REPORT OF THE COMMISSION DIVISION 3, COMMISSIONERS MCMANAMY, PORTER, AND MILLER BY DIVISION 3: Exceptions to the report proposed by the examiner were filed by complainant, and defendant replied thereto. Complainant, a corporation, alleges by complaint filed June 7, 1937, that defendant's refusal to comply with complainant's request to supply and spot cars at certain places on defendant's team tracks at Cleves, Ohio, to permit the loading of such cars with grain from a loading device owned by complainant and located on property leased by it, and to grant to complainant such use of certain real estate owned by defendant as may be necessary for such loading, was and is unreasonable and unduly prejudicial. We are asked to issue am order requiring that defendant comply with this request. Complainant buys and sells grain at various points in Ohio and Indiana. It owns and operates a grain elevator at Milroy, Ind., and also one at Cleves, which is a local point on defendant's line 16.1 miles northwest of Cincinnati, Ohio, and within the Cincinnati> switching limits.
