such payment, at a day and place therein to be prescribed, that all such lands will be sold at public auction, to the person who will advance the amount of such assessment, with the cost of such advertisement and sale, for the shortest term of years; and if at the expiration of said notice, such owner shall neglect or refuse to pay such trustees, or a majority of them, to cause such land to be sold at public auction, for a term of years, for the purpose and in the manner expressed in such advertisement, and to give a certificate of such sale, under their corporate seal, to the purchaser thereof, his executors, administrators and assigns, who shall, by vírtue thereof, and of this act, lawfully hold and enjoy the same for his and their own use, provided the owner or agent does not pay the said taxes with costs, and ten per cent interest, previous to the expiration of said term of time. for which it was sold.

§ 4. Each officer whose election or appointment is vided for by this act, before he shall enter on the duties of his office, shall take and subscribe the oath required by the sixth article of the constitution.
