been made, and also the amount of moneys then in his hands belonging to said village, and at the expiration of his office shall deliver and pay over to his successor in office all the books, papers and moneys in his hands or possession pertaining to said office.

§ 14. It shall be the duty of the clerk of said village to keep all the books and papers belonging to said village, to attend all the meetings of the village board, to keep a journal and record the proceedings of said board at every meeting thereof, to record all by-laws, orders, rules, regulations, ordinances and resolutions made or passed by said board; to receive, file and preserve all returns of the election of village officers, all reports of the treasurer, all bonds of village officers, with the approvals thereof, all returns of votes taken or any resolutions submitted to the electors and taxable inhabitants of said village for approval or disapproval, and all other papers required to be filed by any provisions of this act, or by the direction of said board; to attend at all elections of village officers, and at all votings upon any resolution submitted as aforesaid, and to keep a poll of all persons voting at any such election, or upon the resolutions so submitted, under the directions of the presiding officers; to procure the publication of all notices in the manner prescribed and directed by this act, or by any by-law, order, rule, regulation, ordinance or resolution of said board; to serve written notices of their election on all officers elected under this act; to give and serve all other notices required to be given or served by said clerk under this act, or under any by-law, order, rule, regulation or ordinance or resolution of said board; to keep an accurate account, under appropriate heads, of expenditures, of all warrants and the ⚫ amount thereof, drawn by said board or the treasurer in a check book to be kept by him for that purpose; to make out and add to the annual assessment roll, filed by the assessors of said village with the said clerk, the ratable amount which each person so assessed shall be required to pay towards the taxes assessed upon said village; to keep the corporate seal of said village, and to perform all other duties required by this act, or by any by-law, order, rule, regulation or ordinance or resolution of said board.

§ 15. The constable of said village shall within five Constable. days after his election execute a bond to the village of Cleveland, in such sum and with such sureties, not less than two in number, as the president shall approve, conditioned that he shall faithfully execute the duties of his office and account for and pay over all moneys received by him according to law, which bond, with the approval of the president endorsed thereon, shall be filed with the clerk of said village; and such constable shall perform the duties and be subject to the liabilities and obligations prescribed by law for town constable within the limits of said village, and shall also receive the same fees for like services as are allowed by law to town constables.

16. The collector of said village, before he shall Collector. enter upon the duties of his office, shall execute a bond to the village of Cleveland, in such sum, not less than one thousand dollars, with sureties, not less than two in number, as the president and any two of the trustees shall approve, conditioned that he shall faithfully execute the duties of his office and account for and pay over all moneys received by him according to law on such taxes and assessments, which bond with the approval of the president and said trustees endorsed thereon, shall be filed with the clerk of said village; and such collector shall possess the powers, perform the duties and be subject to the liabilities and obligations prescribed by law for town collectors; and all taxes to be collected for the use of said village, shall be collected by him, and he shall receive the same compensation for like services as is allowed by law to town collectors.

17. The assessors of said village shall have the power, Assessors. and shall perform all the duties in relation to the assessments of taxable inhabitants, and also of taxable property, real or personal, in said village, the same as town assessors are now required by law to do, and shall give notice and review their assessments in like manner; and it shall be the duty of the said assessors, while making their assessment of the real and personal estate in said village, to ascertain the names of all persons residing in said village who shall then be liable to a poll tax for highway labor, and enter the same upon their assessment

roll; and there shall be but one assessment of property in said village in any one year; and such assessment shall be made annually by said assessors, and shall be completed by them on or before the first day of June in each year, and when so completed they shall file the same immediately with the clerk of said village. Each assessor shall receive for his compensation one dollar and twenty-five cents per day for the time actually spent by him in the performance of his duties as such assessor.

18. The street commissioner shall have the general supervision and charge of all public grounds, and the highways and sidewalks of said village, under the direction of the village board; and the said board may limit, regulate and restrain him in the performance of his duties; and such commissioner shall be required to perform all such duties pertaining to his office as the said board may from time to time prescribe, and shall be allowed such compensation for his services as the said board shall deem reasonable, which compensation shall be fixed and determined by said board.

§ 19. It shall be the duty of the attorney of said village to advise with and counsel the village board in all legal questions arising in any matter pertaining to the interests of said village, or in any action or proceeding in which the said village may be a party, or in which the said village shall be interested, and to draft all such bylaws, orders, rules, regulations, ordinances and resolutions as the village board shall from time to time direct, and to act as the attorney and counsel for said village on the trial of all actions or proceedings commenced by or against said village, or in which it shall be interested, and shall be allowed such compensation for his services as the board shall deem reasonable.

§ 20. The chief engineer and assistant engineer of the department fire department shall have the general superintendence and charge of all fire engines, hose, hose carts, hooks and ladders, and implements connected therewith, belonging to said village; and all engine houses and other buildings for keeping and protecting the same, subject to the direction of the village board; and shall perform such duties and possess such powers, and shall be subject to such

liabilities as shall from time to time be prescribed by the village board, and shall receive such compensation for their services as such board shall deem reasonable.

21. The fire wardens, pound master, police officers, Fire warwatchmen and pathmasters, and each of them shall per- officers, &c. form such duties, and possess such powers, and be subject to such liabilities as shall from time to time be prescribed by the village board.

§ 22. The trustees shall be fence viewers, and shall Fence possess the authority of such officers prescribed by law, in respect to division fences or walls in said village.

§ 23. No member of the village board shall be inter- Contracts ested in any contract to which said village shall be a party.

§ 24. The village of Cleveland shall have power, and Taxes. is hereby authorised, in the manner prescribed by this act, to raise by general tax to be assessed upon all the property in said village, which now is or hereafter shall be liable to taxation for county purposes, (except such property as shall by this act be exempted from taxation,) all sums which shall be necessary for the following objects and no other:

1. For defraying the ordinary expenses of said village. 2. For procuring and keeping in repair all necessary Engines. fire engines, the necessary hose carts and apparatus therefor, and all the necessary implements for hook and ladder companies, including the engines, hose, hose carts, appaparatus and implements that may be owned by said village. 3. For procuring the necessary grounds, and erecting Engine thereon and keeping in repair, or for hiring suitable engine houses and buildings for keeping and protecting all such fire engines, hose, hose carts, apparatus and implements that may be owned by said village.

4. For making and maintaining all necessary public Water. wells and reservoirs of water, and for procuring the necessary fixtures therefor.

5. For procuring the proper and necessary ground in Pound. said village, and erecting and maintaining thereon, for the use of said village, a suitable pound.

§ 25. Under the term "for defraying the ordinary expenses of said village," used in the last preceding section, shall be included all necessary advances in making and repairing sidewalks, when any person or persons required to make or repair the same shall neglector refuse so to do; also, all sums necessary for insuring the public property of said village; also, all sums necessary for the prosecuting or defending any action or actions in which the said village shall be a party; also, all necessary sums for procuring blank books and stationery for the use of said village; also, all sums necessary for publishing all by-laws, ordinances, notices, and all other things required or authorised to be published; and also all sums for the necessary expenses of doing any act or thing for said village not hereinbefore enumerated, which it or any of its officers shall by law be required or authorised to perform.

§ 26. The village board shall hereafter, subsequent to each annual election, and on or before the last Tuesday in April in each year, at a regular meeting thereof to be called for that purpose by separate resolutions in writing, to be passed by said board, fix the amount to be raised by tax on said village for the year then next ensuing, under each of the subdivisions of the twenty-fourth section of this act, except under the first of said subdivisions, and shall specify in each of said resolutions the specific purpose to which each amount so to be raised shall be applied; and in case the said board shall determine at such meeting that a sum exceeding five hundred dollars is necessary to be raised under the first of said subdivisions, then the said board shall at such meeting, by a separate resolution in writing as aforesaid, fix the amount to be raised under the first of said subdivisions exceeding the sum of five hundred dollars, all of which resolutions shall be submitted to the electors and taxable inhabitants of said village for approval, as hereinafter provided.

§ 27. No resolution shall be passed by said board, fixing the amount to be raised by tax on said village under
